Ordinance - 19-01 - Amend Chapter 1, Section 1-14 -Citations and FinesCITY OF SPRING PARK HENNEPIN COUNTY, MINNESOTA ORDINANCE NO. 19 —01 AN ORDINANCE AMENDING CHAPTER 1, SECTION 1-14 OF THE SPRING PARK CITY CODE RELATING TO ADMINISTRATIVE CITATIONS AND FINES THE CITY COUNCIL OF THE CITY OF SPRING PARK, MINNESOTA ORDAINS AS FOLLOWS: Section 1. Chapter 1, Section 1-14(e) of the Spring Park City Code is amended as follows: (e) Administrative fines; late payment or, failure to pay. (3) A lien may be assessed against the property and collected in the same manner as taxes. Before the City assesses an unpaid administrative fine against the property, it will give written notice to the violator and an opportunity to be heard by the City Council. Section 2. Chapter 1, Section 1-14(h) of the Spring Park City Code is amended as follows: (h) Criminal penalties. The f hewing a o iside .,eane,.s ptmishable ; aeeer-dane-e with state law. pe If the final determination in the administrative penalty process is a finding that no violation occurred, then the city may not prosecute a criminal violation in district court based on the same set of facts. This does not preclude the city from pursuing a criminal prosecution for a violation for the same provision based on a different set of facts. A different date of violation will constitute a different set of facts. Section 3. Effective Date. This ordinance shall be in full force and effective immediately upon its passage and publication.
