Suzanne, attached is a building permit form we discussed. I also attached our
zoning code as it relates to the district the Yacht Club is located in. Upon looking
at the code for that district, it looks as though what you are proposing might
require a conditional use permit (Subd. D).
If you are seriously considering locating your business at the Yacht Club, I would
suggest you phone or come in to meet with me and/or our administrator, Jim
Brimeyer. At that time we can discuss further the requirements for the
conditional use. At this time a building permit submission would probably not
satisfy the zoning requirements so a discussion with our staff would be the best
first step.

SECTION 18. "C-4", OFFICE COMMERCIAL DISTRICT
Subd. A Purpose. The purpose of the "C-411, Office Commercial
District is to provide a district which may reasonably
adjoin high density residential districts for the
location and development of administrative office
buildings and related uses and which provides a
transition in land use from residential uses to more
intensive uses. The intermixing of office and
residential uses is also permitted under some
circumstances.
Subd. B Permitted Uses. The following are permitted uses in a
11C-411 District:
Offices for administrative, executive, professional,
research and similar organizations (such as attorneys,
accountants, architects, engineers, insurance agents,
manufacturers representatives and stock brokers) in which
there is limited in -person contact with clients,
customers or the public generally in the office setting.
Subd. C Permitted. Accessory Uses. The following are permitted
accessory uses in a 11C-4" District:
1. Off-street parking as regulated by Section 3, Subd.
G of this Ordinance.
2. Off-street loading as regulated by Section 3, Subd.
H of this Ordinance.
3. Docking facilities as regulated by the Lake
Minnetonka Conservation District.
Subd. D Conditional Uses. The following are conditional uses in
a "C-4" District and require a conditional use permit
based upon procedures set forth in and regulated by
Section 6 of this Ordinance.
1. Offices for the provision of services (such as real
estate agencies, medical and dental offices and
clinics, optometrists and opticians offices, and
ancillary laboratories, employment offices, loan
offices, photographer's studios, barber shops and
beauty shops) where in -person contact with clients,
customers and the public generally is customary,
provided that:
a. The off-street parking requirements of this
Ordinance will be met, taking into account all
existing uses of the site and the proposed
conditional use.

b. The requirements of Section 6 of this
Ordinance are met.
2. Multiple family dwelling structures provided that:
a. The proposed site contains at least two
thousand five hundred (2,500) square feet of
lot area per dwelling unit.
b. The proposed site is adjacent to a collector
or arterial street.
C. At least one (1) garage space is provided for
each dwelling unit.
d. The proposed site is landscaped and screened
with planting materials in accordance with
Section 3, Subd. C.6 of this Ordinance.
e. The requirements of Section 6 of this
Ordinance are met.
3. Accessory retail commercial uses provided that:
a. Merchandise is sold only at retail.
b. The retail use is located within a structure
whose principal use is neither retail sales
nor residential.
c . The retail use does not occupy more than ten
(10) percent of the gross floor area of the
tenant space of the building within which such
retail use is located.
d. No directly or indirectly illuminated sign or
sign in excess of ten (10) square feet
identifying the retail business shall be
visible from the outside of the building.
e. No signs or posters of any type identifying or
advertising products for sale shall be visible
from the outside of the building.
f. The requirements of Section 6 of this
Ordinance are met.
4. Yacht clubs provided that:
a. The yacht club docking facilities comply with
the requirements of the Lake Minnetonka
Conservation District.

b. Banquet and food services associated with the
yacht club shall be limited to special events
and shall be available to yacht club members,
and owners of site riparian or leasehold
interests only. Commercial food and liquor
sales available to the general public are
prohibited.
c. Yacht club conference and meeting rooms may be
made available to the general public only for
civic, educational and safety.purposes.
d. Fuel sales and boat repair and servicing are
prohibited on site.
e. No boats shall be stored on site. No boat
trailers shall be parked on site.
f. Accessory retail activities shall not occupy
more than ten (10) percent of the gross floor
area of the yacht club facility.
g. In addition to the specific off-street parking
requirements of this Ordinance, at least one
(1) parking stall shall be provided for every
three (3) boat slips.
h. All lighting shall be hooded and so directed
that the light source shall not be visible
from the public right-of-way or from
neighboring residences and shall be in
compliance with Section 3, Subd. G.7.e.10 of
this Ordinance.
i. Parking or car stacking space shall be
screened from view of abutting residential
districts in compliance with Section 3, Subd.
G of this Ordinance.
k.

The entire area shall have a drainage system
which is approved by the City Engineer and the
Minnehaha Creek Watershed District.
The proposed site shall be landscaped and
screened with planting materials in compliance
with Section 3, Subd. C.6 of this Ordinance..
The requirements

Subd. E Lot Requirements and Setbacks. The following minimum
requirements shall be observed in a "C-4" District,
subject to additional requirements, exceptions, and
modifications set forth in this Ordinance.
1. Lot Area: 12,000 square feet
2. Lot Width: One hundred (100) feet
3. Setbacks:
a. Street Side: No less than thirty (30) feet
where abutting a city street. No less than
fifty (50) feet where abutting a county
street.
b. Side Yard:
(1) Except as provided in paragraphs (2) and
(3) below, not less than ten (10) feet on
any side yard.
(2) No less than thirty (30) feet on any side
yard abutting a city street, and fifty
(50) feet on any side yard abutting a
county street.
(3) No less than twenty (20) feet on any side
yard abutting residentially zoned
property.
C. Ordinary High Water Mark: No less than fifty
(50) feet.
d. Top of Bluff: No less than thirty (30) feet.
4. Building Height: No structure shall exceed three
(3) stories or forty (40) feet, whichever is least,
however, building heights in excess of the
prescribed standard may be permitted through a
conditional use permit, provided that:
a. Public utilities and services are adequate.
b. The site shall be screened and landscaped in
accordance with Section 3, Subd. D.8 in order
to minimize the visual impact of the
additional building height.
C. The requirements of Section 6 of this
Ordinance are met.

5. Lot Coverage: All lots within the C-4 District
shall comply with the following standards:
a. An existing site which is being altered,
remodeled, or expanded without expanding the
existing impervious surface may be allowed
through the plan review process established in
Section 5 of this Ordinance.
b. New construction on conforming lots or an
existing site being altered, remodeled, or
expanded which expands the existing impervious
surface coverage may be allowed through the
plan review process established in Section 5
of this Ordinance, provided the impervious
surface coverage does not exceed seventy-five
(75) percent of the total lot and provided the
following stipulations are met:
(1) All structures, additions or expansions
shall meet setback and other requirements
of this Ordinance.
(2) The lot shall be served by municipal
sewer and water.
(3) The lot shall provide for the collection
and treatment of storm water in
compliance with the City Stormwater
Management Plan if determined that the
site improvements will result in
increased runoff directly entering a
public water. All development plans
shall require review and approval by the
City Engineer and the Minnehaha Creek
Watershed District.
C. Impervious surface coverage may be allowed to
exceed seventy-five (75) percent of the total
lot or exceed existing conditions on the lot
which are over seventy-five (75) percent
provided the following stipulations are met:
(1) Improvements that will result in an
increased rate of runoff directly
entering a public water shall have all
structures and practices in compliance
with the City Storm Water Management Plan
in place for the collection and treatment
of storm water runoff or will be
constructed in conjunction with a
conditional use permit application.

(2) A conditional use permit is submitted and
approved as provided for in Section 6 of
this Ordinance.
(3) All the conditions in l.b (1-4) above are
satisfactorily met.
d. Measures for the treatment of storm water
runoff and/or prevention of storm water from
directly entering a public water include such
appurtenances as sediment basins (debris
basins, desilting basins, or silt traps),
installation of debris guards and microsilt
basins on storm sewer inlets, oil skimming
devices, etc.
6. Bluff Impact Zones: Structures and accessory
facilities, except stairways and landings, must not
be placed within bluff impact zones.
7. Shore impact zones: Structures and accessory
facilities except docks must not be placed within
shore impact zones.
8. Uses Without Water -oriented Needs:
a. Commercial uses without water -oriented needs
must be located on lots or parcels without
public waters frontage, or, if located on lots
or parcels with public waters frontage, must
be landscaped to obscure view of structures or
buildings from the water by vegetation or
topography, assuming summer, leaf -one
conditions.
b. Structures, parking areas, and other
facilities shall be treated to reduce
visibility as viewed from public waters and
adjacent shorelands by vegetation, topography,
increased setbacks, or color, assuming summer,
leaf -on conditions., Vegetative and
topographic screening shall be preserved, if
existing, or may be required to be provided.
C. Accessory structures and facilities shall meet
the required principal structure setback and
shall be centralized.

Jerry, according to the property jacket file for the Yacht Club, 4165
Shoreline Drive, records show in November, 1989, financing had been
approved, the owners were interviewing contractors and were optimistic
about building in the spring of 1990. There were two variances granted
for the building project, one for a lakeside setback of 37 feet instead of
the 50 and the other for an alternate parking plan.
In December of 1992, a one year extension was granted for both
variances as the project had stalled due to lack of financing.
A building permit was granted on February 14, 1995 for the cost of
$14,360.18 to erect a three story building. The file contains photographs
dated July of 1995 showing an almost completed structure. A Certificate
of Occupancy was granted to RDP Partners on August 31, 1995.

The City Council has before it concurrent proposals for the
creation of a C-4 zone, for the rezoning of a parcel along County Road 15
from R-3 to C-4, and for the granting of variances which would permit the
development of the parcel for mixed business uses including an office and
yacht club.
It is my understanding that the City Planner has been asked to
review the proposed amendement to the zoning ordinance. I have not seen
any comments from the Planner and an unaware of the degree to which he has
had input regarding the drafting of the ordinances. I have had an
opportunity to review the results of the Planning Commission's recent
public hearings, however. The Commission has recommended adoption of the
new classification, the rezoning of 4165 Shoreline Drive and the variances.
The Commission does not appear, however to have made any formal findings of
fact as provided in Section 4, Subd. C.3 of the zoning ordinance. The
minutes do reflect testimony given at the hcaring. Given tha fact that tree
matter will be before the. Council tonight, some comments regarding the
choices available to the Council are in order.
Section 4, Subd. D and Subd. E of the zoning ordinance relates to
Council action. After receiving the Planning Commission's report, the
Council may set and hold its own public hearing before acting. This should
be done if the Planner recommends material changes in the proposed
ordinance which neither the public nor applicant have had an opportunity to
review or if an adequate record cannot otherwise be prepared. The reasons
for holding a hearing before the Commission and,or the Council are to get
public input and to ensure that there is a record of the testimony and
exhibits presented. The record in any zoning matter should list all

exhibits presented, summarize the testimony, summarize the discussion, and
state the reasons for making a decision. It is not enough to simply
reporting the decision in a conclusory fashion. In the absence of and
adequate record, a court may conclude that the Council's decision was
unreasonable, arbitrary and capricious and it may be overturned. On the
other hand, where an adequate record exists, a court will be able to
determine, without granting a full trial, that the Council acted
reasonably. Spring Park's ordinance requires that the Council make its own
"recorded finding of fact" and this requirement should be met. Amendment
of the zoning ordinance will require four votes.
The Council's options are to (1) not rezone the land; (2) rezone
the land only if the applicant has a viable project which meets conditions
imposed by the City, agreeing that if this project cannot be built the land
ought to remain R-3; (3) rezone the land without regard to the applicant's
plans, agreeing that the land is generally suitable for office/commercial
r.,srposes (which may be described.in the ordinance as permitted or
conditionally permitted uses); or (4) amend the zoning ordinance to make
the applicant's intended use a conditional use in the R-3 zone.
As to the first, the law is that the City is not required to
rezone property, but has broad discretion. See eg. Sun Oil Co. v. Village
of New Hope, 220 N.W.2d 256 (Minn. 1974). The Councl�cou. conclude based
on tFerecord either that there is no need for the zone or that the
proposed location is inappropriate.
"Conditional zoning," the second option, has not been specifically
approved by the Minnesota Supreme Court or expressly authorized by the
legislature. Courts around the country are evenly split as to its
legality. While there is some risk in following this tack, it is my
opinion that it is a defensible and useful technique for assuring that land
appropriate for more intensive use is developed only after the Council has
determined that adjacent, less intensive uses will not suffer and will be
protected from significant adverse effects of the rezoning. An ordinance
conditionally zoning the property should address the following:
(a) Legally describe the subject property;
(b) Fully describe the C-4 zoning classification including
permitted, accessory and conditional uses (it is my
understanding that the applicant's proposed use would only be
conditionally permitted in the C-4 zone), lot req,.,irements,
building requirements and progressivity. The conditions
imposed on uses, and lot and building requirements must be
reasonably related to the public health, safety and welfare
as revealed in the public hearings. The conditions should be
spelled out in detail in the ordinance and could include
hours of operation, liquor licensing, permissibility of
repair businesses, outdoor dining, etc. With the applicant's
agreement, and if the conditions for giving permits have been
adequately discussed by the planning commission the Council
could be deemed to include a petition for a conditional use
permit and a further hearing can be avoided.

(c) State the conditions upon which the property will be rezoned
from R-3 to C-4. These conditions could include the
applicant's securing a building permit for improvements which
meet all of the conditions of the ordinance, the applicant's
securing any necessary conditional use permit, and the
commencement of construction. Deadlines must be specified
for each condition. If conditions are not timely met, the
land will remain zoned R-3. If the conditions are met, the
land is rezoned C-4.
(d) The provisions of the ordinance should be stated to be
non -severable such that if any one condition is declared
invalid, the entire ordinance is invalid and the land remains
zoned R-3.
The combination of conditional zoning and a conditional use permit can be
most effective. If the development does not proceed, the land remains
zoned R-3. If it proceeds, the conditions of the conditional use permit
must be continuously met, or the permit lapses. Of course, if the permit
lapses, the owner will be permitted to use the land for any permitted or
conditional C-4 uses for which it qualified. This is why the entire
ordinance, not just this applicant's proposal, must be thoroughly
considered.
Simply rezoning from R-3 to C-4, the third choice, is certainly
easier than the second option and its legality is clear. It does, however,
create the risk that this project will not be built and one which is less
tailored to meet the needs of the community and the objections of adjacent
owners will be built in its place. This risk can be reduced by putting
detailed lot and building requirements in the ordinance. r
The fourth choice is appealing in that it could be narrowly drawn
to permit the applicant's use as a conditional use in the R-3 zone, but the
conditional use permit would lapse if not used within one year. The
property would always remain zoned R-3. This approach is so different from
that considered by the planning commission that a further public hearing
would be required. Section 4, Subd. E of the zoning ordinance permits the
council to conduct the hearing. Alternatively, the matter could be
referred back to the planning commission.
I hope that this information is useful to you as you consider the
planning commission's recommendations.

BACKGROUND
In an effort to determine the appropriateness of off-street
parking standards applied to the Yacht Club proposal and the C-4
Zoning District as a whole, our office has contacted a number of
cities and researched parking standards as a means of
comparison.

Parking Generation
The following parking generation figures were compiled from the
Institute of Transportation Engineers (ITE) 1985 Report Titled
"Summary of Parking Occupancy Data".
Office:
Parking generation rates for offices under 50,000 square feet
are as follows:
Range of generation:
One space for each 1,333 square feet at the low end.
One space for each 212 square feet at the high end.
Current Spring Park Code minus 10 percent credit:
One space for each 220 square feet.

The City's established figure easily falls within the applicable
.range found by ITE.
It is important to note that the City must establish parking
requirements that reflect the high end or by assuming the most
intense use. This is necessary because the figure applies to
office buildings in general and does not discern between active
offices that generate a lot of traffic or offices that produce
very little traffic due to the nature of the office use.
Marina:
The ITE Parking Generation Report also studied the use of parking
spaces required per boat slip or berth for weekdays, Saturdays
and Sundays:
Weekdays - .27 parking spaces per berth
Saturdays - .70 parking spaces per berth
Sundays - .49 parking spaces per berth
The City's required one space for each three boat slips gives a
calculation of .33 spaces per slip. This figure appears to be
comparable, if not slightly liberal, compared to the ITE report.
Clubs Serving Food and/or Drinks:
ITE calls for .39 parking spaces per seat.
Spring Park Ordinance calls for one space for every three seats
or .33 spaces per seat.
Consistency with Other Communities
The following communities and their requirements for off-street
parking are listed below:
White Bear Lake, MN
Office = 1 space for every 200 square feet of gross floor area.
Marina = By conditional use; case by case - generally one
space per slip.
Club = One per 40 square feet of dining and bar area plus
one per 80 square feet of kitchen area.
Shorewood, MN
Office = Three spaces plus one for each 200 square feet of
gross floor area.
Marina = One space per boat slip
Club = Case by case
Excelsior, MN
Office = One space for every 250 square feet of gross floor
area.
Marina = Conditional use; determined on a case by case basis.
Club = One per 3 seats or one per 35 square feet of gross
floor area.
Tonka Bay, MN
Office = Three spaces plus one for each 200 square feet of
gross floor area.
Marina = One space for every two boat slips.
Club = One space per 40 square feet of dining and bar plus
one for each 80 square feet of kitchen space.
Minnetonka, MN
Office = Four spaces for every 1,000 square feet of gross floor
area.
Marina = No established standards.
Club = If no liquor is served, one for each 60 square feet of
gross floor area or one for every 2.5 seats whichever
is greater.
If liquor is served, one for each 60 square feet of
gross floor area or one for every two seats whichever
is greater.
SUMMARY
Based on the required off-street parking requirements listed
earlier in this report, it appears that Spring Park's standards
for calculating off-street parking requirements are consistent
with what other communities and national standards, as such they
should be maintained.

Access. The Yacht Club proposal as shown on Exhibit 2, shows
site access occurring via County Road 15 to the north and will
require a cross over in the said roadway's raised median. With
the Edgewater Apartments access lying 120 feet to the west,
there is some concern that stacked vehicles awaiting left turns
into the apartment complex may impede vehicles wishing to access
the subject site.
According to a Hennepin County Highway representative, the County
has no minimum required spacing of crossovers. However, in
review of the proposed crossover, the County recommended denial
of the request on the basis that by allowing the said access
point, the purpose of limiting access via the raised median is
being diminished. Without a median curb cut a right turn
in/right turn out access scenario will be required. According
to the said DOT 'representative, the City must make the final
decision regarding the appropriateness of the proposed crossover.
The access location of the proposed yacht club is a critical
issue that must be worked out prior to final approval of the
project as relocation of the said access point may alter the site
design considerably.
Curb Cut Width. The proposed curb cut width onto County Road 115
is 25 feet in width and conforms to the 25 foot minimum required
by the City Ordinance.
Parking. As shown on Exhibit 2, the proposed yacht club provides
117 parking spaces. According to a strict interpretation of the
Ordinance -standards and shown below, 124 spaces are required of
the proposal. This results in a parking deficiency of seven
spaces.
Yacht Club/Office Building. The proposed building exhibits
a gross floor area of 22,440 square feet. The City
Ordinance suggests one space for each 200 square feet of
floor area for office type uses.
22,440 x .9 = 20,196 - 200 = 101 spaces required
Yacht Club/Boat Marina. The Yacht Club is proposing a 32
boat marina. According to City parking standards, one
parking space per three slips is suggested.
32 slips - 3 = 11 spaces required
Sailing School. The Yacht Club is intending to have a six
boat sailing school. This use will generate its own parking
demand if operating during office hours. At full capacity,
six parking spaces may be needed. A one stall per boat
ratio is suggested.
6 boats - 1 = 6 spaces required

Swimming School. The Yacht Club will include swimming
lessons. Parking demand is determined on the basis of class
sizes. With the likelihood of some car pooling and drop off
students, our office would recommend a parking standard of
one space per instructor plus one space for each four
students per peak hour. A representative of the West Tonka
Community Center has indicated that a maximum of two
instructors and 14 students could be expected as a maximum
at one class session.
14 students - 4 = 4 + 2 = 6 spaces required
Parking Requirement Alternative. According to a strict
interpretation of the parking required for office uses, one
space is required per 200 square feet of office less 10
percent for common space (mechanical rooms, hallways, etc.).
With the yacht club demonstrating a single loaded corridor
design, its percentage of common space is much greater than
the typical 10 percent used in office structures with the
common double loaded corridor design. With this in mind,
the City may wish to consider a lesser parking standard
than the 101 office spaces required by Ordinance. As shown
on Exhibit D, 26 percent of a typical yacht club floor is
designated as "common space" that typically will not
generate parking demand. Therefore the following parking
requirement may be considered as an alternative.
22,400 sq. ft. x .74 = 16,576 - 200 = 83 spaces
required
By applying the aforementioned adjusted office parking
standards, 106 spaces are required of the entire yacht club
proposal resulting in an excess of 11 spaces.
Parking Summary. According to a strict interpretation of City
parking standards with no credit given to overlapping uses, a
parking demand of 124 vehicles can be expected. By altering the
standard applied to office uses as previously described, a
parking demand of 106 vehicles may be expected. The City must
determine which parking requirement alternative is most prudent
and appropriate prior to final approval of the yacht club
proposal.

As noted in the January 16, 1989 Planner's Report, the proposed
office and Yacht Club proposal was deficient in parking. The
applicant calculated parking demand on the office building
without the Yacht Club floor space.

If the Yacht Club is operating during regular business hours, the
site plan must provide on -site parking for each of its related
activities. The previous planner's report outlined several
parking estimations, however, this was without knowledge of the
full range of activities that are to be included on -site.
A Yacht Club is a new use not specifically addressed by the
City's parking standards. In these instances, the City must
determine the appropriate parking standards. The following
parking standards and calculations are offered for the City's
consideration:
Office: The City may the Yacht Club floor space in the
total office space calculation, or deducted and calculate it
independently.

28,992 - 4,000 = 24,992 x .9 - 200 = 112 spaces
Yacht Club Building Space: This building space is intended
to provide locker rooms and meeting space. The parking
demand generated by this actual floor space will generally
be associated with the other Yacht Club activities such as
the boat slips, swimming lessons or sailing lessons.

In addressing the parking demand of the Yacht Club floor
space, the City may tie into the other related activities,
calculate it as part of the office building or treat it as
a private club.
Under the current Ordinance, private club parking is
calculated on a one space per three person seating capacity.
The Yacht Club meeting area has a 50 person seating
capacity.
Seating Capacity - 50 -.3 = 17 spaces
Sailing School: The Yacht Club is intending to have a six
boat sailing school. This use will generate its own parking
demand if operating during office hours. At full capacity,
six parking spaces may be needed. A one stall per boat
ratio is suggested:
Boats - 6 - 1 = 6 spaces
Swimming School: The Yacht Club will include swimming
lessons. Parking demand is determined on the basis of class
sizes. With the likelihood of some car pooling and drop of
students, we would recommend a parking standard of one space
per instructor plus one space per each four students per
peak hour.

Students - 139 - 4 = 35 spaces
Yacht Club: The Yacht Club is proposing a 60 boat marina.
The City has a parking standard for commercial mooring of
one parking space per three slips. This is consistent with
the parking standards prescribed by the Institute of Traffic
Engineers. Yacht Club special events sponsored solely for
club members may result in higher parking demands during
peak times. The Yacht Club may be able to respond to this
parking influx by scheduling special events during off -
office hours.
,To address the parking demand for a Yacht Club, the City can
choose to impose the existing marina standard or a more
stringent yacht club standard.

The City Planner had presented an alternate parking plan for the proposal,
because of the amount of common space in the building and a different
interpretation of the ordinance regarding parking requirements. Putnam
stated the valuation of the building is now 1.3 million.
Motion by Weeks second by Thurk to approve the variance for a minimum of
37 feet from the lake. The Mayor asked if there were any other questions
or comments. Weeks stated according to the Attorney's letter Council did
have the right to grant the variance based on the facts and the projection
of the building does add to the aesthetic value. Kraemer questioned if the
property could not be put to reasonable use if the variance were not granted.
Dick Putnam said no, they then would go back to the original plan, but that
would create other problems, and they felt their present plan was much better,
and it was larger because of aesthetics and the unique situation. Kraemer
said the property was blank and the problem was caused by the developer, and
the building was too large for the property, he also felt this would set a
precedent. The Mayor suggested it be looked at from a different view point
because of the two other buildings that are adjacent to the proposal, he
also felt it would not set a precedent unless there would be a proposal
that had the same situation. The Mayor requested an amendment to the motion
that the value of the building be included in the motion, that it would not
be less than 1.37 million, the maker and the second to the motion agreed.
Upon roll call Rockvam, Weeks, Thurk and Dill voted aye. Kraemer voted no.
Motion declared carried.
The parking plan was then considered. The Mayor asked if the meeting room
had been counted as leaseable space and considered in the amount of required
spaces. Putnam replied it had been considered and they are providing 119
spaces, plus a space for a dumpster.
Motion by Weeks to allow the alternate parking plan as stated by the Planner.
This motion was withdrawn in discussion.
Motion by Weeks second by Thurk to accept the alternate method for parking
spaces as recommended by the Planner but to provide no less than 119 spaces.
Rockvam, Weeks, Thurk and Dill voted aye. Kraemer was opposed. The motion
was declared carried.
Putnam stated the finance regulations were now to have the building 70% pre -
leased and construction would begin in about 45 to 75 days. He thanked the
Council.
b) Garbage Haulers Licenses
The following applications were in order for approval.

Yacht Club/Office Building: The proposed building exhibits a
gross floor area of 24,425 square feet. The City Ordinance
suggests one space for each 200 square feet of floor area for
office type uses.

Yacht Club/Boat Marina: The Yacht Club is proposing a 32 boat
marina. According to City parking standards, one parking space
per three slips is suggested.

A representative of the West Tonka Community Center has indicated
that a maximum of two instructors and 14 students could be
expected as a maximum at one class session.

Total of 6 spaces required
Parking Requirement Alternative. According to a strict
interpretation of the parking required for office uses, one
space is required per 200 square feet of office less 10 percent
for common space (mechanical rooms, hallways, etc.). With the
Yacht Club demonstrating a single loaded corridor design, its
percentage of common space is much greater than the typical 10
percent used in office structures with the common double loaded
corridor design. With this in mind, the City may wish to
consider a lesser parking standard than the 110 office spaces
required by Ordinance. Thirty six percent of a typical yacht
club floor is designated as "common space" that typically will

not generate parking demand. The remaining 64% represents the
gross leasable floor area. Therefore, the following parking
requirement may be considered as an alternative.
24,425 total gross sq.ft. x .64 = 15,632 sq.ft. @ 1 space/
200 sq.ft. = 78 spaces required.
By applying the aforementioned adjusted office parking standards,
101 spaces are required of the entire Yacht Club proposal
resulting in an excess of 18 spaces.
Parking Summary. According to a strict interpretation of City
parking standards with no credit given to overlapping uses, a
parking demand of 133 vehicles can be expected. By altering the
standard applied to office uses as previously described, a
parking demand of 101 vehicles may be expected. Under this
scenario, the 119 parking stalls provided would be sufficient.
The City must determine which parking requirement alternative is
most prudent and appropriate prior to final approval of the Yacht
Club proposal.

CONCLUSION
The proposed site plan contains several design deficiencies
relating to the shoreline setback distance and number of parking
spaces required on site. Each of these issues are local matters
which need to be addressed by the City prior to final approval of
the site design.
