Resolution - 15-19 - CUP Norlings Landscape• RESOLUTION NO. 15-19 CITY OF SPRING PARK HENNEPIN COUNTY, MINNESOTA A RESOLUTION APPROVING AN EXTENSION OF THE 2011 CONDITIONAL USE PERMIT FOR OUTDOOR SALES DISPLAY FOR NORLING'S MINNETONKA LANDSCAPES LOCATED AT 4332 SHORELINE DRIVE WITHIN THE CITY OF SPRING PARK, MINNESOTA WHEREAS, Norling's Minnetonka Landscapes has received approval in 2011 for a conditional use permit to allow outdoor sales display in a C-1, General Commercial Zoning District; for property at 4332 shoreline Drive in Spring Park; and WHEREAS, In September 2012, the Applicant sent a letter requesting a CUP extension and received an extension until September 2015; and. WHEREAS, The applicant has not yet implemented the approved CUP; and WHEREAS, The applicant has submitted a letter prior to CUP expiration, requesting an additional time extension of the 2011 CUP approval to allow them to • install the site improvements by May 2016; and WHEREAS, The city staff has reviewed the applicant's request for extension and the past CUP improvements and find them to be consistent with zoning, consistent with Comprehensive Plan policies and a physical improvement to the appearance and utility of the site; and WHEREAS, Upon review the city staff is recommending that the City Council extend the CUP approval for Outdoor Sales Display at 4332 Shoreline Drive with the conditions of the original approval: and WHEREAS, the Spring Park City Council has reviewed and considered the extension of the 2011 conditional use permit for Norling's Minnetonka Landscapes located at 4332 Shoreline Drive in Spring Park and agrees with the findings and recommendations of the City staff. NOW, THEREFORE BE IT RESOLVED that the City Council of Spring Park, Minnesota hereby approves an extended implementation period for the 2011 conditional use permit for outdoor sales display for the property at 4332 Shoreline Drive in accordance with the plans dated August 2011 and subject to the following conditions: 1. The sales display area located on the east side of the curb cut shall be striped on • site to delineate the size and location of the sales display area in accordance with the approved plan. 2. All parking stalls shall be striped on site and be properly dimensioned to be at least 8 feet 9 inches wide by 19 feet deep. • 3. The freestanding sign and its base shall be set back from the Shoreline Drive right-of-way in a manner that preserves the traffic sight lines along Shoreline Drive. Said location shall be approved by the City Planner. 4. All improvements must be completed no later than May 30, 2016.
