Inc., and John Dennis was formed in September 1988 for the purpose of developing and owning the Yacht Club office and marina in Spring Park. The project proposes a 28,992 sq. ft. office building which includes space in the lower level for the Upper Minnetonka Yacht Club. The marina development proposes a 32 dock/slip marina for sailboats and power boats. A swimming beach is proposed, and deck adjacent to the lower level of the building. The Upper Minnetonka Yacht Club (UMYC), a 26 year old sailboat racing club is currently located on Enchanted Island in the City of Shorewood. The UMYC currently has 30 slips, storage building, and parking lot on its 2 residential lots. The 1.56 acre site is vacant with a lawn or vacant use over the 30 years. The Yacht Club site is located between the public use of the Hennepin County Water Patrol building, boat launch, parking and the Edgewater Apartments on the west. The 1.56 acre site is currently zoned R-3 multi -family and is vacant. The improvements to County Road 15 will provide a protected left turn lane from the east, sidewalk and 9 ton urban street for excellent access to the Yacht Club site. North of County Road 15 is the old Tonka Building currently being remodeled and leased to other commercial or industrial uses. NATURAL FEATURES The 1.56 acre site has approximately 320 feet of south facing shoreline on Spring Park Bay of Lake Minnetonka. The site rises from the 929.4' OHW to 950' along County Road 15. The steep slope on the west adjacent to the lake is 35% and rises 17' adjacent to the Edgewater Apartments. The more gradual 12% eastern slope rises to the flat portion of the site adjacent to County Road 15. The site plan illustrates the mature trees existing on the site. The most prominent is the twin oak with 24" and 28" trunks on the western side of the site. This tree is a beautiful mature oak with a 60 foot canopy. Other oak, maple, pine and cottonwoods are located on the plan. The general vegetation type is lawn grass and a sand/gravel beach. 3 SCHOELL & MADSON, INC. During the construction phases, it is anticipated that air pollution from dust, noise and odors, common with heavy construction activities necessary for construction of office/marine development will occur. The closest noise sensitive area is the Edgewater Apartment on the west side of the site. All local, state and other regulating governmental requirements will be adhered to by the developer and the contractor, regarding hours of operation and dust control. After completion of construction, air pollution, dust, noise and odors will be produced only in the amounts incidental to any normal office/marina developments. The primary air pollution source will be the emissions from heavy construction vehicles during construction. These vehicles would be equipped with appropriate emission and pollution control systems with any violating vehicles subject to appropriate action from local or state regulating aclencies. After development the air quality will be consistent with office parking areas at 110 car parking areas. 24• Describe the type and amount of solid and/or hazardous waste including sludges and ashes that will be generated and the method and location of disposal: The Yacht Club office development will produce solid waste typical of modern office buildings. Approximately 30 lbs. of solid waste will be produced per day and disposed of by local refuge haulers in either burning or landfill disposal areas. 5 Preliminary lake bottom tests indicated a hard bottom with variable depths of silt and some weed growth. Water depths will be adequate for docks and swimming beach without the need to dredge with docks at the 100', LMCD standard assuming normal 929' + water level. 16. No Yes If yes, identify water body and applicable state classification(s), and describe measures to protect water and related land resources: Spring Park Bay of Upper Lake, Lake Minnetonka The marina plan and office/parking development are designed to protect the site's major oak trees, natural slope (west side), views from the lake, water quality as required by Minnehaha Watershed District, and boat traffic areas on Spring Park Bay. 19. Describe any physical alteration (e.g., dikes, excavation, fill, stream diversion) of any drainage system, lake, stream, and/or wetland. Describe measures to minimize im- pairment of the water -related resources. Estimate quantity of material to be dredged and indicate where spoils will be deposited. The Yacht Club project will construct a sand swimming beach above the 929.4' OHW as per DNR permit requirements,the remaining 200+ feet of shoreline will be rock rip -rap as per DNR requirements. Describe the erosion and sedimentation control measures to be used during and after construction of the project. During construction geofabric silt fence will be used for erosion and temporary drainage control. Before building and parking construction, beach and lakeshore rip -rap will be installed, silt fence will be installed before other construction begins. Upon completion of grading and building exterior construction sodding and/or scrub will be installed on the disturbed areas. The natural slope on the site's western 175' will be retained without alteration, thereby retaining the oak trees and scrub/brush ground cover. El 25. LJ If yes, explain (identify species and describe impact): The construction of the 28,992 sq.ft.office building on the 1.56 acre site will alter the natural site. Since most of the site was used as a lawn area, little displacement of small mammals is expected. By protecting the large oak trees and the western slope,the birds and squirrels habitat will be retained. The construction of the 32 dock slips will alter the fish movement in the marina area. Most of the boats will be sailboats with small outboard motors and as boats move around the docks they will be at a low speed. The bottom is a firm gravel/sand with adequate water depth in the marina use area (4' to 6' depth). The beach area will use the existing firm sand bottom for excellent swimming beach area. The area is not a fish spawning area and is located between two existing multiple boat docks; Edgewater Apal-Liiient west and Hennepin County Water Patrol east. 26. The location of the building protects the significant oak trees on the site. These trees, when viewed from the lake and Co. Road 15, create the major visual site feature. The project will retain these trees. Siting of the marina below the 18 foot high bank on the site's west side will hide the docks from view from the street and the majority of the Edgewater Apartment units. When viewed from the lake the marina will appear below the wooded hillside and will blend with the building. The office building is 3 stories plus a walkout lower level towards the lake. The building proposes a gabled/pitched roof which adds to the architectural character. The significant trees on the site will allow the building to "fit within the tree canopy" and will not tower or stick out. Adjacent developments have 2 story and-4 story buildings east and west and the 8 story Tonka Office Tower across Co. Road 15 from the site. The existing development surrounding the site provides an urban commercial environment into which the Yacht Club development will be consistent. For each affected road indicate the current average daily traffic (ADT), increase in ADT contributed by the project and the directional distributions of traffic. County Road 15 was improved during 1988 with widening to four lanes, curb and gutter, signalization, capacity improvements such as turning lanes and sidewalks. The intersection with Co. Rd. 51 (located about 250' east of site) was relocated during the 1988 construction. Hennepin County traffic counts taken in 1987 indicated 129,800 ADT on Co. Rd. 15 in front of the site and 3,200 ADT on Co. Rd. 51 north of the 15 intersection. Co. Rd. 15's construction provides turn lanes that will serve the Yacht Club site. The street width through that section is a minimum width for a 4 lane section and is currently striped for 2 lanes plus turn lanes and extra width to the curb. The Yacht Club development will produce peak hour traffic patterns typical of office developments during normal Monday - Friday business hours. The 28,992 sq. ft. building should produce about 325 ADT Monday - Friday. On weekends the traffic pattern will be used primarily by sail club users and about 100 ADT might be expected. The traffic is expected to split approximately 200 ADT east and 125 west. These additional trips should not have a significant impact upon the road system. 29. Are adequate utilities and public services now available to service the project? If not, what additional utilities and/or services will be required? ❑ No 0 Yes Summary of Issues For regular EAWs, list the issues as identified by "yes" answers above. Discuss alternatives and mitigative measures for these issues. For scoping EAWs, list known issues, alternatives, and mitigative measures to be addressed in EIS. The following issues were discussed as having an impact upon the services or features of the Yacht Club project. 12. The site is currently zoned for high density residential but the City of Spring Park is considering rezoning the site to C-4-Office/Commercial. The proposed rezoning would make the site consistent with the city's plan and the surrounding area. no The project will be constructed within the shoreland area of Lake Minnetonka in the City of Spring Park. The site plan proposes retention of the significant mature oak trees and the wooded hillside on the site's western 150'. The building encroaches slightly into the 50' lake setback for deck and balcony construction. This encroachment is necessary to allow parking and adequate building depth. Expansion of Co. Rd. 15 required property from the site reducing its depth and the buildings east and west of the site are within the 50' setback. (Henn. Co. Water Patrol 30+ feet, Edgewater Apartments 14+ feet). 7 22. The project will generate increased runoff and sanitary wastewater. The site is served by city sewer and water with adequate capacity without system expansion. The site's runoff from parking areas will be routed thru sump catch basins with skimming structures designed to meet Minnehaha Watershed District standards. Runoff from grass, deck and roof drainage will drain to the lake through natural area, beach and lakeshore rip -rap. 23. The project will generate air pollution, dust, noise and odors typical of construction activity. After construction completion the marina/office project should not produce excessive pollution from auto or boat usage. The 110 car parking lot will be primarily used during business hours and to a limited amount, on weekends; thereby complementing the adjacent apartment project. The marina will be primarily for sail boats since it will be the site of the Upper Lake Minnetonka Yacht Club and will not provide gas or other power boat services. Some power boat dockage will be available to the public with conformance with rules regarding speed in dock area, size and exhaust noise level. 25. The Yacht Club development will have little impact upon small mammals around the site today. The hillside and tree preservation will retain the existing habitats. Construction of 32 dock slips and a swimming beach will alter the fish habitat. The area is not a prime spawning area, major pan -fish area or known fishing hot spot. Two multiple dock and launch existing on either side of the site providing boat traffic in the general area. The firm lake bottom, adequate water depth for boat mooring in a commercial area seem to suggest the use of water resource for a beach's marina is a good land and water use. 27d. The Yacht Club office and marina development will alter scenic views and vistas. The visual impacts will be mitigated by the design of the building, location of the building and parking, preservation of major existing trees and fitting the building "within the tree canopy". The site's location between a 4 story apartment building and the Hennepin County Water Patrol building and the 8 story Tonka Tower behind the site on north Co. Rd. 15 reduces the visual impact of the Yacht Club structure. Summary The Yacht Club office/sailing club and marina offers a unique opportunity to combine private, non-profit and public water oriented activities an excellent site on Lake Minnetonka. Public programs such as, UMYC sail school and swimming lessons offered thru Westonka Community Services; public marina dockage and an active sail boat racing program combined with rental office/parking combine a variety of complementary uses that provide for responsible lake use within marketable commercial development. Per our discussion with Upper Lake Minnetonka Yacht Club, Community Services would offer swimming, sailing, and sailboard lessons at the perspective site. We would be a program operator working in cooperation with the yacht club offering these programs to the public. Residents and non-residents alike could register in person or by mail through the Community Services office for these programs. These lessons, as are typically taught in Community Services programs, are intended to be an economical introduction to new recreational skills. The concept is lifelong recreational enjoyment. Our experience with this organization over the past several years at the Mound Beach has been excellent. Their commitment to safe and low cost water sport lessons has been demonstrated by their investment in boats, high quality instructors recommended, and their steadfast adherence to instruction of safety as an integral part of every lesson program. In addition to the lesson aspect, the increased assessed evaluation would certainly assist the funding of our beleaguered Westonka school system. As Director of the Westonka Community Services program, I heartily endorse the establishment of their facility in Spring Park.
