Re: The Yacht Club
Dear Mayor Rockvam and City Council Members:
R.D.P. Partners is requesting your approval of a variance allowing our building to be located
within the 50 foot lake setback line. We offer these reasons which create a hardship in meeting
the setback requirement.
A. Two significant natural site features restrict our placement of the building.
The location of major oak trees on the southwest portion of the site suggest the
building's location to the east side. Likewise, the steep, wooded slope on the southwest
suggests an alternate building location.
B. The site's size and shape have been restricted by the condemnation by Hennepin County
of extra road right-of-way for C.S.A.H. 15. The loss of site depth on the eastern end of
the property has created a hardship in providing parking, building and setback space.
C. The location and type of adjacent land uses restrict our building location. The location
of the Edgewater Apartments adjacent to our western boundary restricts our building
location to the eastern side of the site. If the building were located on the west side the
50 foot lake setback could be met, but the impact upon the Edgewater Apartments
would be very negative.
D. The adjacent buildings are located within the 50 foot lake setback at approximately 10
and 25 foot distances from the O.H.W. The location of The Yacht Club building at the
50 foot setback is inconsistent with adjacent uses. It is a hardship for the Yacht Club
building to meet the 50 foot setback rather than the existing average setback line
established by the existing adjacent buildings.
A second variance or interpretation of the parking standards is requested to allow the
parking spaces required to be computed based upon rentable square foot area rather
than the normal formula of 90%. The Yacht Club building is unique because of the
high percentage of common or non -leasable space. Mr. Brixus' report provides a
complete explanation. We ask that the City Council allow the use of the alternate
parking requirement method for computing the number of parking spaces required.

In summary, R.D.P. Partners ask the City Council to evaluate our variance request in light of
the building location constraints. The current site and building plans do respect the site's
natural features, adjacent land uses and provide the best use of the site. We believe the changes
and improvements to the building have increased its value and appearance. We are proud to
be part of Spring Park's redevelopment of its downtown.

Subject: Sanitary Sewer Easement -
Minnetonka Edgewater Property
Ladies and Gentlemen:
As directed at the February 20, 1991 Council Meeting, we
have contacted the Yacht Club developers regarding their payment
of $300 of the total of $500. In a telephone call today, Dick
Putnam agreed to pay for the additional $300 cost. All other
costs related to constructing a sewer service to the Yacht Club
property line would be paid by the City.
We will proceed with preparation of the easement document.
