To allow site hardcover to exceed 30% up to 40%, the property owner / contractor must implement one of the Storm water management measures outlined below. The site plan must identify which measure will be selected and demonstrate that it will fit on the site with the new building and driveway construction. They may speak to the City Engineer to determine which measure may be best suited for the site. They will need to submit a revised site plan showing the selected measure and how it works with the overall site plan. The revised site plan is subject to reviewed and approved by both the City Engineer and the Minnehaha Creek Watershed district. Prior to issuing the building permit we must be confident that the selected storm water management measure will fit the site and function properly. 2. The City allows the hardcover greater than 30% up to 40% provided that the site includes a storm water management component listed below. My initial review suggested that the 38% z hardcover may be a grandfathered non -conforming condition, however, to preserve this grandfathered condition a building permit must have been issued within 180 days of the homes destruction. I am informed that the homes were lost to a fire in March 2021. The new construction must comply with the storm water management requirements listed below. You may contact the City Engineer, to determine which component may work the best for your site. Good luck with this project please contact me with any questions. (4) Lot coverage. Impervious surface coverage of lots within the R-1 districts shall not exceed 30 percent of the lot area, except as provided below: a.lmpervious surface lot coverage may be allowed to exceed 30 percent of lot area on an existing lot of record that falls below R-1 lot area and width standards subject to the following: i. All structures, additions or expansions shall meet setback and other requirements of this chapter. ii. The lot shall be served with municipal sewer and water. iii. The amount of impervious surface does not exceed 3,000 square feet of area. b.New construction, alterations, expansions and remodeling of structures on all lots may expand lot coverage up to 40 percent of actual lot area through the plan review process established in article IV, division 1, provided the following stipulations are met: i. All structures, additions, or expansions shall meet setback and other requirements of this chapter. ii. The lot shall be served by municipal sewer and water. iii. The lot shall provide for the collection and treatment of stormwater in compliance with the city stormwater management plan if determined that the site improvements will result in increased runoff directly entering a public water. All development plans shall require review and approval by the city engineer. The property owner shall be responsible for installing one or more of the measures recommended by the city engineer to mitigate the impact of additional impervious surface. Plans must also be reviewed by the Minnehaha Creek watershed district when projects meet criteria requiring watershed district review and approval. iv. Measures to be taken for the treatment of stormwater runoff and/or prevention of stormwater from directly entering a public water. The measures may include, but not be limited to the following: (A) Installation of rain gardens, infiltration basins, or bio filtration basins should be considered for treatment of stormwater runoff from hard surfaces. Filtration basins should be considered if soil conditions are not favorable for infiltration. (B) Installation of erosion control devices, including silt fence, bio-rolls, erosion control blanket, and storm sewer inlet protection should be used. 3 (C) Installation of oil -skimming devices and sump catch basins should be used to improve water quality. (D) Stormwater runoff from hard surfaces should be directed into pervious areas (grassed lawns or landscape beds) through site grading and use of gutters and downspouts. (E) Hard surfaces should be constructed using pervious pavement or pavers, or raised materials such as decking which has natural earth or other pervious material beneath or between the planking. (F) Grading and construction techniques should be implemented that encourage infiltration of stormwater runoff. (G) Installation of berms or basins should be considered to temporarily detain water before dispersing it into pervious area. Is this a tear down rebuild???? In review of the attached survey we offer the following findings. The site is zoned R-1 Single and Two Family district. This district allow for two family lots meeting the following standards. Lot area. Required 12,000 sq. ft. The existing two addresses have a lot area of 24,498 sq. ft. Compliant. Lot Width. Required 50 feet. The existing two addresses have a total lot width of 120 feet. Compliant. Setbacks: Required Proposed Compliant Street side setback (north) 30 ft. 30 / 32 feet Yes Side yard (West) 10 ft. 19.0 ft. Yes Side yard (East) 10 ft. 16.5 ft. Yes Lake side (South) 50 ft. 76.7 /81.7 ft. Yes Hardcover: 30% 38.3% No The proposed hardcover exceeds the City 30% standard. The City will allow up to 40% hardcover with a storm water management plan. The survey's estimate of existing hardcover did not include the house. My rough estimate of total existing 4 hardcover including the existing house is approximately 38.1 %. The surveyor should revise their estimate of existing hardcover to include the house. If the proposed hardcover is equal to or less than the existing hardcover, the 38.3 % hard cover maybe grandfathered and the plan can be approved without a storm water management plan. The site plan appears to meet all the required R-1 lot area, width and setbacks. They need to provide a revised estimate of existing hard cover to address this issue. Building height may not exceed 35 feet.
