Matt, The attached garage construction will require a variance from the required 30
foot front yard setback. Review of the attached survey raises a number of questions.
1. The garage requires the removal of the retaining walls, can the garage be shifted
north to meet the 30 foot setback?
2. Can the garage be reduced in depth to reduce the amount of setback
variance? The size of the new building cannot be a factor to justify a variance.
3. The Street elevation is 950. What will be the floor elevation of the garage? Will
street drainage run toward the garage and house?
My Planning Commission is very sensitive as to maintaining the required setbacks and
variances are heavily scrutinized. New construction must be designed and sized for
the site. Variances must be justified by conditions unique to the site not created by the
property owner or previous property owners. Recognizing this attitude, I would
recommend that prior to going through a variance application, we to meet next week
and look at the site to discuss options to eliminate the variance or at least discuss
options to reduce the amount of variance being requested. If this works for you please

Hi Jamie,
I had Sathre-Bergquist add the building to scale on the new lot survey we had completed.
The homeowner is going to ask for a variance for the set -back from the road due to the slope of the yard/position of the
house, it leaves almost no room for any structure.
Let me know if I need to add anything else and I'll get it to you right away.
