DISCUSSION OF ISSUES CONNECTED WITH THE YACHT CLUB PROPOSAL a) Re -draft of C-4 OFFICE COMMERCIAL dated January 26, 1989 The City Administrator read a letter from Alan Brixius, the City Planner dated January 26, 1989, also attached was a redraft of Ordinance 56, in regards to implementation of a.C-4 Zoning District. The Mayor stated he felt the permitted uses listed would be better suited for a C-1, he was also concerned with the word "Commercial" being used. Jeffrey Robinson from the Edgewater Apartments was present and was con- cerned with the traffic that would be generated. Kraemer also expressed this concern. Ken Larson, the City Attorney, was present and presented Council with Ordinances from Edina and Wayzata. He suggested to incorporate under Conditional Uses, "nothing that has retail sales". He stated the courts look to a rational basis, and Council might consider focus on limited public contact, but keep the list short. PLANNING REPORT TO: FROM: DATE: RE: FILE NO: BACKGROUND Spring Park City Council Alan Brixius January 26, 1989 Spring Park - C-4 Zoning District Amendment 175.01 - 89.01 At your January 23, 1989 meeting, the City Council reviewed an initial draft of the new "C-4" Office Commercial District. During this review, a number of changes were suggested to tailor this Ordinance further to meet the City's specific land use objectives. The attached Ordinance redraft attempts to implement the City Council's concerns and recommendations. C-4 DISTRICT REVIEW Section 21.Subd. Y. A definition of a yacht club was formulated to distinguish this use from a commercial marina. Subdivision A. Purpose. The expressed purpose of the C-4 District remains unchanged from the original draft. The intent is to allow the establishment of low intensity commercial uses that can compatibly coexist with adjacent residential areas. Subdivision B. Permitted Uses. This section has been modified to specifically list commercial uses the City will allow in the C-4 District. This is intended to insure that the C-4 commercial development is conducive with the purpose of the District. 4601 excelsior blvd., ste. 410, minneapolis, mn 55416 (612) 925-9420 l The original draft included the following provision 3 as a permitted use. 3. Other similar uses which have no storage of merchandise and are service oriented with no retail sale of goods on the premises. While this provision prohibits retail sales and only allows service oriented businesses, some concern was raised over the size, type or intensity of the service business that it may permit. By not defining the permitted uses, the types of permitted service uses are vague and left to interpretation. This could present a problem when the City wants to prevent an incompatible service business from entering a C-4 District. The new draft Ordinance provides a list of six permitted uses that are similar in character. The City Council should review this list and determine if these uses are appropriate in the C-4 District. The City Council should also decide if any additional uses should be included at this time. In establishing the list of permitted uses, it is understood that there may be other uses not identified that are appropriate within the C-4 District. Section 1, Subdivision F of the Spring Park Zoning Ordinance quoted below, recognizes this situation and allows for further modification of this District in the future. Section 1 Subd. F. Uses Not Provided for Within Zoning Districts. Whenever in any zoning district a use is neither specifically permitted nor denied, the use shall be considered prohibited. In such case, the City Council on their initiative or upon request, may conduct a study to determine if the use is acceptable and if so what zoning district would be most appropriate and the determination as to conditions and standards relating to development of the use. The City Council or property owner, upon receipt of the staff study shall, if appropriate, initiate an amendment to the Zoning Ordinance to provide for the particular use under consideration or shall find that the use is not compatible for development within the City. Due to the land use compatibility concerns the City has with the yacht club office building, the City may wish to be very cautious with the type of land uses it allows in the C-4 District. By specifically listing the permitted uses, the City maintains the greatest land use controls, in that any variation from the current list requires a text amendment and total review of the City. Subdivision C. Accessory Uses. No changes suggested in this subdivision. Subdivision D. Conditional Uses. Provision 1. Multiple Family. Provision l.a. was modified specifically that 2,500 square feet of lot area was required per unit. Provision 2 has been amended to only allow retail sales only as an accessory use. Provision 2.c. was changed to limit retail activity to 15 percent of each tenant space rather than the building. Provision 3. Yacht Clubs. Provision 3.b. This provision was revised to allow on -site food services in conjunction with the yacht club events. Commercial food and liquor sales available to the public are prohibited. Provision 3.c. This provision was added to address the use of yacht club meeting rooms by the general public. Provision 3.e. now prohibits only off-season boat storage. Provision 3.f. This provision was added to allow some retail activity in conjunction with the yacht club facility. The boat loading and removal facilities were removed from this conditional use permit. Subdivision E. Lot Requirements and Setbacks. This portion of the proposed Ordinance remains unchanged. With these changes, the City Council must again discuss the merit of the Ordinance and determine if it meets the land use objectives of the City. Site Plan Review As noted in our January 16, 1989 review, the yacht club site plan presents a number of design deficiencies that must be addressed. The need for setback variances, additional parking and other site amenities suggest that the site may be over -utilized. In this regard, a revised building or site plan may be appropriate. The major issue confronting this development is traffic generation and required parking. Since the yacht club is a unique use that does not precisely fit into one of the City's existing parking categories. The City must determine the appropriate parking demand on an individual basis. Section 3, Subd. F.9.o of the Spring Park Zoning Ordinance addresses this situation. o. Other Uses. Other uses not specifically mentioned herein shall be determined on an individual basis by the City Council. Factors to be considered in such determinations shall include (without limitation) size of building, type of use, number of employees, expected volume and turnover of customer traffic and expected frequency of delivery of service vehicles. Under this zoning provision, the applicant must provide information describing the traffic and parking need of the proposed use. It would seem that the traffic and parking demands of the public education programs are difficult to determine and regard further information from the applicant. In review of the proposed use, we would suggest the following parking standards: TOTAL SPACE Office Space 28,992 X .9 = 26,092 - 200 = 130 Boat Slips 32 - 3 = 11 141 spaces The 141 parking spaces address the total building area and the boat slips. THE CITY COUNCIL OF THE SITE OF SPRING PARK DOES ORDAIN: Section 1. Section 2, Subdivision Y is hereby amended by the addition of the definition of yacht club to read as follows: Section 2. Subd. Y. Yacht Club. A private club established for the recreational and educational enjoyment of boating and sailing. Yacht club activities may include programs for sailing, sailboarding, swimming and boat safety. Yacht club facilities shall be limited to a club house containing meeting and social area as well as dock and mooring slips for the exclusive use of yacht club members. �(.0 Section 2. Ordinance -15 is hereby amended with the addition of Section 21, C-4 Office Commercial District. SECTION 21 "C-4" OFFICE COMMERCIAL DISTRICT Subd. A. Purpose. The purpose of the "C-4", Office Commercial District is to provide a transition in land use from residential to low intensity business uses allowing for the intermixing of such uses. Subd. B. Permitted Uses. The following are permitted uses in a "C-4" District. 1. Barber shop and beauty shops. 2. Commercial and professional offices (without any ancillary restaurant or coffee shop uses). 3. Funeral homes. 4. Laboratories (medical and dental). VV+` 5. Medical and dental offices and clinics. ' 6. Photographic or art studios. Subd. C. Permitted, Accessory Uses. The following are permitted accessory uses in the "C-4" District. 1. Off-street parking as regulated by Section 3, Subd. F of this Ordinance. 2. Off-street loading as regulated by Section 3, Subd. G of this Ordinance. Subd. D. Conditional Uses. The following are conditional uses in a "C-4" District: (Requires a conditional use permit based upon procedures set forth in and regulated by Section 4 of this Ordinance.) 1. Multiple family dwelling structures provided that: a. The proposed site contains at least two thousand five hundred (2,500) square feet of lot area per dwelling unit. b. The proposed site is adjacent to a collector or minor arterial street. C. At least one (1) garage space is provided for each dwelling unit. d. The proposed site is landscaped and screened with planting materials in compliance with Section 3.B.7. of this Ordinance. e. The provisions of Section 4.B of this Ordinance are considered and satisfactorily met. 2. Accessory retail commercial activities provided that: a. Merchandise is sold at retail. b. The retail activity is located within a structure whose principal use is not commercial sales. C. The retail activity shall not occupy more gyp`` than f-fifteen (15) percent of the gross floor area of each tenant space. d. The retail activity is not located within a structure whose principal use is -residential. e. No directly or indirectly illuminated sign or sign in excess of ten (10) square feet identifying the name of the retail business shall be visible from the outside of the building. f. No signs or posters of any type advertising products for sale shall be visible from the outside of the building. g. The provisions of Section 4.B of this Ordinance are considered and satisfactorily met. 3. Yacht clubs provided that: a. The yacht club docking facilities must comply with the requirements of the Lake Minnetonka Conservation District. b. Banquet and food services associated with the yacht club shall be limited to special events and available to yacht club membership and site riparian ownership or leasehold interests only. Commercial food and liquor sales available to the general public are prohibited on site. C. Yacht club conference or meeting rooms may be made available to the general public for civic, educational and safety purposes. d. Fuel sales and boat repair servicing are prohibited on site. e. Off-season, outdoor storage of boats is prohibited on site. f. Retail activity shall not occupy more than fteen­ (151 �.'! percent of the gross floor area of the yacht club facility. g. At least one (1) parking stall per three (3) boat slips be provided for the yacht club in accordance with Section 3.F of this Ordinance. h. All lighting shall be hooded and so directed that the light source shall not be visible from the public right-of-way or from neighboring residences and shall be in compliance with Section 3, Subd. B.9 of this Ordinance. i. Parking or car stacking space shall be screened from view of abutting residential districts in compliance with Section 3, Subd. B.7 of this Ordinance. j. The entire area shall have a drainage system which is subject to the approval of the City Engineer and the Minnehaha Creek Watershed District. k. The proposed site is landscaped and screened with planting materials in compliance with Section 3.B.7 of this Ordinance. 1. The provisions of Section 4.B of this Ordinance are considered and satisfactorily met. Subd. E. Lot Requirements and Setbacks. The site is capable of accommodating any increased intensity of use. b. Any increased intensity of use is not reasonably expected to cause an increase in traffic volumes beyond the capacity of the surrounding streets. C. Public utilities and services are adequate. d. All warning devices and barricades shall conform to the Minnesota Manual on Uniform Traffic Control Devices. 2. Permit on Job - Permits or copies shall be kept on the site of the work while it is in progress in the custody of the individual in charge, and shall be exhibited upon request made by any county official. 2. Provisions and Specifications - These general provisions and specifications shall be considered as forming an integral part of each and every permit issued for operations on county roads. The work authorized by this permit shall be done at such time and in such manner as shall be consistent with the safety of the public and shall conform to all requirements and standards of the County of Hennepin as herein specified. If at any time it shall be found by Hennepin County that the work is not being or has not been properly performed, the permittee, upon being notified, shall immediately take the necessary steps, at their own expense, to place the work in condition to conform to said requirements or standards. 3. Annulment - In the event of wilful failure or neglect by said permittee or their employees to perform and comply with the prescribed conditions, restrictions and regulations, the Department of Public Works may revoke and annul this permit and order said permittee to remove any and all structures or property belonging to said permittee from the legal limits of the highway or county property. In the event the permittee leaves the highway in a condition needing repair or construction, the Hennepin County Department of Public Works may repair such highway and the costs of such repair or construction shall be paid by the permittee. 4. Execution - The permittee shall use diligence in the execution of the work authorized under this permit in order not to endanger or unnecessarily obstruct travel along the said highway. Operations shall be so conducted at all times as to permit safe and reasonably free travel over the roads within the limits of the work herein prescribed. All safety measures for the free movement of traffic shall be provided by the permittee at their own cost. 5. Conformity to Laws - The installation shall be made in conformity with all applicable laws, regulations and codes covering said installations. All installations shall be made in conformity with regulations of governmental agencies for the protection of the public. 6. Removal - If at any time the permitted structure or facility shall fail from any cause whatsoever, the permittee shall have the same removed or repaired within 48 hours after receipt of written notice to do so, unless by reason of some extraordinary happening Hennepin County may extend such time limits. 7. Existing Facilities - Applicant must protect all existing installations. 8. Private Property - The Permit as issued does not in any way imply an easement on private property. 9. Cutting Trees - The permission herein granted does not confer upon the permittee the right to cut, remove or destroy trees or shrubbery within the legal limits of the highway or relieve permittee from obtaining any consent otherwise required from the owner of the property adjacent thereto. 12. Boring or Jacking - Installation of pipe under roadways, shall be jacked or bored as designated by the Hennepin County Department of Public Works. 13. Liner or Casing Pipe - Shall be required for installations exceeding 4 inches in diameter. 14. Pressure Grouting - Shall be required as designated by Hennepin County Department of Public Works. 15. Drainage - All waterways and lines of drainage shall remain operative. 16. Pole Anchors - No pole anchors, anchors, braces or other construction on right of way except by permit authorization. 17. Driving Limitations - No driving onto highway from ditch or driving on shoulders or over curbs where damage will occur. 18. Lugs on Equipment - No lugs shall be used on equipment traversing road which will damage the road surface. 19. CONCRETE PAVEMENTS 1. Openings The opening made in a concrete pavement must be so located that no side is within three (3) feet of a construction joint. If the side of the opening is within three (3) feet of construction joint, the concrete pavement must be removed to the joint. Before breaking the concrete, the slab must first be cut with a concrete saw full depth, and the exact location thereof must be approved by the Hennepin County Department of Public Works. All broken concrete must be removed from the site and disposed of. NO OPENING SHALL BE MADE IN PORTLAND CEMENT CONCRETE DURING WINTER MONTHS EXCEPT FOR EMERGENCIES. 2. Backfill and Compaction After the excavation has been completed, the requirements for the backfill, i.e.,kind of material, compaction, etc., shall be the same as specified for the repairs made for "Trenching or Sub -surface Operations". (See Paragraph "C" below). 3. Replacement of Concrete The concrete used for the final surface repair shall consist of 3A42 high early strength concrete to meet Minnesota Department u, Transportation Specification dated 1988, Spec. No. 2301. This concrete to be secured only from commercial plants which can furnish a mixture that is approved by Hennepin County. The final finish must be burlap dragged or broomed so that it will match the surface of the adjoining concrete slab, and cured with an approved curing method. All construction joints shall be replaced. The fresh concrete patch shall be protected from all traffic contacts for at least 72 hours after it has been finished. B. BITUMINOUS PAVEMENTS 1. Openings When necessary to cut openings in bituminous surfaced roadways, the size of opening and location thereof must conform to size and location specified in the Permit, or to size specified by Hennepin County. When cutting the opening, the edges are to be cut in a straight line, and sides to be smooth and vertical. No ragged edges permitted. Cutting to be done with saw, mill or similar approved tools. All excavated bituminous material to be removed from the site and disposed of. NO OPENING SHALL BE MADE IN BITUMINOUS PAVEMENTS DURING WINTER MONTHS EXCEPT FOR EMERGENCIES. 2. Backfill and Compaction After the excavation has been completed, the requirements for backfill, i.e., kind of material, compaction, etc., small be the same as specified for the repairs made for "Trenching or Sub -Surface Operations". (See Paragraph "C" below.) 3. Replacement of Concrete Base Use procedures listed under A-3. Allow the concrete to cure for 72 hours before placing bituminous materials. 4. Bituminous Tack Coat A tack coat shall be applied to all adjacent bituminous and concrete faces before placing the bituminous materials. 5. Restoration of Blacktop All blacktop surfaces are to be restored as soon as possible after backfilling has been completed. The kind and grade must be approved by Hennepin County. Replacement of the bituminous material shall be as directed by Hennepin County. 6. Damage to Blacktop Any blacktop area which has been scarred by equipment, lugs, cleats, teeth, etc., shall be replaced or repaired as directed by Hennepin County. C. TRENCHING OR SUB -SURFACE OPERATIONS 1.Openings Trenches for conduits, water, steam, oil and gas pipes, sewers and other utilities placed within the right of way shall be located as approved by Hennepin County. Trenches for construction along the highway shall not be opened for a distance of more than 300 feet at anyone time, unless especially authorized. 2. Storage of Excavated Materials Excavated or other material shall be placed or stored on the side of the operation farthest from the traveled road unless otherwise authorized by Hennepin County, and in such manner that there will be no interference with the flow of water in any gutter, drain, pipe, culvert, ditch or other waterway. 3. Backfill and Compaction After excavation has been completed, it may be filled with the excavated material which has been removed, with the following exceptions: If the excavated material consists of mucky, soft or -unstable soil, boulders or large rock, it must be removed and disposed of outside the county right-of-way and replaced with granular (sandy) material. The refillin%Df the trench shall be done with approved material compacted by the ordinary compaction method and shall follow as `rapidly as possible the placing of sub -surface structures and shall be completed in such manner as will conform to the earth shoulder or subgrade or as directed by the Hennepin County Department of Public Works. 4. There are two aspects to consider on this license. First the proposed ordinance regarding Facilities with Special Density Licenses Not Constructed, and second, if the Order conditions under which this license was granted have changed. The proposed ordinance states that any Special Density license granted over two years ago where docks have not been constructed, have until 11/30/93 to construct the docks or be considered abandoned. In the case of the RDP Partners license, some of the amenities required for the license are dependent on the building being constructed. According to John Dennis, all their building and work permits are current and they are still working on obtaining financing. They are ready for construction, except financing and final plan review. A representative of RDP Partners, Les Renner, will be at the meeting to give an update. Regarding the conditions of the license, in addition to the amenities, there is a stipulation limiting who can use the docks. The following is an excerpt from the order: 86. No slips shall be made available to tenants, owners, or occupants of the building at the site of the docks except in accordance with the following requirements: a) Slips shall be made available only to the University of Minnesota sailing (school), the Hennepin County Sheriff's Water patrol and members of the Upper Minnetonka Yacht Club. b> Slips shall not be made available to owners, tenants or occupants of the building at the site unless they are also members of the Yacht Club. Slips shall be made available to members of the Yacht Club on a non- discriminatory basis and no privilege of priority shall be given to any club members who are tenants, owners or occupants of the building at the site. � � Water Structures Committee, RDP Ptrs, 2/5/93, Page 2 c) The Applicant shall annually provide to the District, prior to approval of its dock license renewal, a statement and description of the policies of the club governing allocation of slip privileges among members, which policy together with other assurances required by the District, shall be sufficient to assure the District that no violation of LMCD Code Section 2.05, Subd. 2, has occurred or will occur under the policy. The club shall submit at the same time a list of all persons or entities to whom slip privileges have been given and the owners of the boats kept at the slips. The club shall also submit a description of the identities of any such persons who are also owners, tenants or occupants of the site or are related to, affiliated with, or employed by such owners." In discussing the situation with Skip Jewett of the ULMYC, he advised that the ULMYC still plans to be a tenant of the site and to use the docks, but has made other plans in the interim until the project is finished. We recently learned as a result of articles in the Minnesota Real Estate Journal and The Laker that the proposed Yacht Club Office Building development may again be about to proceed. Reviewing my file on the matter, we have not heard of any activity on this development since 1991, and the bulk of my contacts and correspondence with the City and the developers relates to the planning and zoning process which occurred in 1989. At the time the development was conditionally approved, several issues were left to be resolved between the Edgewater and the developers in order for the City to grant final approval to proceed. These matters included: • The design, location, use and administration of the boat slips to be included in the development; • The design and access of the parking lot and the administration of the parking lot during non -business hours; • Location of the curb cut into the office building parking lot and related traffic flow issues on County Road 15; • The lighting plan for the parking lot, the marina and the office building, so that the lighting from this development would not be intrusive to our residents; • The construction of a dark metal fence on the boundary between our two properties and the creation of other security and aesthetic measures to separate the properties (including appropriate landscaping); and • An agreement as to construction hours during the building phase of the development. 11900 Wayzata Boulevard, Suite 230, Minneapolis, Minnesota 55305 (612) 545-1121 fax (612) 545-6290 City of Spring Park page 2 August 5, 1994 In this regard, I refer you to the attached letter to RDP Partners dated January 17, 1989, to which we never received a response, and my letter to the City dated April 14, 1989. My notes indicate that an agreement between the developers and the Minnetonka Edgewater on these matters was a condition of the City's approval of the project. Yet, we have not heard from the developers of the project for several years, nor have they made any attempt to address these issues. I understand that the City has not as yet seen final plans for the building, the parking lot and the boat slips. Further, the County has not received any request for a curb cut permit. We would respectfully request that the City keep us advised of any further planning or approval activity by the City on this project. Before the City allows the development to proceed, in accordance with its original approval of the project, we would request that the developers satisfactorily resolve the matters set forth in my January 17, 1989 letter and any other issues which their newest plans may raise. Finally, we would request that the City again consider the ingress, egress and traffic flow issues relating to this development and do all that is necessary to see that the safety of this portion of County Road 15, especially as it relates to our property, is not negatively impacted by the proposed development. I will look forward to seeing the developers' current plans for the proposed office development and yacht club. We would also request an opportunity to be heard by the Council before the issuance of a building permit for the project, if the above referenced matters are not satisfactorily worked out with the developers.
