Josh: On Monday night the Spring Park City council will be acting on your city liquor license
contingent on the Federal and State approvals. We want to process your license at this time so that
once you receive your Federal and State approval will not have any other obstacles for your opening.
At the Council meeting you will likely be questioned on the status of the outstanding conditions of
approval for your conditional use permit, building permit and certificate of occupancy. In this regard, I
have listed the conditions below and their level of completion. Please be prepared to give the Council
a status report on the other outstanding items.
1. The applicant shall obtain and provide evidence of the following licenses prior to occupancy of
the site. Any site or building plan improvements prior to receipt of these licenses is at the
applicants:
a. Brewer's License from the State of Minnesota
b. Taproom license from the City of Spring Park
C. Growler Sales and License from the City of Spring Park
Comment: The local approvals will be made at Monday night's Council meeting. Do you have any
schedule for the federal and state license approvals.
2. The applicant shall comply with the production, consumption, and sales limits of the Spring
Park Zoning Code.
Comment: This is an operational condition no further information is required on this item.
3. The west side of the building shall be signed "loading zone no parking".
Comment: In visiting the site yesterday this has not be installed, please give a time for completion.
4. Applicant shall provide a description of the brewing equipment and process and means for
controlling odor.
Comment: Please give a description on any venting or air exchange equipment being installed
associated with the brewery. If this is part of the building permit information it may have already
been addressed by your architect.
5. Applicant shall verify that the size of the trash enclosure is large enough to meet the
businesses trash and recycling needs. No trash or recycling equipment shall be stored outside
the trash enclosure.
Comment: Josh your site plan included a 10'x 8' fenced in trash enclosure on the north side of the
outbuilding. This has not be installed, this item is still pending. Please confirm the size needs of the
trash enclosure for the brewery and provide a schedule for installation. We will need to recieve plans
for the enclosure, you must provide a detail on the anchor system and an elevation of the proposed
fence screening and gate.
6. Applicant shall provide a description and schedule for the repair of the existing parking lot.
Comment: Site observation reveals that this item in near completion.
7. A detail of the outdoor area shall be provided that addresses following items:
a. The expansion of the concrete sidewalk south of the building to provide a uniform floor
level and surfacing.
b. Identification the preferred fence and submission of a gate detail and gate latch.
C. Demonstration of the minimum 36-inch clear aisle between the tables and chairs.
Provide a 36-inch aisle between the table and fence to allow movement around the
table. All area must be disability accessible.
d. Any umbrellas or other shade devices in the outdoor are must provide a minimum of a
7-foot vertical clearance.
Comment: The aforementioned items have been provided and deemed complete.
8. Applicant shall provide a single building elevation that specifies the exterior wall treatments.
Comment: This information has be provided and deemed complete
9. The Monument sign is approved subject to the application and issuance of a sign permit and
the applicants shall confirm that the proposed sign lighting is stationary and cannot be rotated
or directed away from the sign.
Comment: The aforementioned information has been provided and are deemed complete.
10. Subject to the comments of the City Engineer.
Comment: I believe this has be addressed.
11. Applicant shall secure a building permit for all building renovations and be subject to the
comments of the City Building Official.
Comment: You are currently working under an active building permit, please provide a schedule for
completion, final inspection, and receipt of occupancy permit.
12. Staff meet with the applicant to provide a detailed Landscape Plan for the Shoreline Drive
area.
Comment: This item still needs to be addressed, I have not received a revised landscape plan. We
met on site to discuss the elements that should be addressed. Please provide at your earliest
convenience.
13. Applicant provides details that show the elevation of the fence and outdoor seating area.
Comment: This item has be addressed in the application materials. The fence will be a decorative
metal fence with an exit only gate. Please provide the gate and latching details.
Josh, I will not be at the council meeting on Monday, but I will assume that you will be question on
the project progress and the schedule to opening. I hope this email helps you address the council

Back Channel Brewing, City of Spring Park, MN — Conditional Use Permit for a Brewery
1. A. Application for Micro Brewers License — State of MN was received on May 31, 2017. As of
6/5/17, the application is in a 2-3 week background investigation process.

4. Refer to paperwork labeled #4. In regards to odor, there is minimal "odor" involved in the
brewing process. The odor will be during non -business hours and an in the building. Most
people find the brewing odor pleasant and refreshing.
S. The recommended enclosure should allow for the truck to drive straight into it without
obstructions. The door(s) should open past 90 degrees and provide at least a 10' opening as well
as to account for 10' of depth and a width of 15' or greater. Located on North side of shed.

Tract "A" Reg. Survey No. 1488. Contains two structures: Shed and Building #4787.
Shed is located on the western property line, 30ft west of building #4787. Shed is 248 sq. ft. size.
Exterior finish is brick, maintenance free siding, and asphalt shingles. There is one door on the east side
of the shed facing building #4787. There are no other windows or doors on shed. The shed will be used
for non -brewing related storage.
Building #4787 is located 71.4 ft. from north property line adjacent to Shoreline Dr. and 42.7 ft. from

siding, stone veneer, with steel roofing. The interior of the building is separated into 3 sections. Section
1 comprises the tap/serving room. Section 2 is the brewing facility and storage. Section 3 is
men's/women's bathrooms along with brewery office.

Exterior Doors:
Enter main door on east side of building (ED-1). Ed-1 is a tempered glass door. Walk 5 ft. west from
ED-1 and enter the vestibule with concrete floor and sheet rock walls. Vestibule is 80sq. ft. Walk through
door (ED-2) to enter tap/serving room. ED-2 is a wood entrance door. From ED-2 walk 20 ft. west, then
turn north 35ft, then turn west, walk 5ft, turn north. This is the location of exterior door 3(ED-3). ED-3
is a steel door with a tempered glass window. From ED-2 walk 25 ft. west, then turn south and walk 18
ft. south. This is location of exterior door 4(ED-4). ED-4 is a full length tempered glass door.
Garage Doors:
Starting at GD-2 walk 20 ft. west, then turn south for 18ft. This is location of garage door 1(GD-1). GD-
1 is a full length glass sliding garage door with tempered glass base. Starting at ED-2 walk 1Oft west,
then turn south for 18ft. This is location of garage door 2(GD-2). GD-2 is a 9 ft. by 4ft. glass half sliding
garage door, with a bar top as the base. Starting at ED-2 turn immediately south and walk 18ft. This is

Section #2 (Brew area) (1165 sq. ft.) Section #2 is split into three areas. The three are utility room, tax
determination cooler and brewing area. The utility room will have our mop sink, water heat, water
softener/filters, and other utility specific storage. Starting at ED-5 located on the west side of the
building, walk 15 ft. east then 10 ft. south, face back to the west and this is the door for the utility
room(ID-5). Starting at ED-5 walk 15 ft. east, then turn south and walk 20 ft. This is a interior dorr #4
(ID-4) This is a locked entrance door between section #3 to section #2. Starting at ED-5 walk 20 ft. east
then turn north and go 35 ft. This is the only window located in section #2(W-7). W-7 is a plate glass
window 4 ft. by 10 ft. Staring at ED-5 walk 15 ft. east then turn north and go 30 ft., then turn east and
walk 10 ft. this is a locked gate separating section #1 from section #2. Starting at ED-5 wall 30 ft. east
and turn south. This is the locked cooler door. This door will separate our un-taxed vs taxed beer.
Section #2 will be used from general brewing process. It will be separated from the public inside by a
lockable door (ID-4) on the south side and a lockable metal gate on the east side. The exterior exit(ED-5)
will also be lockable to separate the outside from the brewing area. The tax determination area/tanks will
be the cooler (highlighted in yellow). The brewing will happen in the mash/boil kettle area, with
supplement water being provided by the HTL/CLT. All fermentation will take place in the jacketed
fermenters located in the northwest corner of the building.
Section #2 will be a food safe area. The walls will be covered with FRP. The floors will be a food grade
epoxy applied over a sloped floor with vented drains. The ceiling will be painted with a food
safe/washable paint. All fixtures will meet food safe/washable surface specifications. The cooler is
constructed of food safe/washable material.
Section # 3 (Bathroom/Office) (380 sq. ft.) Section #3 is split into three main areas. The men's bathroom.
women's bathroom, and the office. Starting at the threshold (A) between section #1 and section #3, walk
5 ft. west, turn south. This is the door (ID-1) entering into the office. There will be one window (W-10)
located inside the office on the southern wall. The office will be used for operation of the brewery.
Starting at threshold A, go 20 ft west and face south. This is the entrance to the men's bathroom (ID-2).
There is 1 window located within the men's bathroom on the southern wall. Starting a threshold A, Walk
25 ft. west and this is the door to the women's bathroom (ID-3). There will be one wind located in the
women's bathroom against the west wall. Starting at threshold A walk 20 ft. and face north. This is the
door leading into the brewing area (ID-4).
Section #3 will be open the general public with the exception of the office area. The floor in all areas of
section #3 will be the same stained concrete as Section # 1. The walls will be a combination of tile and
sheet rock depending on the location within the space.

Back Channel Brewing & Seton Channel
Seton Channel has always been a popular pathway for boaters traveling
throughout the west side of Lake Minnetonka. If a boater lives, or docks their
boat, anywhere west of the Narrows Bridge, chances are very strong that they
travel through Seton Channel when boating. And for close to a decade, the view
along Seton Channel has been compromised by the dilapidated building at 4787
Shoreline Drive. This location is notorious on Lake Minnetonka, due to its prime
location, and the fact that boaters are constantly driving past this eyesore.
Fortunately, that is about the change as new life is being pumped into this once
vacant structure in the form of Back Channel Brewing.
Since the announcement of our arrival, we have been getting showered
with praise and excitement from local residents for bringing a new establishment
to the west side of the lake. It's not just Lord Fletchers, or the Minnetonka Drive -
In, anymore. Now everyone can enjoy a craft beer that is specifically brewed for
the Spring Park, Mound, Minnetrista, and Orono area. However, simply moving
into our new home isn't enough for these residents. Anytime we meet a local
resident for the first time, the first comment made after congratulatory
comments are, "So will we get to boat up to the brewery?"
In response to this question, we have consistently stated that we have five
boat slips, but need approval from the LMCD, and general support from the
surrounding neighborhood. Our goal is to allow for the western lake residents to
be able to use these boat slips during business hours, rather than add five new
boats to an already crowded lake. This brings me to a point where I would like to
point out the Pro's & Con's of both sides of the situation.
SCENARIO #1 - The Five Slips Are Not Approved For Brewery Use
- Five new boats, with families and friends, will be added to the lake and will
consider their boat slips a home away from home throughout the summer. These
five boats will have 24/7 access to these slips, as they are paying good money for
this privilege, and the dock area will be managed by them. Local neighborhood
residents will have zero access to these docks. These five new boats will likely
have minimal boating experience since they are new to the lake.
SCENARIO #2 - The Five Slips Are Allowed For The Public To Use Specifically For
The Brewery, During Business Hours
- Residents of the west side of the lake will be able to use the five slips via boat,
paddleboard, canoe, or kayak during business hours for the brewery. These slips
will be managed by the brewery, who will make sure that anybody showing up at
the docks is there to attend the brewery. These slips will not be allowed for any
random boater to use for any purpose other than the brewery.
Brewery business hours will be:
Wednesday - 4:00-10:OOpm
Thursday - 4:00- 10:OOpm
Friday-12:00- 11:OOpm
Saturday - 12:00 - 11:OOpm
Sunday - 12:00 - 6:OOpm
With these limited business hours, the five slips dedicated to the brewery
will be roped off, and off limits, to the public when the brewery is not open. This
means that there will be no boaters allowed to use these slips on
Monday's, Tuesday's, and in the evenings when the brewery is not open.
Due to the location of these slips, there is risk for potential boat congestion
around Seton Channel. Our solution for this is to fly five flags high above each of
our slips, so that any boater passing through the channel can clearly see if a flag is
flying. If a flag is flying, this will indicate to the boater that a slip is available for
them. If a flag is not flying, the boater has to continue on their pathway and not
disrupt the flow of boat traffic by stopping. In addition to flying the flags, we also
plan to hire local residents to help dock boats during the busier days of the week.
Adding this extra employee will only help us manage the dock area so that we can
create a high quality experience for everyone on and around the lake.
We plan to use this opportunity as a means of boater education, because
there aren't enough efforts being made to teach people how to properly operate
their watercraft on the lake. If the brewery is granted use of the slips, we will post
information on our website, at the docks, and inside our brewery about the
proper way to operate a boat, specifically through Seton Channel. We will
challenge, and demand, all boaters to respect our neighbors, and other boaters
who are traveling through the area. We expect to make Seton Channel the most
fluid channel on all of Lake Minnetonka through means of education and
awareness.
If the brewery is not granted use of these slips, we will have no reason to
promote boater safety in the area, nor will we have a vested interest in managing
the dock area. Granting us use of the slips will improve the quality of life for
residents on the west side of the lake, as they will be able to enjoying something
new in their area.
We are aware that some surveying of the area needs to be done around
the channel to ensure that use of these slips for the brewery will not impede
traffic. This survey could be started in May and completed in June, as one full
month of prime boating should be enough to determine boater density through
the area. This will give the brewery ample time to prepare information for the
public on how to properly boat up to the brewery, as well as the LMCD enough
time to assess the results. With this timeline, we hope to be able to allow boaters
and paddlers access to our brewery, via the lake, by mid -July.
We hope that this information provides an understanding of the type of
business we plan to bring to the area. We expect to be stewards of the lake, and
will hold ourselves to the highest standard in every facet. Please feel free to
