Council Member Comment Brixius said recently a structure was proposed that was two-three times larger than the primary structure and it was denied. Brixius said the PC decided to restudy this. Brixius said there was review criteria and it was found it did not provide a strong enough case. He said what is a reasonable size accessory structure needs to be defined. Brixius said it should be studied if the size should be for both detached and attached and whether it is cumulative to include other structures on the lot. Brixius refers to Council member Sippel's comments included in the packet. He said floor area needs to be defined along with height restrictions. Brixius said Sippel is suggesting the size be limited to allowable footprint and allowing rafter space. Brixius said there is no current code regarding plumbing in an accessory structure. He said plumbing and electrical become the potential for home businesses and rental properties. Brixius said accessory structures also need to be studied in relation to the primary structure. Brixius said Orono has a circumstance where the restrictions are based on the size of parcel. Brixius said Spring Park does not compare to Orono in parcel size. Brixius said the Rehman property is approximately 14000 feet. He said if 10% was allowed he could have had 1400 square feet. Brixius said hardcover becomes an issue and Engineer Pearson might need to weigh in on this for drainage purposes. Brixius said Orono's code also restricts the accessory structure to disallowing plumbing fixtures preventing rental potential. Brixius said Minnetonka Beach have similar issues in terms of lakeshore but they were more generous in allowing larger accessory buildings and it is cumulative. 4349 WARREN AVENUE, SPRING PARK, MINNESOTA 55384-9711 (952)471-9051 FAX(952)471-9160 Brixius said also included is Delano's code as it establishes a limit on AB, it establishes sizes per zoning district and if it's attached, they don't allow the attached to go over 80% of the primary dwelling. Brixius said in each case there is some flexibility on setbacks. Brixius said a • lot of communities go to smaller setbacks (five feet). Brixius said if the building size is increased there will have to be flexibility on impervious surface. Brixius said he had at first just removed the CUP option and limited the accessory structure to 1000 square feet but he feels this is insufficient. Hoffman had a question about Orono's lot sizes. Mason said regarding size of property/size of house, a percentage allowance would seem reasonable. He said he looks for improvement to the lot, perhaps removing substandard structures. Brixius wondered if Mason was looking at a limit of 10% coverage. Brixius said right now, everyone is entitled to 1,000 square feet and it could be made that or 10%, whichever is greater. He said in the case of smaller lots, would 1,000 square feet be considered too much. Kaczanowski wonders about putting too many restrictions because he agrees, they should look for lot improvement. Hoffman likes the percentage where garages can't become larger than the principal structure. Brixius said there could be such a thing where if the garage is attached, it can't exceed the size of the primary structure. Hoffman said if someone is going to build one structure that includes a garage he feels there shouldn't be restrictions except to hardcover and setbacks. Hoffman said he thinks an attached garage is considered attached if it has common footings and is part of the design element of the house. Another discussion is about whether to allow plumbing. Mason agrees with Kaczanowski's original analysis in that a wash sink would be allowable but stipulate no shower/bath and no toilet. Hoffman said the original code was to prevent people from living in garages. Hoffman said he's personally okay with a toilet. He said he's not in favor of showers being allowed. • Hardcover. Hoffman feels strongly about this and he is not in favor of adjusting this. Brixius said the DNR allows 40% hardcover. The Minnehaha Watershed District also must comment on this increase. He believes the city engineer can draft a list of five options to slow the rate of flow and treatment options. Hoffman said right now he thinks accessory buildings are limited to one and perhaps one other regarding a shed under 100 square feet. Brixius thinks this should be made very clear. Hoffman is in favor of keeping it to one accessory structure. Brixius said Delano stipulates the total is limited to one attached, one detached or two detached if not attached. Mason is in favor of two detached structures. Kaczanowski likes the second structure being limited to a small shed-type size. Hoffman is not in favor of more than one accessory building given the character of the neighborhood. Garages have a specific use to store a car but they can be used for other things. Hoffman said if he designs a house and he wants 3/4 of the house to be garage and Y4 to be house, that's his right. He's concerned we're getting involved in design limitations. Brixius said communities do have architectural standards. He said if by definition an accessory building is subordinate then it shouldn't outsize the house. He said one way is to not allow the accessory structure to exceed the size of the house or have a cumulative limit. Brixius said if a cap is set, do they include both attached and detached or percentage of lot area; Brixius will look at both. Brixius said recapping the discussion, an attached garage needs to have common footings, as far as plumbing would a wash sink/toilet be allowed, the number of accessory buildings to be capped at two and limit the size of the second to a small shed, impervious surface should be given a menu of drainage options. Hoffman wonders • about floor drains. Brixius said they don't like garage floor drains going into the storm sewer. Kaczanowski wonders if the square footage should be discussed further. He said 1,000 square feet is a four car garage. Brixius said 200 feet more isn't that much. Kaczanowski wonders about ratio and attached garage cannot exceed a certain ratio. All votes ayes, motion carries. 5. APPROVAL OF MINUTES a. Planning Commission Meeting Minutes from January 8, 2014 — Struck makes a motion and Kaczanowski seconds to approve the minutes. All votes ayes, motion carries. • 6. CONSIDERATION/DISCUSSION ITEMS a. 2401 Black Lake Road Variance Application — Brixius said there is a request for construction of a 22x22 detached garage. He said this is zoned R-1 and the existing site is legal non conforming. He said the site has history and Brixius points to photos. He said the house used to have a tuck under garage but it was decided to use this as living space. Brixius said a variance application came before the council in 2006 for the purpose of building a garage and it was denied. The applicant is requesting a new garage location. The footprint is 22 x 22 and it is worked into a slope. He said a foundation is being proposed versus the garage being set upon fill. Brixius said accessory garages are allowed in R-1 districts. Since the 2006 proposal the comprehensive plan has focused on modernization of the housing stock. He said it also needs to maintain the character of the neighborhood. Aerial photos illustrate the challenges posed on Black Lake Road. Brixius said there was opportunity to build a garage previously and it was declined. He said the variance criteria has changed and the lot is unique and the circumstance is it wasn't created by the property owner. Brixius said in looking at the site there are lot setbacks that are allowed to be averaged. It meets the lot width requirements. The building has been shifted to the north so it is outside the drainage easement and compliant with the sideyard setbacks. The only setback variance being requested is the lake setback from 50 feet to 35 feet. Pervious pavers are being proposed and a slated deck to allow runoff to flow through. He said the impervious surface has been reduced and stormwater and erosion control will be required. Additionally rain • gardens will be reviewed and approved by the city engineer. There are a number of conditions as set out in his memo. Brixius suggested softening of the lakeside presentation of the garage with landscaping. Brixius said if approval is granted, there are conditions that need to be considered and they are outlined on page seven of the planner's memo. Struck asked about the impact on the neighbors on the • south side. Brixius explained because of the easement it is more than compliant with the setback. She wonders about the slope flowing to the neighboring property. Brixius said it is a requirement of the engineers report that drainage be designed to flow to the rain gardens. i. Open Public Hearing — Hoffman opens the public hearing at 7:19 pm. He directs those with comments to step to the podium. ii. Comments/Discussion - Fadell is the current homeowner. He said he purchased the home in 2003 along with a friend. They were bachelors and thought it would be a fun project. He said the structure was a lake cabin and the driveway had a very steep grade and he believes that is his hardship. He said in redesigning the property, their concern was the foundation and it was found the house had to be rebuilt. They were concerned about being stuck with something that couldn't be changed. Fadell said fast forward ten years and he is the primary owner now after buying Neve out. He said he is married and has four children and they've outgrown the two bedroom house. Fadell said his wife was unable to make it but his wife wanted it known that one of their children has a neurological condition and it is necessary they need to relocate closer to a primary care provider. Fadell said he is open to working with the Watershed for the rain garden recommendations. Kaczanowski asked about reducing the impervious surface. Fadell said the driveway will be shortened and narrowed and therefore it reduces the impervious surface so it's gone from 28 to 22%. Kaczanowski asked about the garage size of 22'. Fadell said it is designed to be as small as possible and allow movement around the vehicle. Brixius said the initial proposal was 20x20 and it doesn't allow for extra items to be stored. Hoffman said it's • nice to see a sizeable driveway in front of the garage from a safety standard. Kaczanowski wondered if a single car garage was considered. Fadell said width has never been a problem, it's the depth. Kaczanowski wondered about obstructed views. He thought there could be a couple affected properties across the street. Fadell said he does have a support sheet signed from the neighbor across the street. Mason asked about storage underneath the garage. Fadell said it's about 484 feet. Mason wondered what the floor will be and Fadell said it will be on a slab. Kaczanowski asked if there will be any fill added and Fadell said no, because of the garage being placed on a foundation instead of a filled site. Hoffman asked about calculations where adjoining properties would be averaged. Brixius said averaging was previously eliminated on the shoreline side but it's allowed on the street side. Hoffman said he thinks the garage looks very nice and it will add a lot. Hoffman said it's always a concern due to precedent and they have to justify their recommendations. He said the fact that this is a garage and we are updating our accessory structure ordinance, the timing is good. iii. Close Public Hearing — Hoffman closes the public hearing at 7:34 pm. Kaczanowski asked about the house to the south and said they are setback about 29 feet so the garage is not extending beyond that. Kaczanowski asked about the floodplain and wondered if the DNR would be involved. Brixius said no, the DNR will not be involved with this. He said the basement of the garage has to be three feet above the ordinary high water mark and, it is. Struck said it looks like most of the residents on Black Lake Road have garages so it's not out of character. Mason asked about the easement and wondered if there would be a problem. Brixius said the easement would remain unencumbered. Kaczanowski said the existing driveway goes almost to about 20 feet from the lake but with the proposed garage they are • improving the situation by backing the parking away from the lake and he thinks that's a plus. Recommendation to Council — Hoffman will accept a motion to recommend to the • council the variance request for 2401 Black Lake Road lakeside setback and to include the six conditions in the planner's report on page seven. Struck would like to make that motion provided the items on page seven under section d. are met. Brixius asks to include the findings on page six and seven. Struck accepts that friendly amendment. Mason seconds. Motion was approved unanimously. b. Accessory Structure Size Limit Draft Ordinance — Brixius said this is a draft for discussion. He said the joint workshop meeting offered a number of suggestions for definitions, size, exempting attached garage floor area and establishing a number for accessory structures. He said before this goes to public hearing, there are items that need to be discussed further. Brixius goes through his attached redline memo specifically regarding height requirements, number of detached accessory buildings, allowable size, exterior materials, water sources allowed but restricted, prohibited uses are restated, connection to principal building and impervious surface elements. . Kaczanowski asked about a gazebo that is open air and Brixius said this should be made more clear. Comments: Under definitions, Hoffman said he thinks that looks good. Brixius asked about construction time-frame regarding the principal structure has to be built first and PC is good with that. Brixius asked about floor area. Struck said a large building was recently voted down because it superceded the size of the house. She said a 1200 square foot garage could be larger than a lot of homes in Spring Park. Struck is also concerned with allowing an attached • garage with no limitations in size. She said there could be a 4,000 sf house and then they could have a 4,000 sq attached garage. Hoffman asked what were the numbers she was thinking. She said she wasn't sure. Brixius said it can be based on the foundation size or the square footage of the house. He said foundation size gives more control. Mason said it's desirable to be able to move items inside versus outside. He feels a 1200 square foot garage would be nice if it was in keeping with the character of the neighborhood. Struck is concerned with the small lots and wonders if 1200 square feet is too big. Brixius said if it's based on the foundation footprint, there is some protection that way. • Regarding accessory building size — (detached garage), Mason thinks the 1200 square feet is good. Struck thinks it should be limited to 1000, Hoffman 1200 and Kaczanowski votes 1000, vote is split. Hoffman is in favor of 1200 because he thinks anything like this will be architecturally designed and it will be proportional. Struck agrees with that on new construction but she is concerned with someone just adding a garage, it might not be designed. • Size of the attached garage and how should that be determined - Struck wonders if it can be a percentage. Hoffman talks about a tuckunder garage situation. Brixius said most tuckunder garages also need an entrance. Brixius said it's easier to base it on the foundation size. Mason can live with 80%, Struck said 80% Hoffman said 100% and Kaczanowski feels somewhere in between. • Building height - 16 feet with median grade and median point of the roof. No change. • Number of accessory buildings - Hoffman said he was never in favor of allowing more • than two buildings. He said a house with an attached garage, a detached garage and a 100 square foot shed seems allowable. Kaczanowski asked about the number of garages. She said using her property as an example in order to be within in the setbacks she would not be able to build a two car garage because it would go into her house. She would then build two single car garages based on the lot configuration. She said she would also probably need to have a shed. Mason likes the idea of a detached garage and a shed. Brixius said the total number of accessory buildings have to stay within the square footage cap. He said maybe it's an attached garage and one detached building. Hoffman said not all accessory structures are garages. He said there can be a greenhouse, a pool house, a gazebo. Kaczanowski wonders if there are any statistics on how many properties have accessory structures. The question is if there is an attached garage, does the attached garage count as one of the accessory structures. All PC's are okay with the language as written in the planner's memo. • Architectural Materials - Hoffman said he's starting to see metal panels as an architectural style so he doesn't think they should be disallowed. He's in favor of allowing a percentage. Brixius said this may be an issue with new construction but he would be hesitant to encourage something that doesn't match the siding of the house. It's decided that there will be a limit put on materials at 30%. • Plumbing - Hoffman, Mason and Kaczanowski vote for allowing a toilet and Struck votes against the toilet. The language will remain as suggested. • Continuous foundation and underpinning is considered a continuation of the foundation. • Next item was setbacks and all required should be met. • Brixius said the stormwater impervious surface section will be added after it's reviewed by the engineer. Struck asked about building permits lasting longer than a year. Brixius thought it was part of the building code and he could check with the building inspector on this. 7. COMMUNICATIONS a. Planner Brixius, Ex Officio Bren, Administrator Tolsma, Clerk Lewin and city resident, Richard Rehman. 1. CALL TO ORDER — Hoffman called the meeting to order at 7 p.m. 2. PLEDGE OF ALLEGIANCE - 3. OATH OF OFFICE a. Gavin Tempero - Tempero is sworn in. Hoffman asks Tempero to tell a little about himself. Tempero said he's lived in this area for many years after short term stints in DC and Arizona. He said he has a friend that serves on the planning commission in a different city and he's intrigued with community service and wants to be part of it. Pete Kaczanowski said he started about a year ago. He is a Navy Veteran and he and his wife live on Sunset Drive with their two sons. Jeff Hoffman said he's been involved with the city for many years and served on both the council • and the planning commission. Sarah Struck said she has served about six years. She said she was interested when The Mist condominium went up. She said it's been interesting and eye opening and she feels she has learned a lot. Mike Mason said he's lived in Spring Park since '76. He lives next to The Mist on Del Otero and has served on the Planning Commission for a while. He's retired now. Shirley Bren said she is the representative from the council and it's her first term and she's learning a lot. Bren said in the 80's she was the St. Boni City Clerk and also on their council. She said she's interested in this area and the community. Rick Rehman is a Spring Park resident and also lives on Del Otero, next to Mason. Al Brixius introduced himself as the City Planner. 4. ROLL CALL 5. ADOPT AGENDA — Hoffman said Mason has requested to be added to Miscellaneous. Mason makes a motion and Struck seconds to adopt the agenda. All votes ayes, motion carries. 6. APPROVAL OF MINUTES a. Planning Commission Meeting Minutes from February 12, 2014 — Mason said he had some corrections to the minutes and those changes were discussed with Lewin. Mason makes a motion and Kaczanowski seconds to approve the minutes. All votes ayes, motion carries. 7. CONSIDERATION/DISCUSSION ITEMS • a. Accessory Structure Ordinance Amendment— 4349 WARREN AVENUE, SPRING PARK, MINNESOTA 55384-9711 (952) 471-9051 FAX (952) 471-9160 2 Brixius said the draft ordinance presented tonight has changes outlined in red. He said the zoning ordinance is being addressed. He said there are minor changes in the definitions and the opportunity for CUP has been removed. Brixius said what's being proposed is accessory • building size shall be measured by the foundation size and won't exceed 1200 square feet. Brixius said rafter storage will be allowed and won't count against the square footage. He said an attached garage can be equal to the size of the primary structure and the accessory structure can be 80% of the principal structure. Brixius discussed the proposed changes in the draft ordinance presented and he wants to make sure the commissioners are clear on the number of accessory buildings allowed. • Brixius references handouts set in front of the commissioners regarding aerial surveys done and said most properties didn't have more than one or two accessory structures per lot. • Brixius said structural design materials are shown and discussed. He said there is concern that new structural material allowances probably won't match the principal structure, i.e. metal sided structures. • Plumbing will be allowed to the extent of a toilet and a wash sink. • Building height will not change. • Home occupations will not be allowed in the accessory structure as it's not in character with the neighborhood. • Continuous foundation and shared wall is considered to be attached. Hoffman said he has three areas he would like to discuss: under 1.a whether an attached garage size should be limited in size to 80-100% of the principal structure. Kaczanowski asked if it was common in other communities to have a smaller attached garage. Brixius said • most communities he works in are growth communities and have larger lot sizes. He said the size of the garage can diminish the house so the 80% limitation works. Struck refers to the Comprehensive Plan talking about the concern for monster houses and too much impervious surface. Brixius said Spring Park is a cottage community and the 80% protection would prevent monster homes. Kaczanowski likes the 80% but no larger than 1200 square feet. Struck said that she thinks this is extending the size of the accessory building quite a bit as they could build 1200 square feet and a second floor of 1200 square feet as long as it stays under the height requirement. Hoffman refers to 3. a & b, asking about the number of detached buildings. He said as written, what's allowed is an attached garage, two accessory structures and one small shed. Brixius said he looks at what can go wrong. He said in order to keep the accessory building from dominating the site, the number of accessory buildings allowed could also dominate the site. Kaczanowski said he's concerned about three garages - one small house with an attached garage and two accessory structures plus a shed. Brixius recommends one accessory building if there is an attached garage, and one small shed. Tempero asked if there is the 30% hardcover protection thereby possibly limiting the number and size of the accessory structures. Struck agrees because they would also have to meet setbacks. Struck said she has driven around and noticed that not many lots have three accessory structures. Tempero thinks regarding the shed, the height limitation of 8 feet should be included in the 100 square foot limitation. • In discussing the allowable materials, Hoffman said it was very clear no pole-barn type buildings would be allowed. Hoffman points out that allowable design materials are limited to 30% if they are contrasting. Brixius said he's comfortable with the 30% accent material. Kaczanowski said complimentary can be arbitrary and Hoffman agrees but believes the design element should be between the property owner • and the architect. He understands limitations in a commercial district but he believes it's a personal choice for a home owner. Brixius said he's comfortable with the 30%. Hoffman said originally the language was to not allow any decorative materials contrasting with the principal structure. Kaczanowski wonders about the word "similar." Brixius said someone may build a brick house and not want to build a brick garage so something similar or complimentary. Hoffman asked if anyone is opposed to item 4. Kaczanowski asked about unfinished metal as he's imagining dull sheet metal. Hoffman said he's seeing unfinished metal that is allowed to rust and it's a new decorative style that has emerged recently. Planning Commissioners are in agreement with 4a. i. Open Public Hearing — Hoffman opens the public hearing at 8 pm. and asks for audience members to be heard. ii. Comments/Discussion - Rich Rehman, 3914 Del Otero Avenue. He said he wants to discuss the 1200 feet plus 1200 and notes that less than half would only be allowed because of the 16 foot height limit. Rehman said he would like it bigger than 1200. He said he fit the code when he came in and he is upset about the change. Rehman said in 1996 townhouses were allowed on his block and he thinks it ruined the neighborhood and then The Mist was allowed so he feels there are detriments already in his neighborhood. He think his proposal for his garage is no different. Rehman is looking for a three car garage with a spot of his boat because he doesn't like things outside. He thinks there is too much government involved. He wonders what his chances are for getting a sideyard variance for six feet from the property line instead of ten feet. He's asking the commissioners what his chances would be if he requested a sideyard variance. • Brixius said Rehman would have it tough as he would have to prove why he needed the sideyard variance when he could build what was allowed without it. Rehman said his lot allows for him to build a bigger garage and that's what he would like. iii. Close Public Hearing - Hoffman closes the public hearing at 8.05 pm. Hoffman said he doesn't think a casual opinion would work tonight about the sideyard setback variance request. Brixus said if it can be put on the lot without a variance, that's what should be strived for. Brixius said it will work against him if he has the room without a variance. Brixius said it's a risk. Rehman wondered if the code would ever be changed so a sideyard could go to five feet. Brixius said they've posed this before and it's been decided that ten foot sideyard setbacks will stay. iv. Variance Request Public Hearing — Brixius said there is a variance application from Joel and Catherine Shoop requesting a sideyard setback variance. He said the current home is legally non conforming but is compliant with the lot width. Brixius said the existing home is non conforming regarding shoreline setback and the west side yard setback is also presently non conforming. Brixius said the proposed site plan is illustrated with the demolition and the new construction. Brixius outlines the proposal on the overhead slide. He said the standard sideyard setback is ten feet. He said grading and drainage issues have been discussed but the applicants want to make sure the variance is approved before more spending is done. Brixius said variance criteria was discussed with the applicants and an application narrative was provided by them. Their specific claim is the lot condition is unique to the property. Brixius said there is unique topography to the property. He said the proposed use is a side loaded garage and the driveway would slope. Because of the slope of the lot and the side loaded garage, a turning radius is necessary. Brixius said new construction does not have negative impact to a neighborhood. The comprehensive plan looks for continued reinvestment, however proper setbacks are encouraged. Brixius said the west side of the lot is 6% slope and it's not uncommon. Brixius said the hardship seems to be the way the home is designed. Brixius said a difficult component is the fact that the house could be designed to fit the lot without variance. Brixius said most homes on West Arm Road are non compliant. Brixius said an alternative design could be made to fit the lot without variance. Brixius reminds the commissioners of a variance granted in 2009 for a side yard setback but that lot 48 feet wide. Brixius said to justify this they must agree the topography provides practical Am- Wiculty, overall site design reduces the present non conformity, it is not out of character with the neighborhood. Brixius said a grading and drainage plan needs to be submitted if this variance is accepted. Mason said without the impervious driveway would they be over and Shoop said they'd be close but at about 31%. i. Open Public Hearing — Hoffman opens the public hearing at 7:17 pm. Joel Shoop, 4336 West Arm Road said there has been discussion about the narrowness of the lot and that it is 56 feet and meets the average lot size but he reminds commissioners there is a four foot existing retaining wall that extends into the property. Shoop said one of the points is the front load garage would be reducing the driveway length. He said as a practical use it makes sense to have the longer driveway to maintain off street parking. Shoop said a longer driveway would help with flattening out the driveway so it wouldn't be as difficult to get out in the winter. Shoop said they are making some significant relief to the lakeshore setback and they are making the sideyard setback better than what is present. He said the alternative is they keep the present structure in place and expand in the conforming part of the lot. Catherine Shoop, 4336 West Arm Road. She said the additional driveway length improves the space for additional parking. She said the nature of the street and the dead end speaks to a more practical use. Kaczanowski asked about the age of the current structure. Shoop said he's not sure. Kaczanowski asked about the new house with a front loading garage and wondered if they've looked at designs. Shoop said they have but they want a longer driveway because of the slope. Kaczanowski wonders if it would increase hardcover with a front load garage and Shoop said it wouldn't as they are looking to use pervious pavers anyway. Hoffman said the garage depth is 21.6 Qd it's about 31 feet in width. He said if it's rotated, they would be gaining driveway space instead of Ksing it. Catherine said the sideload garage makes for better parked vehicle maneuverability. Brixius said the proposed turn radius is tight and really works for smaller vehicles only. Hoffman said if the garage is rotated and they don't need the sideyard setback they could gain some space by moving the garage slightly closer to the road and he wondered if they considered that. Shoop said they have but are committed to the sideload garage in order accommodate excess parking. Tempero asked if the turning range was tested with a Suburban. Shoop said they did try it. He said it was tight but they were able to do it. Kaczanowski said he likes the photographs and the detail but said when pulling out of the garage, it seems like it would be very tight. He wonders about safety concerns with the front entrance of the house. Shoop said this was worked through and they did expand the garage an additional three feet in consideration of the front entrance. Mason asked whose retaining wall was on the property and Shoop said it was theirs. Kaczanowski wondered about the house flipping over and entering on the west side and Shoop said it was discussed but a variance would still be needed on that side because of the retaining wall. Struck wondered about a detached garage and Shoops said they have considered it. Tempero wonders about the steep slope coming off of the trail and continuing down the hill and running into the house and driveway. Shoop said they've considered this as well and are hoping pervious pavers would mitigate some of the drainage and grading plans to slope it away as much as they can. Kaczanowski said the newer design pavers will perhaps still continue the flow in the direction it goes. Shoop said they definitely will have to use some specialists to get the drainage corrected. ii. Comments/Discussion Hoffman asked if there was anyone in the audience that wanted to speak. Patricia Diettrich 4334 est Arm Road said she submitted a letter but also wanted to speak. She said she is requesting nial because of the ruling for ten foot side yard. She said she is concerned about the height of the building and is concerned about loss of sunlight and the rain runoff coming off the roof. Bob Diettrich, 4334 West Arm Road asked Shoop about the retaining *all and wondered if it could be removed. Shoop said it really can't because the neighboring property is right up next to it and it's not secured but tiered into the lot. Diettrich said he wonders about the proposed driveway and what will happen with all the snow. He said it will all have to be blown away. Diettrich said the drainage affects everyone. He said it's the city's problem because of the way it drains. He wants someone to look when it's raining because it flows right into Palens yard and they end up with a slough in their yard. Diettrich feels Shoop will really have drainage problems. Diettrich said a realtor told him their property could be worth less because of the closeness and the extra shading that will come with the taller house. Catherine Palen, 4352 West Arm Rd, on the other side of Diettrich. Catherine is very pleased that Joel and Catherine are going to build a new home. She said they want them in their neighborhood. However, Catherine said they will deal with drainage issues and it will be bad. She said when it rains, for them, it drains between their and Diettrich's house and pools and percolates in their front yard. She said there will continue to be a water issue until something is done by the city to correct these drainage issues. She wonders if a rain pond can be engineered to adequately handle the runoff but doesn't think it can be fixed until the city takes care of the runoff. She said the city needs to give some thought to this and help them all out but, especially the Shoops. iii. Close Public Hearing — Struck makes a motion and Kaczanowski seconds to close the public hearing at 7:47 pm. Hoffman asked if there were additional questions. Hoffman wants to thank the audience for their comments. He said stormwater management is a big part of what they try to do. Hoffman said there was a large group of citizens from Spring Park who put together the Comprehensive Plan. He said consideration was given to how neighborhoods look. He said they wanted a more open area versus a crammed Rok. He said this is why the ten yard setbacks are held when they can be. Hoffman is looking for a otion to approve. iv. Recommendation to Council Hoffman makes a motion to approve this with the findings of the planner. Struck seconds. Kaczanowski wants to be clear about the findings of the planner. Hoffman said it's on the summary page. Hoffman is making a recommendation for option one with the findings. Brixius said with option one to please include the four conditions of approval and Brixius would like to add a fifth option that the house be designed with gutters to direct rain and drainage away from the side yard. Hoffman accepts that amendment and Struck accepts the amendment. Struck asked if the motion was to approve option one. Mason, yes. Struck, Kaczanowski, Tempero and Hoffman all vote no. Variance application is denied. Brixius is looking for a vote on Option two with the findings in order to incorporate into a resolution for council because he needs findings for denial. Tolsma said the picnic shelter came in at $10-20,000. He said there is a drainage issue so that is listed. Tolsma said he wants the PC to see what is allocated for the park in this year's • budget. He said it's money that could be worked with and recommendations could be made and presented to the council. Tolsma said this can be a topic in upcoming meetings. • Mason asked if playground repairs have been made that were suggested. Tolsma said there were some minor repairs made and there are some that still need to be fixed. Struck thinks maintenance is necessary even if it's not ADA compliant. • Kaczanowski said he is a Scout leader for Eagle Scout projects and it's nice to have the list for maybe a project. • It's decided, weather permitting, to meet at the park a little earlier - such as 6:30. Struck said she can make it at 6:30 and they'll go to Wilkes Park too. • Struck said the League of Cities has an entire section on playgrounds and there is a booklet that addresses park standards and things to think about for parks. She said it's really eye opening and talks about signage, playground equipment, who is the customer. She said it was a good read. Tolsma talks about a recent article in a League magazine and would probably make that a part of next month's meeting. • Mason asked about the concerns of West Arm Road. Tolsma said he thinks the wind is blowing and the present council is starting to say that these roads do need attention. Mason said the group that was present tonight have some real and just concerns and drainage has to be addressed. Bren said the water comes off the trail and she wonders if this involves Three Rivers or the Railroad. She said she would like to see a street plan and that might be a good one to start with. Brixius said this is a revolving issue and he thinks a petition should be encouraged so this can be studied. He said the city has very limited space to control. He said West Arm Road is probably 18 feet wide and if there are aging utilities it needs to fixed. He • said there has to be a storm water component in order to resolve the larger issue of drainage. Mason said if the drainage problem isn't corrected and a new house is built on the lot, they will more than likely want the city to correct it once the new house is built. Hoffman said he attended a couple of classes offered by the League and he wondered if they were still offered. He found them very helpful. Lakeside Accessory Structure Discussion (Start by 8:00) Hoffman explained he was contacted by the Mayor and the Planning Commission is being asked to revisit accessory buildings on lakeside setbacks. Brixius said on April 21 st the council approved the proposed ordinance but added to prohibit a . detached accessory structure between the principal structure and the shoreline. Council felt this wasn't previously considered and only locational setbacks were discussed. In other words, if it could meet the setbacks, it would be allowed. John Perry, 4516 West Arm Rd, is proposing an addition on his home. He has an existing utility easement and he is interested in a 500 square foot accessory structure. Brixius said the initial review showed everything in compliance. However, the council upon hearing about the application made a determination that an accessory building between the principal structure and the shoreline could be detrimental and they did not want to establish a trend. Brixius said the concern is these accessory structures could become dwelling units. A provision was allowed for open air structures such as gazebos. Brixius said the ordinance represents what was adopted. The provision changed is provision d., setbacks, stating it can't be located between the primary structure and the lakeshore. Perry's request came at the time the council and PC were reviewing the accessory structure ordinance. Hoffman said to summarize, as the application is now, the ordinance the PC proposed would permit this but the ordinance adopted would not allow this. Hoffman recalls previously talking about this because an example used was a pool with a pool house. He said a pool house will have toilet facilities but he feels it's an acceptable use so, he remembers discussing this in that context. Hoffman said he's concerned because no one is guaranteed a view. He said as long as a lot can accommodate a proposed accessory structure, without needing a variance, he thinks it should be allowed. He is opposed to not allowing someone to do what they want with their property. Mason said he understands existing boathouses are allowed. He wonders if other cities should be consulted in order to find out what they allow. Mason wonders about a scaled down version and he is offering some suggestions to help this work. Perry said he is designing this to not block views and with how high the houses sit up on the hill, they wouldn't be blocking views as they would look over this structure. Perry said his neighbor is interested in relocating the easement along with Perry and they are in the process of getting cost estimates. Hoffman said there are two absent commissioners and he would also like their feedback. Hoffman said he thinks it would be acceptable to schedule a public hearing and it could be discussed along with feedback from the missing members. Tempero said his neighbor has put up a row of arborvitae that will someday totally block his view. He understands that this is allowed and he can't do anything about it. Tempero asked if the roof of the accessory structure is about the height of the basement of the primary structure. Perry said he doesn't have the exact calculations but his intent is to have the roof of the accessory structure no higher than one foot or so than the basement level. Tempero wonders if that's something that could be written into the ordinance that the height of the access structure can't exceed a certain height above the basement level of the primary structure. Brixius said they should publish for the public hearing and try to examine the proposals that could come forward. He said there has to be protections built in for those who are not conscientious about what they are building. He said this feedback will be brought back to the council. Brixius thinks Perry has a practical hardship with the easement going through his property. Perry feels not being allowed to do this takes away the value of his property. He knows the proposed accessory structure would add to the value of his property. Brixius said the city's concerns are these accessory structures turning into rental, home occupation or a businesses. Sarah Struck's Comments: I did read the notes and if I can comment via email; l am in favor of the language proposed in May 6, Memorandum from NAC re: Spring Park - City Council amendment to accessory building ordinance. My reasoning is based on having some green space remaining in lake facing properties and for this really points to same line of thinking we discussed for accessory buildings on non-lake lots. The idea was to see fewer buildings and more green space, avoid unnecessary clutter on small lots. The same should apply to larger lots. For me, particularly when the shore is viewed from the lake and enjoyed by many from all directions I think there is a greater onus to monitor the number and types of buildings and style. l agree with the council's comments in the document. c. Sign Application - (Sign applicant (David Linnell) met the commissioners during the park tour because he had another appointment: He said at some point he may be interested in having a permanent sign that sticks out perpendicular to the building to catch commuters eye. Linnell said he will be storing the rental boards in a trailer but during the day they will be on the lakeside. He said they are proposing two non-illuminated signs. He said since they're occupying two tenant bays they are allowed signage across both. He said there have been some issues in the past about dock storage along Del Otero so he doesn't want this to become a problem. Accessory Structure — Brixius said a previous ordinance was adopted but the council changed language that any accessory structures shall not be located between the shoreline and the principal building. He said that during that time an application came forward to the city for an accessory structure to be placed between the principal structure and the shoreline. Brixius said zoning and shoreland regulations are drafted specifically for Spring Park and are not modeled after the DNR ordinance. Brixius said in 2006 setback averaging was seen as an intrusion and a restriction and it was appealed in favor of the standard 50 foot setback. Brixius said accessory structures were not anticipated at that time. Brixius said recently the accessory structure ordinance was changed to allow for a larger structure and floor space is not counted above rafters. Brixius said what's to be considered is the principal building is the major investment in the property. Brixius said some accessory buildings may have a lesser construction standard and a lesser value and it has a potential impact. Brixius said it's intended to be accessory, not to be used as a residence, a home occupation or a business. He said what needs to be considered are has been outlined in the summary portion of his memo dated June 5, 2014. i. Open Public Hearing — Hoffman opens the public hearing at 7:15 pm. John Perry said he doesn't know what the PC is thinking so he doesn't know if he should speak now. John Perry, 4516 West Arm Rd. He said this started by buying the property with intent to increase the size. He said there is a sewer easement that goes through his property. He later discovered the easement is only 15 feet from his residence so he can't add on. Perry said it was suggested that a beach house could be built for storage. Once he started talking to the city about his plans he realized there weren't really any limitations placed on the boathouse as long as he met setbacks, hardcover • restrictions, etc. He said he was told initially he could do this and now this is being taken away. Perry said he has a 20 foot hill so site lines wouldn't be bothered. He understands that views need to be protected and he doesn't think views should be blocked. He said he is going to pay to move the sewer in order to get additional space but it will still leave him with a two car garage. He • thinks he should be allowed to build this boat structure as he needs the space. Perry thinks taking away any accessory structure from being allowed between the lakeshore and the principal building should not happen. Perry believes each request should be considered for line-of-site views and not just flat out not allowed. Perry said he has a deep lot with a lot of property and he would be losing 90 feet of property that he can't do anything with. He said it will affect his house value. Perry said he contacted several cities and most cities he contacted allowed structures within 50 feet. Mason asked if he's contacted any of his neighbors and Perry said one of his neighbors is interested in doing similar. The other neighbor he doesn't know what their thoughts are. Perry argues that if the house to the west of him is torn down in the future, they would be allowed to build 50 feet from the lake and it would impede his view. Mason said Perry's property is unique in that he has a drop down hill. Brixius said this particular lot is unique and because of the utility easement this property would be considered for variance. He said the point being principal structures can be 50 feet from the lake. Brixius said this is similar to what was approved at 2401 Black Lake Rd with the garage built into a hill. Tempero said he doesn't like the extra words that were added to the approved ordinance about not allowing something between the house and the lakeshore. He said his neighbors have large trees that block his views and he realizes there is nothing he can do about it. Tempero wonders if there can be restrictions added that would trigger a variance action. Hoffman said this was taken into consideration when they approved the original ordinance. He looks to make this fair. He said someone who has a flat lot would not be able to build a structure. Hoffman said the DNR set the setback because they are worried about the view from the water. He said no one is guaranteed a view. He said he doesn't think the city should be worried about views. He believes in being fair. He is opposed to restricting this. He feels if he has the property and meets the setbacks, this should be allowed. He said if this proposal was not being built on the lake, it would be allowed to be built. Hoffman said he's not in favor of compromise and they worked hard on this and did their due diligence in crafting the original ordinance. Mason agrees with what Hoffman is saying. Tempero agrees too, but he wonders if they can give them something versus rejecting it, it might go over better. Mason said this is a boutique amendment and came up because of the proposal in front of us today. Hoffman isn't sure about that but believes on principle this should be fair for both lakeshore and non lakeshore owners. ii. Take Comments / Discussion iii. Close Public Hearing — Mason makes a motion and Tempero seconds to close the public hearing at 7:39 p.m. All votes ayes, motion carries. iv. Recommendation — Brixius said he recommends that the PC reject the additional language and Hoffman wonders what would be the compromise. Brixius said he would take Perry's plans and use them as an example. He said that might be a starting point. Hoffman said he believes a standard is being set with the present language being proposed. Hoffman said again if this property wasn't on the lake, it would be allowed to be built. Hoffman said he is not in favor of compromise on this. Hoffman makes a motion to strike the proposed language in the amendment. Mason seconds. Brixius clarified the prohibition of accessory structures between the principal • structure and the shoreline. One of two is to deal with that drainage area with the install of storm sewer and diverting it to the storm sewer across the street and the second option is to do the drainage but also combine it with a road project. Manufacturing District Uses - Brixius said there have been some businesses that have gone into the Tonka Business Center. He said allowed is manufacturing, assembly, etc. He said there are a number of retail type businesses that don't quite fit the current description. Brixius thinks the manufacturing district should be modified to allow retail and service type businesses. He said what he envisions is a C1 district where it would be allowed. He said there are concerns about parking, businesses that are interior to the building. During the development of Lakeview Lofts, Brixius said there was an indication from the building owner that there may be some future plans with the parking lot. Brixius said he doesn't recommend change existing uses but to add permitted uses if it meets certain conditions. He said in the past the city has been unaware of businesses going in the building when a sign application comes before the planning commission. Hoffman wondered about when a building permit is applied for if parking conditions can be examined. Brixius said he wants an assurance from the building owner that the parking is attached to the building. Brixius thinks there needs to be clarity. Hoffman is concerned about reviewing parking when a sign application comes forward that it's too late. Leases have been signed and build outs have been commenced. Brixius said this is more just • asking the PC if they are interested in tightening this up. Mason asked if this could even go to something such as a grocery store. Brixius said it's pretty broad now. Struck wonders about a grocery store or a high volume store due to traffic • and parking concerns. Brixius thinks things should be explored with an open mind as to what could go in the building. Mason said he agrees to trying to dedicate future parking. Tempero wonders about the current signage and how new signs fit in. Brixius said typically they ask the landlord about uniform sign appearance, placement, size. He said no more than 20% of the building can be covered with signage but sometimes there are internal businesses so there is detail review needed. He said he wants a comprehensive sign plan for this building because the larger industrial spaces could get divided up. b. All In 1 Fitness Sign Application — Brixius said there was an application for a sign located at 4150 Shoreline Drive. He said this area is zoned manufacturing. Brixius said there were concerns as the sign placement is over an entrance door. He said they were unclear as to where the tenant space was located. Brixius said the building inspector was contacted and there was a concern about a change of use due to an assembly type use. He said there could be some question about occupancy and there will be a code review performed. He said with resolving that, they feel comfortable moving forward. Brixius said this business is next to Katie Lein Dance Studio. Brixius said a condition for the sign and the installation must accompany a sign off by the building inspector. Mason asked if it was an assembly business. Brixius clarified that it has to do with people assembling in groups. He said the business use qualifies but the concern is large group of people and additional fire protection might be necessary. Hoffman said it has to do with number of exits and ventilation. Brixius said the building inspector is working with the architect. The sign designer said this has been approved for occupancy. Hoffman said he'll accept a motion for approval. Hoffman said it depends upon the use such as a restaurant. Tolsma said the main point of this amendment is to address the permitted uses. It's really a loosening of the language. Hoffman thinks a list of questions to propose to Brixius might be in order. • How do we enforce adequate parking? Mason said there is delivery of items going on now and previous to Tonka Ventures there was a lot of parking. Mason thinks an evaluation of parking spaces needs to be done. • Bren wonders if Tonka Ventures needs to be updated on what is allowed as far as businesses use. • Struck said part of the issue is the city doesn't know what's in there. She wonders if something could be built in to say a multi-tenant use, there should be a notice. • Tempero thinks the city should know who is in the space. • Hoffman said insurance companies want to know what they are insuring so they should be compliant with the city. • Bren asked about the building inspector and if they have a right to access the building. • Struck wonders if there is a legal way to get a valid of list of who is in a building. Struck thinks a city has an obligation to know what is going on in our city. • Bren wonders about businesses such as growing medical marijuana and what would happen if a city was opposed to this. Tolsma said an argument can be if something isn't listed as a permitted use, it can be disallowed. Struck said she thinks about the water issue and she would think the city should know what is taking place. Hoffman wonders about talking about business licensing and how to start that conversation. Tolsma said it could be part of the recommendation in updating the ordinance. Hoffman thinks the fire marshal should be inspecting at least once a year. Struck also wonders about business licensing and what would change with the business owner of Tonka Ventures. Hoffman said if there were objectives surrounded around safety issues, it will make it easier to accept. Kaczanowski wants to think that there are safety considerations to other tenants in a building. He wouldn't want to be a tenant knowing there was a hazardous material operation going on. Struck wonders about other districts. She said general commercial districts aren't regulated and she mentions the previous Tonka Auto and Marine where it was discovered they were putting something down the drain that wasn't supposed to be going down. Hoffman wonders about other cities in the area and whether they have business licensing. Tolsma said it could be framed that the business licensing is free unless it's after the fact they are fined by administrative fine. Mason agrees with Struck that it is important to monitor and protect the water supply considering what's happened. Hoffman and Struck are in favor of a charge for a license. Council Work Session September 22, 2014 — Tempero said regarding turning Wilkes Park into a community garden. He thinks if the park was cleaned up and made nicer, it would be used more. Kaczanowski wondered about Thor Thompson baseball field and if that is actually rented out. Tolsma said no but there is a negotiation about the lawn mower and other tools with the Little League. Bren said since the tennis court is being used for pickle ball courts, perhaps a picnic table could be set there for the participants as they have white plastic chairs there now. CALL TO ORDER — Hoffman called the meeting to order at 7 p.m. 2. PLEDGE OF ALLEGIANCE 3. ROLL CALL — Mason, Struck, Hoffman, Kaczanowski, Ex officio Bren. Tempero absent. 4. ADOPT AGENDA — Mason makes a motion and Kaczanowski seconds to adopt the agenda. All votes ayes, motion carries. 5. APPROVAL OF MINUTES a. Planning Commission Meeting Minutes from October 8, 2014 — Mason makes a motion and Kaczanowski seconds to approve the minutes. All votes ayes, motion carries. 6. CONSIDERATION/DISCUSSION ITEMS • a. Manufacturing District Uses Draft Ordinance & Business Licensing Discussion Brixius said he looked over the list of questions submitted by the Planning Commission. He said there is a need to legitimize things that are already being done. He said the concern is that the sites are zoned for manufacturing and parking is geared as such. He said if there was retail there would be higher parking demands. Brixius said Buttenhoff owns three parcels and one is exclusively for parking. He said nothing would prohibit development. He said if there is a trend towards retail, it would be important to have parking availability secured. Brixius said the Comp Plan identifies the Tonka Ventures building becoming obsolete. He predicts this area as potential commercial, mixed use, similar to the Lakeview and Mist Lofts. Brixius attached aerial photos to his report showing parking spaces for the site. Hoffman asked if that included the surface lot. Brixius said the 67 spaces is the surface lot. Brixius estimates Spring Street and Shoreline Drive as having 32 spaces. An estimated generation for predominately warehousing and manufacturing of 230 for 1,2 and 3 buildings. He said there have been some parking issues on the west end with the truck bay and employee parking for Napa Auto. Brixius said originally it was specifically asked of Buttenhoff if the parking was sufficient for their needs and they said it was. However, they came forward last year and said it wasn't. Brixius said there are enforcement measures because of parking requirements. however this has been ineffective as it doesn't come forward until it's an issue. Brixius said New Hope has developed a policy called BUCO (Business Use Certificate of Occupancy) requiring building inspections after a fire. Brixius said the city should clarify with Mnspect what type of • inspections would be required and how to budget for additional costs. Brixius said this potential change should be sent to the major business owners to inform them of the upcoming change and public hearing. Mason wonders why Buttenhoff doesn't like to reveal what is in his building. Brixius said he doesn't think it's so much that as the fact that's always the way it's been done. Kaczanowski wonders if this applies to all businesses or just the manufacturing. He wonders if this will apply to every business including existing and Brixius said present businesses will be okay but will have to comply with future changes. Struck wonders about it not being retroactive. Brixius said when there is a new business changeover it gives the opportunity to conduct inspections. He said inspections of housing requires annual inspections but he's not sure about this. Struck thinks without looking at existing occupants, the process will be very slow to clear. Brixius said there is a reliance on building inspections according to the building permit and building code and fire code at the time. Kaczanowski wonders about building inspections and fire inspections. Brixius said one of the anticipated changes in the 2015 building code is residential square footage exceeding a certain limit, sprinklers must be in place. Mason wonders about the difference in the term assembly between the former Snap Fitness and the Dance Studio. Hoffman said insurance companies are starting to require annual inspections for safety. Brixius said the dance studio wasn't going to have an exterior door where Snap Fitness did. Hoffman is in favor of checking on inspection costs and thinks it should be fee based. Brixius said these would be some numbers that would have to come from Mnspect. Hoffman said he would like to assemble a list of businesses. Hoffman agrees it is important to notify businesses of the potential change to the ordinance. Brixius said . regarding timing, he thinks it would be good to bring this back in February in order to cover everything. Mason wonders about business licensing and phasing it. Brixius said it would apply to change of ownership, new leases and perhaps new owners. Brixius suggests this be discussed at a staff meeting and ask Mnspect's guidance or suggestions. Struck wonders about a new lease and maybe renewed leases. Struck likes renewed lease to be a part of this. Kaczanowski wonders if this can be softened by saying this might be beneficial from an insurance standpoint. Perhaps insurance rates could go down if they've proved they are compliant with inspections. Hoffman said their basic duties are health, safety and welfare and this follows this. Struck also wants to remind the fact that environmental concerns regarding water contamination and hazard materials need to be known. Hoffman likes the BUCO term versus licensing. He said BUCO is a certificate of occupancy and he likes that it is a one-time fee. Mason said when looking at businesses that have petroleum products, they are required to be inspected for safe practices and he feels this is the same thing. Hoffman wonders if the changes in zoning and the business inspections should be separate. Tolsma said he thinks they should be separate as they are two different things. Hoffman wonders about having the public hearing for the zoning change in January and the business change in February. Tolsma said there is a new council starting in January so there is going to . be a little learning involved. He thinks the BUCO should definitely be in February or March with an effective date in April or May. Bren wonders about Gentle Dentistry. Tolsma said staff suggested a picnic shelter in the park. He said the candidate is apparently artistic and they are hoping several options can be presented and they can 40 pick. Brixius said Eagle projects are to benefit the community and show leadership. He suggests the city think about what they would like. He said the projects are always well done. Mason suggests at Thor Thompson Park on the south side by Jackie Stone's house, there is a suggestion for a memorial bench or garden in her memory. He said ideas have been a bench, a stone or a plaque in her memory. Brixius said a paver path or butterfly garden would be a nice idea. Struck asked if there was water at the park and Mason said there is a drinking fountain. She wondered about a dog watering spot that relates to Jackie's love of dogs. Mason said there are funds available for this from friends of Jackie. Mason said he would be willing to follow through on funding sources. 9.
