ADJOURNMENT 673031.v2 CITY OF SPRING PARK COUNTY OF HENNEPIN STATE OF MINNESOTA ORDINANCE NO. 2020-02 AN ORDINANCE AMENDING THE ZONING/SHORELAND ORDINANCE OF THE SPRING PARK CITY CODE (CHAPTER 42) MEMORIALIZING THE PROHIBITION OF SHORT-TERM RENTALS WITHIN THE CITY OF SPRING PARK THE CITY COUNCIL OF THE CITY OF SPRING PARK, MINNESOTA ORDAINS AS FOLLOWS: Section 1. The City Council of the City of Spring Park hereby amends Chapter 42, Article II of the Spring Park City Code by adding a new Sec. 42-77 as follows: Sec. 42-77. – Short-term rentals. (a) Definitions. In addition to the definitions contained in Article I, Division 2 of this chapter, the following definitions shall apply to this section. (1) Operator. A person or enterprise, or its agent, who is the owner of a dwelling, which is being offered for rent to transients, whether such person’s ownership interest in the property is as the owner, lessor, lessee, sublessee, mortgagee-in-possession, licensee, or any other interest. Where the operator performs their functions through a rental agent, the managing agency or the rental agent has the same duties as the operator hereunder. (2) Rent. Compensation, in money or other consideration, given in exchange for the occupancy, use, or possession of real property which is charged, whether or not received. (3) Short-term rental. Any temporary occupancy or use of a dwelling or dwelling unit that is offered for rent to a transient for fewer than thirty (30) consecutive calendar days for various purposes, including but not limited to, tourist or transient use, or as a vacation home, or bed and breakfast. (4) Transient. Any person who, at their own expense or at the expense of another, exercises occupancy or possession, or is entitled to occupancy or possession, by reason of any rental agreement, whether in writing or otherwise, concession, permit, right-of-access, option to purchase, license, time-sharing arrangement, or any other type of agreement for a period of fewer than thirty (30) consecutive calendar days. (b) Short-term rentals prohibited. 673031.v2 (1) Purpose. The City finds that short-term rentals constitute a commercial use of residential property, which conflict with the fundamental character of residential zoning districts, disrupt the residential character of neighborhoods, and have a negative impact on the livability of residential neighborhoods. The City further finds that, while short term rentals are prohibited under the current provisions contained in the City Code, an ordinance amendment clarifying those regulations is necessary. The City has received complaints from residents regarding short-term rentals, including but not limited to complaints related to noise, over- occupancy, and illegal parking. To ensure adequate housing options for residents, preserve the residential character of the City’s residential districts, preserve property values, and reduce land use conflicts, the City determines, in furtherance of the public health, safety and general welfare, that it is necessary to limit short-term rentals to hotels, motels, lodging establishments, and similar accommodations which are appropriately licensed, zoned, and which have the appropriate infrastructure and services for such short-term use. (2) Prohibition. Short-term rental in any residential zoning district in the City is prohibited. State licensed hotels, motels, and lodging establishments located in areas where permitted by the City’s land use regulations are allowed, pursuant to all applicable law and rules. (3) Enforcement. a. An owner, operator, tenant, or occupant of any building or property in violation of the provisions of this section may be charged and found guilty of a misdemeanor and may be held responsible for the cost of enforcement in addition to penalties. b. The City may exercise any and all remedies at law or in equity to ensure compliance with this section. All unpaid costs, charges and penalties may be certified as a special assessment levy against the property. c. The City hereby further declares the short-term rental of a dwelling or dwelling unit may constitute a public nuisance pursuant to Chapter 18, Article IV of the Spring Park City Code and the City may exercise its authority to abate such nuisances. d. To address violations of this section, and in addition to any other remedy available to it at law or in equity, the City may exercise its enforcement authority pursuant to Chapter 1, Sec. 1-14 of the City Code and applicable state law. Section 2. In an effort to minimize the disruption of the adoption of this ordinance, the City shall not take any enforcement actions related to short-term rentals until December 31, 2020. Section 3. Chapter 42, Article I, Division 2. - Definitions, Section 42.43 - I of the Spring Park Zoning/Shoreland Ordinance is hereby amended to add the following: Interim use. A temporary use of property until a particular date, until the occurrence of a particular event, or until zoning regulations no longer allow said use. Interim use permit. A permit issued by the council in accordance with the procedures specified in this chapter setting forth the conditions and restrictions which must be complied with before an interim use may be created, the restrictions under which such interim use will be allowed to continue, and the date, event, or change to zoning regulation which will result in termination of said use. Section 2. Chapter 42, Article IV. - Administration of the Spring Park Zoning/Shoreland Ordinance is hereby amended by adding a new Division 4. - Interim Use Permit as follows: DIVISION 4. - INTERIM USE PERMIT Sec. 42-185. - Purpose and intent. The purpose and intent of allowing interim uses is: (1) To allow a use for a brief period of time until a permanent location is obtained or while the permanent location is under construction. (2) To allow a use that is presently judged acceptable by the city council, but that with anticipated development or redevelopment, will not be acceptable in the future or will be replaced in the future by a permitted or conditional use allowed within the respective district. (3) To allow a use which is reflective of anticipated long range change to an area and which is in compliance with the Comprehensive Plan provided that said use maintains harmony and compatibility with surrounding uses and is in keeping with the architectural character and design standards of existing uses and development. Sec. 42-186. - Procedure. 2 Uses defined as interim uses within a respective zoning district shall be processed according to the submittal requirements, standards and procedures for a conditional use permit as established by section 42-141 of this chapter. Sec. 42-187. - General standards. Interim uses shall comply with the following: (1) The standards of a conditional use permit set forth in section 42-141 of this chapter shall be satisfied. (2) The use shall conform to the applicable performance standards of this chapter. (3) The use shall be listed as an allowed interim use in the respective zoning district. (4) The date or event that will terminate the use can be identified with certainty. (5) The use will not impose additional costs on the public if it is necessary for the public to take the property in the future. (6) The user agrees to any conditions that the city council deem appropriate for permission of the interim use. Sec. 42-188. - Termination. An interim use shall terminate on the happening of any of the following events, whichever first occurs: (1) The date or event stated in the interim use permit. (2) Upon violation of conditions under which the interim use permit was issued. (3) Upon change in the city’s zoning regulations which renders the use nonconforming. (4) The redevelopment of the use and property upon which it is located to a permitted or conditional use as allowed within the respective zoning district. Sec. 42-189. - Revocation. If an approved interim use is in violation of this chapter or the conditions of the interim use permit approval, the city may initiate a process to revoke the interim use permit. The city will conduct a public hearing to consider the revocation of an interim use permit and will mail and publish notice of the hearing according to section 42-141. The public hearing shall be conducted by the planning commission, which shall make a recommendation to the city council. In considering revocation, the planning commission and the city council shall consider compliance with the approved conditions of the interim use permit and the standards listed in section 42-141. Section 3. Chapter 42, Article II, Section 42-77 (Short-term rentals), subsection (b) (2) is 3 hereby amended to read as follows: (2) Prohibition. Short-term rental in any residential zoning district in the city is prohibited except where allowed by interim use permit within a respective district. State licensed hotels, motels, and lodging establishments located in areas where permitted by the city’s land use regulations are allowed, pursuant to all applicable law and rules. Section 4. Chapter 42, Article VIII, Division 2, Section 42-280 of the Spring Park Zoning/Shoreland Ordinance (R-1, Single and Two Family Residential District Accessory Uses) is hereby amended by adding a new Section 42-280. - Interim uses, as follows: Sec. 42-280. - Interim uses. The following is the interim use in an R-1 district (requires an interim use permit based upon procedures set for in and regulated by article IV, division 4): (1) Short-term rental. Short-term rentals constitute a commercial use of residential property, which may conflict with the fundamental character of residential zoning districts. To ensure there is no disruption to the fundamental character of residential zoning districts an interim use permit for short-term rentals meeting all the following conditions is required is to ensure the public health, safety, and welfare of its citizens. a. Lot requirements. i. The lot must be located adjacent to or across the street from a commercially zoned district. ii. The lot must be abutting an arterial street as defined in the Spring Park Comprehensive Plan. b. Conditions required to maintain interim use permit. i. No physical alterations. No physical alterations of a primary residence shall be permitted in conjunction with the operation of a short-term rental dwelling unit, except that additional onsite parking may be provided, to the extent that such parking is otherwise permitted by the applicable provisions of the city code. ii. Building code compliance. All dwellings pursuing an interim use permit for short-term rental shall be in compliance with the City’s building and fire codes. Inspection and verification of code compliance by the City Building inspector shall be required. iii. Non-transferable. Interim use permits issued under this section are non-transferable. Each interim use permit shall automatically terminate upon the sale or other conveyance of the property upon which the short-term rental is located, unless otherwise authorized by the city council. iv. Number of bedrooms. Each interim use permit shall indicate the number of bedrooms which are contained in the primary residence. No interim use permit holder shall advertise the primary residence as containing any more than the identified number of bedrooms. v. Limit on the number of guests. The maximum number of transient 4 guests permitted to stay within a short-term rental dwelling unit at any one time shall be the sum of the number of bedrooms contained in the primary residence multiplied by two, up to a maximum of 10. Such sum shall include both adults and children. vi. Signage. No commercial signage is allowed on the property of any short-term rental dwelling unit. vii. Events. Events are not allowed to be hosted by transient guests on short-term property. For purposes of this prohibition, an event shall mean a gathering on the property of the total number of people permitted to stay on the premises plus five. Events hosted by the owner are exempt from this prohibition, but must otherwise abide by state and local law and policies. viii. Parking. A property with a short-term rental dwelling unit shall provide a minimum of two off-street parking stalls for transient guests. The maximum number of vehicles allowed at the property shall be limited to the number of off-street parking spaces provided. To be valid, off-street parking shall meet any applicable requirements set forth in the city code. ix. Occupant eligibility. The primary overnight and daytime occupant of a short-term rental dwelling unit must be an adult 18 years of age or older. This adult must provide a telephone number to the owner and shall be accessible to the owner by telephone at all times. x. House number visible. Property containing a short-term dwelling unit must have a visible house number that can be easily seen from the street at all times. Section 5. This ordinance amending the Spring Park Zoning/Shoreland Ordinance shall be in full force and effect immediately upon its adoption and publication. Respectfully submitted, Jamie Hoffman, City Clerk CITY OF SPRING PARK WORK SESSION MINUTES FEBRUARY 21, 2023 – 5:45 PM SPRING PARK CITY HALL (Work Session discussion times are approximate) 1. 5:45: City Emails City Administrator Anderson recapped the use of personal emails for City business and suggested that everyone use their city emails when city business is being conducted. 2. 5:55: Sunset Lake Access – Bollards City Administrator Anderson researched and advised we can name the street and put up a street sign without any issue. He also presented options for bollards to be installed to mark the property lines. It was recommended the bollards are made of metal, with a concrete filled core, and a plastic sleeve over it for weathering. Anderson will research and bring back to Council for review. 3. 6:10: TCE Water Update City Administrator Anderson recapped the situation regarding the TCE levels in the water. He said the state is involved and will be conducting further testing in March. In the meantime, Quality Flow will be coming over to check the system. Council Member Sippel recommended we test the TCE levels before and after maintenance or repairs to determine any changes in levels. 4. 6:20: Miscellaneous Anderson pulled up a draft of a 5-year Capital Improvement Plan and asked for Council review and input. Council Member Sippel stated he would like all roads added as all are in horrible shape. Anderson stated the City Engineer recommended that we redo the arterial roads - Mapleton, Lilac, Northern, and Park Lane - when we do Sunset. Anderson stated he asked Nielson for estimates. Council Member Chase mentioned adding a potential redevelopment fund where the city could purchase derelict properties and redevelop for city/resident use. Council Member Sippel asked for road repairs to be made on Northern due to damage from past projects and at Hazeldell due to the water main break. 5. 6:30: Adjourn There being no further discussion, Council Member Hoffman motioned, being seconded by Council Member Chase, to adjourn the work session at 6:30PM. This project will include a full roadway reconstruction including curb & gutter, storm sewer, bituminous paving and pedestrian improvements. The final configuration of the roadway with parking and pedestrian accommodations has not been finalized at this time. The underlying city sewer and water pipes are aging and have a history of failure and need to be replaced in conjunction with this project. Several options were investigated for the sewer and water replacement including trenchless methods. The chosen method for replacement is conventional open trench methods. The proposed City project along Sunset Drive will include a complete reconstruction of the sanitary sewer system including the gravity collection main, manholes, individual sewer services to the property line and the pressurized sewer forcemains (2). We are proposing to replace the existing 8” gravity sewer with a 10” gravity sewer for two reasons. The first reason is that oversizing the pipe at this time would allow the pipes to be slip lined in the future without loss of capacity when compared to an 8” pipe and will allow for some additional capacity in the system for any redevelopment in the area. The additional cost is estimated to be approximately $3-$4 per foot of pipe. As part of this project, Lord Fletchers will be contacted to request that a grease trap be installed on the propert y to eliminate the ineffective grease trap located near lift station No. 1 at Dickenson Avenue. The existing 6” and 8” watermain will be replaced with 8” watermain in the current locations and additional piping is proposed from Park Lane to Togo Road to increase the currently inadequate fire flows in the area. A second extension from Togo Road to Sunset Drive is also proposed to further increase fire flows, reduce the length of dead end main on Sunset Drive and provide addition supply redundancy for the properties east of Northern Avenue during and after construction. Water services will be replaced from the main to the property line and additional fire hydrants will be located to cover areas outside of the current 300’ coverage zones. There is a current Orono utility easement along the east property lines from Park Lane to Togo Road. Additional easements will need to be acquired from Togo Road to Sunset Drive if this segment of watermain is to be installed. Proposed improvements to power and communication includes the undergrounding of all overhead lines, removal of utility poles, new homeowner services lines, and street lighting installation. Sunset Drive Utilities Feasibility Report March 6, 2023 Page 2 The estimated cost of the sanitary sewer and water systems improvements is $2,268,933 and powerline and other small utility undergrounding portion of the project estimated to be $461,600 for a total project cost of $2,730,533 The City may be eligible for reimbursement for I&I improvements through the MCES I&I Grant program. At this time this program does not appear to be funded beyond 2022. Should funding become available, the City will make an application. Public Facilities Financing options which may include the Transportation Revolving Loan Fund or the Sewer and Water funds. The Transportation Revolving Loan Fund is available to Cities that must replace utilities as a result of a county improvement project. The term of the loan is 30-years, and the interest rate is estimated at 1% above prime. Costs not covered by Grants or Sewer and Water funds will be covered by the City’s General Obligation Funds and Bonding. It is the recommendation of the engineer that this project is feasible as outlined in this report and we recommend moving forward with public hearing as well as hydraulic modeling of the water system to determine if an expanded water main project is necessary. Sunset Drive Utilities Feasibility Report March 6, 2023 Page 3 1. PROJECT AREA CHARACTERISTICS Existing Conditions Sunset Drive in the City of Spring Park is also known as County Road 51.The proposed project and the limits of this feasibility study begins at the intersection of Shoreline Drive and terminates at Shadywood Road. Right-of-Way - The platted right-of-way is 66-feet wide throughout the entire length of the roadway. The current roadway width is generally 33 -feet with two lanes of travel and shoulder on both sides. Some areas of the roadway currently have curb and gutter while others do not. The county is currently developing plans for the roadway and pedestrian accommodations. Sanitary Sewer – The sanitary sewer servicing the residents and businesses along Sunset Drive flows to the southwest via gravity sewer and two existing pump stations. Sanitary sewer from Shadywood Drive to Dickson Avenue flows to existing Lift Station No. 1 on Dickson Avenue that discharges to the 8” sanitary sewer trunk line on Sunset Drive to the southwest. The rest of Sunset Drive flows to existing Pump Station No. 2 midway along Sunset Drive near Thor Thompson Park. This lift station pumps along Sunset Drive where it eventually pumps to a 10” trunk sewer near the intersection of Sunset Drive and Spring Street. The sanitary sewer was constructed in 1964 and is currently 58 years old. The sanitary sewer is constructed of Vitrified Clay Pipe (VCP) and sewer televising reports show that the pipe is in poor condition with tree roots growing in between pipe joints and some blockages were found during televising. Data from the City of Spring Park Asset Management Plan show that a portion of the sanitary sewer between 4056 Shoreline Drive to 3980 Shoreline Drive received a cured in place pipe liner as well as a portion from 3791 to 3731 Shoreline Drive totaling 905 linear feet. Water Main – The water main along Sunset Drive is a mix of 6” and 8” water main that serves the residents and businesses along Sunset Drive. The water main serves the streets that branch off of Sunset Drive and has a n inter-connection to Orono’s water system at the intersection of Sunset Drive and Shadywood Drive. The water main was most likely built during the same time period as the sanitary sewer putting the age of the water main at approximately 58 years old. Sunset Drive Utilities Feasibility Report March 6, 2023 Page 4 Data presented in the Spring Park Asset Management Plan show that the water main along Sunset Drive is subject to a high number of water main breaks as well as several locations that experience low fire flow rates. Maps also show areas along Sunset Drive that are outside the required 300’ hydrant coverage area including a large business in the area. Power and Communication Utilities – There are currently utility poles and overhead utility lines that parallel Sunset Drive. Lines run along the east side of the road from Shoreline Drive to Park Lane then lines cross over Sunset Drive and continue the west side of the road from Park Lane to Shadywood Drive. Occasional perpendicular crossings were observed serving houses opposite the main overhead lines. 2. PROPOSED IMPROVEMENTS Sanitary Sewer Two alternatives were considered for replacing the sanitary sewer including cure in place pipe (CIPP). The second alternative looked at replacing the sewer with conventional methods or excavating, removing and replacing the pipe with new materials. Trenchless methods are used where: 1. Pavement is in good condition and does not need to be replaced. 2. Where a trenchless method can save time and allow better access to properties or. 3. Where a trenchless method would be cost effective compared to an overly deep excavation. 4. Manholes are in good structural condition but may need some rehabilitation to prolong their life. Traditional, excavate, remove and replace methods are typically chosen for the following reasons. 1. Pavement is going to be replaced due to age and poor conditions 2. Where services lines to homes need to be replaced. 3. Where digging depths are not excessive and 4. Where the traditional methods have a better life cycle cost ratio and extended design life. Sunset Drive Utilities Feasibility Report March 6, 2023 Page 5 After analyzing the pros and cons of traditional excavating methods versus trenchless methods as well as discussions with City public works staff, we are recommending that the sewer be replaced with the traditional methods for the following reasons. 1. The City sewer and watermain replacements withing the roadway Right -Of-Way can be incorporated into the Hennepin County roadway project to be completed in 2024 to limit residential inconveniences to only 2024. 2. Due to age and material type of the service lines, we suggest that the service line from the main to the property line be replaced. Even when using trenchless methods for the main line replacement, excavating from the centerline of the road to each home would be required to replace the service lines. With traditional excavation methods, the connection to sewer and watermain are more easily constructed leading to a higher level of confidence that the connection will not leak and will provide a much longer service life. 3. Sanitary sewer manholes should be replaced with new manholes rather than spray lining the old manholes. This will further reduce I&I and provide a lower long term life cycle cost. 4. Traditional excavation methods can be completed at a lower cost with minimal additional disruption to access or homes on the roadway. The sanitary sewer will be replaced with 10” PVC Pipe and new precast concrete manholes and casting, and each home will receive a new 6” service line wye and PVC service line pipe to the property line. Water Main Two alternatives were considered for replacing the watermain including pipe bursting to replace the watermain. The second alternative looked at replacing the watermain with conventional methods or excavating, removing and replacing the pipe with new materials. Trenchless methods are used where: 1. Pavement is in good condition and does not need to be replaced. 2. Where a trenchless method can save time and allow better access to properties 3. Where the water main is generally sized appropriately for the area Traditional, excavate, remove and replace methods are typically chosen for the following reasons. 1. Pavement is going to be replaced due to age and poor conditions 2. Where services lines to homes need to be replaced. Sunset Drive Utilities Feasibility Report March 6, 2023 Page 6 3. Where digging depths are not excessive and 4. Where the traditional methods are less costly. 5. Where the watermain needs to be upsized significantly for pressure and fire flow needs. After analyzing the pros and cons of traditional excavating methods versus trenchless methods, we are recommending that the water be replaced with the traditional methods for the following reasons. 1. Due to the planned roadway project being completed by Hennepin County in 2024 any excavation within the roadway can be temporarily restored until the roadway project takes place. 2. Due to age and material type of the service lines, we suggest that the service line from the main to the property line be replaced. Even when using trenchless methods for the main line replacement, excavating from the centerline of the road to each home would be required to replace the service lines. With traditional excavation methods, the connection to sewer and watermain are more easily constructed leading to a higher level of confidence that the connection will not leak and will provide a much longer service life. 3. Watermains are undersized in this area to provide the required minimum fire flows. along Sunset Drive. Upsizing the utilities will allow for better fire flow in the area. 4. Traditional excavation methods can be completed at a lower cost with minimal additional disruption to access or homes on the roadway. The watermain will be replaced with 8” C-900 PVC. The project will include the replacement of gate valves and hydrants in addition to corporation stops, services from main to property line, and curb stop box and valves. Due to low pressure zones in this project area, and dead end lines, we recommend two segments of looping to solve these issues. The first recommended loop is from Park Lane to Togo Road and the second connection to create a loop is from Togo Road to Sunset Drive. The Park Lane to Togo Road extension would be located in the existing Orono utility easement assuming permission to locate in that easement is granted by Orono. The segment from Togo Road to Sunset Drive would require a utility easement to be obtained. Sunset Drive Utilities Feasibility Report March 6, 2023 Page 7 Minnesota Department of Health will conduct a plan review of the project as it pertains to water main improvements Pump Station Elimination While discussing the initial report with DJ Gorman of the City, a possibility of eliminating one of the two pump stations that currently serve Sunset Drive was brought up. The original design of the sewer was reviewed. The potential to eliminate Lift Station No. 1, and convey the flows by gravity to Lift Station No. 2, was investigated. This scenario would require that Lift Station No. 2 be rehabilitated and lowered 5 feet to intercept the gravity sewer that would have depths exceeding 30 feet at location. This scenario is not feasible. See Appendix C for a figure of the existing Sunset Drive Sewer plans for reference. Grease Trap Replacement The grease trap for Lord Fletcher’s is located at the pump station near the corner of Sunset Drive and Dickison Avenue which sits an estimated 800 feet away from their discharge point. This leads to a building up of oil and grease in the sewer system between the two points. As part of this project, we would recommend the replacement of the grease trap closer to the discharge point of Lord Fletcher’s sewer service. Underground Power and Communication Facilities The city is in the process of adopting a joint trench requirement for all power and communication utilities. This will allow for better planning and layout of these facilities as opposed to coordinating locations between all communication facilities for installation within the right-of-way. Coordination between electric and communications facilities will begin immediately to allow for as much time as possible for this work to be completed. 3. IMPACT OF PROPOSED IMPROVEMENTS The proposed street improvements will not create new maintenance issues for the Public Works staff. The City will work with affected property owners and the Contractor to resolve any situations that may arise during construction. Short term traffic delays, construction dust and noise, and erosion may occur. Efforts to minimize these impacts include the restriction of work hours and dust and erosion control measures included in the project. Any disruptions that occur to existing yards, and driveways will be restored. Sprinkler systems located within the right-of-way are the responsibility of the property owner to remove and replace at their expense. Several alternatives for utility replacement have been reviewed and it has been determined that the sanitary sewer and water utilities will be replace by conventional open trench methods. The City utility plans and specification will be incorporated into the Hennepin County roadway project to enable concurrent 2024 construction. It is Sambatek’s recommendation that this project is feasible as outlined in this report and we recommend moving forward with design and water main modeling tasks.
