Planning Commission Meeting Minutes from December 10, 2014 — Struck makes a motion and Mason seconds to approve the minutes. All votes ayes, motion carries. 6. CONSIDERATION/DISCUSSION ITEMS Manufacturing District Uses Ordinance - Brixius states that numerous commercial and retail sites have been added over the years in manufacturing zones, which is not expressly permitted under • the current city code, which is the same as being prohibited. Brixius notes that the site is currently under transition and it is expected that the area will continue to have more commercial/retail sites in the future. Brixius says that this proposed amendment would make the commercial/retail uses legal in the M district with three conditions. 1 — The business must be contained completely within the building with no outside storage. 2 — There must be adequate parking available per the city code. 3 —Wall signs will only be allowed for tenants that have an exterior wall and a designated entrance/exit on the building exterior. Kaczanowski wonders if the M district may need to be rezoned in the future if more commercial/retail activities are taking place in it. Brixius says that the zone will most likely stay M as long as some type of manufacturing activity is occurring in the zone. Struck asks if this ordinance amendment will address any of the concerns about potential hazardous materials being stored, or if that will be addressed in the future with a Business Use Certificate of Occupancy (BUCO), or something similar. Brixius states that the BUCO would be the appropriate mechanism to address those concerns and to learn when a new tenant has moved in. Kaczanowski asks if the fire chief has been involved in any of the discussion yet about a BUCO. Brixius says that it has been discussed with the fire chief briefly at a recent staff meeting, and that he would have an active role in the future of developing a BUCO policy. Mason thinks that the fire chief should be at the future meeting when the BUCO will be discussed with potentially affected businesses. Brixius agrees. Kaczanowski also feels that the building official should be at that meeting as well. Brixius says that it is the most current version and that the council will be asked to vote on this exact language if recommended by the planning commission. Struck recommends that the first sentence of 4(c) be changed to read "Wall signs shall be allowed to only those tenants using both a tenant bay with an exterior wall and direct exterior entrance." Brixius agrees that the proposed change makes sense. Hoffman states that he feels this ordinance amendment is important as it simply legitimizes these uses that the city has already allowed. a. i. CONSIDERATION/DISCUSSION ITEMS Business Use Certificate of Occupancy Discussion — Brixius said the next step is to mail to all industrial and businesses in Spring Park and set a public hearing for April. Brixius said this will get added to Chapter 10 of the city code. He said Scott Qualle, the building inspector is likely to be the designated inspecting official. He said he doesn't think the number of applications will be arduous to the city. Brixius said the fee set should cover an hour of expense by the B.O. Brixius said the enforcement tool is no signs will be issued unless the city is aware of the business. He said the property owner and leasee will be responsible for this. Brixius said the application requires several criteria. He said a site plan may be required if there is a physical change but, if it is just a rental of a tenant bay, a site plan more than likely won't be required. Brixius said once an application is received, Qualle will be directed to do a site inspection and a building inspection to make sure the use is appropriate. He said each time a business changes, a new certificate will be necessary. Brixius said if there is failure to comply, revocation can happen and occupancy can be denied. Brixius said an administrative fine can also be a tool for enforcement purposes. Brixius said Appendix A is the fee schedule and that is being amended to show a $50 fee. He • said there isn't a lot of code language because it's dependent upon the building code. He said the intent is to keep the fee down. 4349 WARREN AVENUE, SPRING PARK, MINNESOTA 55384-9711 (952)471-9051 FAX(952)471-9160 2 3-11-15 • Kaczanowski asked what Qualle charges and Brixius said it's $50 an hour and, if the inspection goes beyond that, the city will pick up the remainder. Brixius said it's been proven it's necessary to keep the fees down in order to gain compliance. Kaczanowski wonders if an average walk through is about an hour. Brixius said in the city's case, most of the spaces are smaller scale and can be done in an hour. • Struck said she has some questions and asked if it is typical to get input from the community and Brixius said it's a public hearing and he thinks it's helpful to invite those who are affected. Struck wondered if the actual proposed ordinance change would be sent out with the letter and Brixius said yes. He said he thinks it's important for property owners to know what is being proposed. Struck said in section 10-203 both property owner and leasee shall be responsible and she wonders if this should be one or the other. Struck said in 10-204, item 4, it says 'size of use' and she wonders what that means. She thinks it might be clearer to say 'space'. Struck wonders what staff should expect in terms of a complete application. Struck also would like the site plan requirement made a little more clear. Struck wonders about the words "proposed sign plan" and she thinks it should be defined somewhere. Brixius said businesses typically know what they want and need for a sign plan. Struck said regarding storage and hazardous materials, she wonders if BUCO would address this. Brixius thinks this is part of the building code and would rely upon that. Brixius said he can tighten up this language. Kaczanowski said he wonders if the building inspector uses a checklist. Struck thinks storage or disposal of haz mat needs to be noted. • Mason asked if this is for new businesses only and Brixius agreed, it is not for existing businesses. Mason wonders if this will lead to a registry and Brixius said yes, it should • be easy to create a business registry as time goes on. Mason wonders if the fire department has contact information for businesses within the large warehouse buildings. Brixius said this can be made part of the application to identify two contact people. • Tempero wonders if this is just for businesses that occupy a facility rather than home occupations or the Boy Scouts and Brixius confirmed. Kaczanowski wonders who pays the $50 and Brixius said we don't care as long as the application fee is paid by someone. • Struck suggests perhaps a mention about recycling could be added. Kaczanowski said this is not for existing businesses and he wondered if this could be suggested to existing businesses as an incentive perhaps through reduced insurance costs. Hoffman said he is aware of several insurance companies that require inspections as part of their insurability so he thinks it's probably already being done. Brixius thinks there are ways of swaying existing businesses to be inspected but he thinks this is a step-by-step process. Hoffman wonders about start dates in section 10-205 and Brixius said he'll define this further. • Hoffman suggests a list of clear objectives be put together for the public hearing so commissioners can be informed. 7. MISCELLANEOUS — • Struck asked if anyone has noticed the activity on the building lots on the Orono side of Northern Avenue. She said there was a meeting in Orono because two of the proposed buildings have more than 50% of the basement exposed which counts as an actual story. Struck asked if anyone knows about the expansion of the HC public works facility. She said the public meetings are so long and the agenda is pages in length. She said it's difficult to get information. Struck said she was at the Dakota Junction in Mound and she said the manager was asking about getting a petition to keep the trail open during the winter. She said she thinks the trail could be used all winter long and it seems like a good idea considering the duration of our winters. Bren explained the council is concerned because Three Rivers puts the responsibility of damage on the city. Tolsma said SP has said they would be interested in keeping the trail open but only if everyone (other cities) is in on this. Mason said the trail is partially plowed during the winter by the Water Patrol and Tree Trust so, they must accept liability. Kaczanowski is concerned about ice on the trail so he would wonder more about grooming the trail. Tempero wonders about brushing it instead of plowing so it would prevent plow damage. • Kaczanowski wondered if there was any interest regarding a tour of the city, he thought it might be helpful to learn more about the city and what buildings are what. He said he wonders about properties that are torn up or not maintained. Tolsma agreed that anything that looks out of the ordinary, it is helpful for the city to know about it. • Tolsma said based upon the planning commission's previous suggestions, park equipment has been ordered. New picnic tables, trash receptacles, repairs for playground items. Mason wondered about the suggested picnic shelter where some could play music in the park. Bren said the League of MN Cities has a training session for council members and she said one of their focuses was how to get citizens involved more in the city. • Hoffman said he received a phone call from a resident asking about the trash cans at the park. Hoffman said he told them they are in the process of replacing them. Hoffman said another observation by his caller was that the receptacles are being used for garbage disposal by people driving by and they should be relocated so this doesn't happen. 9. Public Hearing Business Licensing Certificate Amendment - Memo from Brixius dated March 24, 2015 - Mailing list of businesses notified of potential amendment to ordinance - Draft Ordinance - Business Use Certificate Application - draft - Mound Fire Commercial Building Information Sheet Brixius said a letter was sent to commercial property owners along with draft copies of the ordinance and application. He said the goal is occupational fits for the zoning district. He said it is also a safety feature. Brixius said they are looking for identification of key holders and to make sure appropriate uses are within the buildings. Brixius said this has been attempted for a long time and usually the city finds out about new businesses when they apply for signage. Brixius said the city wants to know what the business is, who they are, what they do, do they have any haz mat materials. Brixius said some of the proposed ordinance language has been used from other cities. Brixius said this applies to new businesses from this point forward. He said it is specifically stated that sign and building permits will not be issued without the business certificate being approved. Brixius said he has spoken to the owners of the Yacht Club and because their building is mostly office building it's being modified somewhat to reflect an annual inspection and to be certified for the entire building. Brixius outlined the required information in the business certificate application. Brixius said the registration fee is being suggested to be $50 to cover the required inspections. Brixius said doubling fees is necessary • if occupancy has already taken place and the certificate has not been applied for. It is suggested that the inspections be performed by the building inspector and Mound Fire. Kaczanowski said the graduation of the timeline for fines has been suggested and he wonders how that will be established. Brixius said the thinking is $50 prior to occupancy and then graduated sums as the time goes on. Kaczanowski said he likes the idea of less painful increases with associated timing. Struck wonders if this is tied to the comp plan and Brixius said when addressing the manufacturing zone, the large Tonka Ventures building is identified in the comprehensive plan as redevelopment and it could become mixed use, housing, retail, etc. Brixius said with the comp plan they are looking for smooth transition for future businesses. Mason said he thought the reason for the process is to begin at the beginning. He wonders if this is happening too late. Brixius said they are trying to get this going before occupancy. He said once this is adopted, letters will be sent out to owners stating that cooperation of property owners is necessary. Kaczanowski wondered if there is a fire inspection required now and Mound Fire said there is not. Tempero asked about the covering of the costs for the building official and the fire department. Brixius said they based it on an hourly fee and one hour seemed like adequate time to perform the inspections. He said they want to make this affordable. He said there won't be a lot of these inspections as they start out. Qualle said it won't be necessary to do annual building inspections. John Dennis of the Yacht Club said it benefits both sides. He said one time a year the business occupancy can be supplied to make sure everything is compatible. He said they are very careful when they screen their tenants. He said all their spaces are office space. Dennis said they own several buildings in different communities. He said in Waconia they have a building and they do have an annual fire inspection. Qualle said dependent upon the zoning, they are categorized as low, medium, high risk. High risk requires more frequent inspections compared to low risk. Mound Fire said typically the building inspector walks through first and notes what is in place. Qualle said it's necessary to establish a business directory in order to know what businesses are in place and to be able to track new businesses that have started without a business certificate. Mason said some businesses don't have signs and may just have a name on a door and he wonders if they will be included in this process. Brixius said if it's just an address and a name on a door, they are permitted for service delivery. Mason said he wonders about those buildings that have an internal space and still may have chemicals or safety hazards. Brixius said the idea is to get this going and there is not a sure-fire way to make everyone comply but it's a start and gets access. Mason said it's important to get the property owners to enforce this or the city will never know what's inside some of the large buildings. Qualle said the fire inspection will prompt discovery of non compliance. Dennis agreed. He said when the fire department comes through, they find things. Mason is concerned about internal businesses that only have a name on a door and it doesn't prompt a business certificate. He thinks it's probable there will be some of those. Chair Hoffman closes the public hearing at 7:40 p.m. Hoffman said regarding adding additional language under 10-203, he said the wordage and/or can sometimes be misleading. Brixius said he will change it to or. Tempero thinks 'might' be the better word. Hoffman is concerned if the word 'and' is used, it would maybe require both owner and tenant apply. Struck wonders who would be the contact if there isn't a business certificate on file and Brixius said both the property owner and tenant. He wonders if they should be more specific. Kaczanowski suggests after seven days it goes to $75 and after 14 days it goes to $100. Struck wonders about after that and Brixius said beyond 30 days it goes to administrative fine process. Hoffman said he is looking for a motion recommending the business use certificate with Brixius's additional language per the April 8 memo be moved to the council for review. Tempero moves to approve and Struck seconds. b. He illustrates on the board where the home is located. Brixius explained this is a substandard lot and it doesn't meet the sideyard setbacks. Applicant is looking to expand the home by increasing a story and adding a garage. Brixius said a substandard building is allowed if it has water and sewer. He said an expansion of a legal non conforming lot is allowed without increasing the non conformity. He said the variance is regarding the addition proposed. Brixius said hardcover will be reduced by removal of some existing hardcover. He said the building height cannot exceed 37 feet and the site plan does not illustrate sidewalks or driveways. He said they cannot exceed 40% hardcover. Brixius said soil types sometimes don't work with so-called permeable pavers. Therefore, he is suggesting tabling this in order to get a revised site plan, show the driveway, construction details and stormwater management components. Brixius said the surrounding properties are in keeping and character with the proposed construction. He said the variance is intended to allow flexibility where undue hardship creates practical difficulty. He said it cannot impair adequate light or air and he doesn't think they can demonstrate that but the neighboring property has the same issue. Brixius said the suggestion is to jog the garage from the house in order to gain five feet setbacks. Brixius said the applicant's site plan has been discussed with the building inspector and there are restrictions with homes located close to neighboring property. He said where the home is closer than five feet, homes cannot have any openings. Three to five, window openings are allowed but they have to be fire protected windows. Brixius said this will add value to the neighboring properties and they see no detriment as far as values. Brixius said the Comprehensive Plan looks to avoid variances but it recognized there are non conforming properties in Spring Park and it is believe the proposed expansion will fit with the comprehensive plan. Brixius said the narrowness and the size of the lot and having a building on it already demonstrates practical difficulties. He said special circumstances are not economic but rather it's the physical nature of the existing structure. Brixius said past practice is to encourage investment in homes. Brixius said the recommendation is to table this for a month in order to present a better site plan. He said they will take public comments this evening but the applicant is wanting to know if they should move to the next step in terms of investment to explore this further. Hoffman opens the public hearing at 7:18 p.m. Willier said he is okay with the terms set out. Hoffman said the lot is 28 feet wide and the proposed addition is 16.5. He said with a five foot setback it would have a gain in square footage. Willier said he is getting used to the idea of offsetting the garage giving it better street appeal. • Hoffman is wondering about the angle of the house on the property line and Brixius is in favor of this for pedestrian circulation and the allowance of the fire safety in terms of window openings. • Willier said they were planning on removing hardcover and they currently have wood decking. He said they are now leaning towards the wood decking instead of permeable pavers in order to insure a permeable surface. • Brixius asked Willier if they have a contractor and he recommends a pre-con meeting to make sure everything is addressed. • Hoffman asked if the applicant was familiar with stormwater runoff and why there are hardcover restrictions. Willier said he is familiar with this. • Mason asked if this is going to be a primary residence and Willier said it is to be in the future but right now they have two teenagers. • Tempero said his concern is the hardcover and he likes the fact that they are willing to reduce present hardcover as it exists. • Hoffman said he is in favor of the project if requirements suggested by the planner can be met. • Mason agrees with Hoffman but would like to see the engineer and planner involved in order to come up with a good, workable plan. CONSIDERATION/DISCUSSION ITEMS — Brixius said the Willier's request for two sideyard variances is still open under public hearing. Brixius points to the illustration on the whiteboard. Brixius said the variance may be warranted if proper, required paperwork is submitted. Revised survey plans have been submitted. It was asked that a site plan be presented and to show the structure to comply more fully with the sideyard setbacks. He said they have staggered it 1.8 feet to make that accommodation. At five feet they meet fire requirements to allow fire compliance. Brixius said further fire compliance will be required at the building permit level. Impervious surface areas were addressed on the grading plan. Proposed driveway is illustrated and a wooden sidewalk is illustrated. He said the existing conditions are at 51% and proposed to 39% is shown. Brixius said the applicant's engineer has provided the elements to reduce the impervious surface and a system of swales to manage runoff. He said they will be examining the soils and soil replacement might be necessary. The city engineer has reviewed this plan and agrees this satisfies the requirement. Brixius said treated decks are allowed and not treated as impervious surface. Brixius said it must be a slatted deck and a suggestion for a composite material versus wood would be suggested. A deck of 80 square feet is being proposed. Lakeside decks are allowed but it cannot encroach more than 7.5 feet so they are suggesting moving the deck into compliance. Stairways and landings are allowed but landings cannot exceed 32 square feet. Brixius said the deck is not being approved. • Brixius said the applicant provided a conceptual elevation and concerns are roof eaves as they extend from the house. There is a concern where there is only two feet of setback, eaves and gutters cannot cross property lines. Brixius said the roof height is compliant. By achieving a five foot setback on the addition they would be allowed to place windows without additional fire protection. Stormwater management has been identified. Brixius said Identified Issues are the grading plan where the lot meets Sunset Drive the street is higher than the garage. A grading plan shows a dip in the driveway but it's only .3 of a foot below the garage. There is a concern when there are heavy storms and the city engineer recommends pouring the garage slab with a slope towards the driveway. At minimum garage floor is sloped away from the house, wood walkway is slatted, drainage patterns on this 28 foot wide lot has to be on site. Nothing can encroach onto other property lines without easements or written permission. Struck asks if they are going from under 800 square feet to over 2400 square feet. Willier said essentially, yes. Tempero wonders if the slight widening of the garage being requested changes the hardcover calculation and Brixius said they can make it work. Mason asked the sideyard setbacks are going to be five feet and he wonders what it is now. Brixius said right now it's 2.1 feet and it widens to about three feet. On the other side there is ten feet narrowing to 5.1 feet. Mason asked if the foundation will support a second story. Willier said their contractor has reviewed this and it will not presently handle the second story however they are going to sink pylons and pour a slab thereby eliminating the present crawl space. Mason wondered what the other neighbors have said and Willier said he hasn't heard of any complaints. Struck wonders if this is a complete demo, rebuild and Willier said it is not. Hoffman comments regarding the sidewalk on page two and suggesting materials. Hoffman said it's not in the ordinance that materials can be dictated. Brixius said in the recommendations he does not dictate material choices and realizes this is up to the applicant's . choice. Hoffman asked about hardcover calculations and there is going to be some demo of walls. He wonders if the city should require a demo plan that outlines the items being removed. Brixius thinks that is an excellent suggestion and should be made a part of the demolition to verify. Hoffman closes the public hearing at 7:28 p.m. Hoffman asks for further comments and questions. Kaczanowski said one of the nets was broken. He said he hasn't been over there lately so it might have been fixed. He wondered if the nets could be raised and lowered for the pickle ball players and he believes it might be nice to be able to do that. Tolsma said he will follow up with Goman about this. Tolsma said he assumes the net must have been fixed because we haven't heard any complaints. Kaczanowski wonders if pickle ball should be allowed. Tolsma said pickle ball has really caught on so the City has striped the court to accommodate the game. He said there haven't been any complaints from tennis players about pickle ball players or about the nets. He said there has been talk about building a standalone court for pickle ball. Bren confirmed there is wide use of the courts and Westonka Community Education prints in their brochure about the availability of the courts. Kaczanowski said his youngest son is here and Daniel Kaczanowski wondered if Frisbee golf could be incorporated into the space behind the tennis court area. Pete Kaczanowski said this could be done quite economically as the set up for the flags can just be done with dock posts. He said he would be willing to look into this if this is something the City would be interested in. Hoffman suggests a regulation course be looked into with the baskets at the poles. Kaczanowski also wondered about a soccer net and he knows when his kids were younger there was a shortage of fields for young soccer players. He feels Wilkes Park would be a good spot for some soccer nets. Hoffman thinks the budget should be looked at for some of these requests. Mason wondered if the fields would have to be striped and Kaz said it's not necessary at this time and maybe to weigh it depending upon the interest. Struck said parking has been brought up in the past for Wilkes Park. Kaczanowski said even one soccer net at Thor Thompson, back by the basketball court, would be nice and he knows it would be used. Boat Launch Dynamic Sign Proposal Discussion Brixius said a request was received from Hennepin County for a dynamic sign. He said there has been improvements to the boat launch and along with that a plan was developed involving a number of signs. Brixius said they're directional and educational and the proposed dynamic sign will be used for public service announcements, Amber Alerts and weather alerts. Brixius said the sign is 70 square feet and 15 feet in height. He said according to ordinance it does not require a permit but it must meet certain conditions. He said because this is zoned public, it restricts the size. He said an amendment will be needed to the ordinance but he suggests this move forward and the amendment take place next month. He said conditions are • It must be 50 feet from residential and this is satisfied • The sign will be angled with the queue arrangement presently in place • The County is only asking for one dynamic sign and they are required to go static-to- static • Next month a recommendation will also be brought forward to change the text faster • A requirement is a light sensor and a dimming switch and it should be held to that standard to reduce glare. Hoffman wonders how soon they want to proceed with this. Tolsma said the installation is scheduled for early to mid November. He said therefore the timeline should work. Kaczanowski asked if these are HC wide and the same size. He was told there are other signs similar to this elsewhere in the county and the possibility is there will be one at every launch. Tolsma also confirmed it is one sided. Brixius said no because this would be an amendment just to the public zoning district. Brixius said this is a public safety sign and so they are trying to work together on this. Tolsma said in the past there have been large digital signs acting as message boards displayed. Struck wonders about this being two sided. She thinks they're missing something here. Mason said he thinks the location should be closer to the Water Patrol building as it makes more sense and he wonders if this will dim down at night. Brixius said they are going to request it to respond to ambient light. Mason wonders about the fact that the closer one gets to the sign the more difficult it is to read. Brixius said technology is improving every day. Brixius said the LMCD, HC, HC Emergency Mgmt and the City will have an opportunity to display messages. He said the target population is boaters using the launch and will have the highest priority. Mason said the City has always wanted a community sign and this is the answer to that. Struck thinks it's more appropriate to direct the signage to its audience, that being boaters. She said she thinks it will be weird to see community messages on a sign that is directed to boaters. Brixius said the initial hope was this sign would be closer to Shoreline Drive but HC wants the sign closer to the launch. Kaczanowski asked who is paying for this and Tolsma said the majority is HC but the city is putting in $2500 as well as the LMCD. Hoffman thinks this sign is so large in order to catch traffic on the road. Hoffman asked if there has been a plan view received because he thinks the elevation is deceiving. He wonders how much of an angle is going to be towards the street. Brixius said • he will request this. Mason wonders if that has been established. Tolsma said the bid was written so there will be input allowed from the County and the City. Brixius thinks if the sign is positioned towards the ReMax building it will protect Lakeview Lofts and the Mist. Kaczanowski asked how it is powered and Brixius explained power will be run to the sign and the message will be computerized. Hoffman is looking for direction and Brixius said this was informational and next month will be the amendment change. Kaczanowski noticed the drawing it titled Spring Lake Park and should make sure it is corrected. Hoffman is looking for a motion. Park Improvements Discussion — Tolsma said there was previous direction to look at soccer nets and Frisbee golf baskets. He said he got some pricing and for the Frisbee golf baskets they're around $400 per basket. He said soccer goals on the top end are $1500 for aluminum goals but it's 2.5 inch thick and it won't bend if weight is applied. He thinks if there are only one or two soccer goals, he thinks the higher end is the way to go. Kaczanowski wonders about size and Tolsma said since this is geared more towards youth he would look towards recommendations for middle school age. Kaczanowski suggests to stay around K-3rd or 4t" grade size maximum because the goals get big. Tolsma thought about 6 feet tall to about 10 feet wide. Tolsma said it has to be moveable • and Kaczanowski said that's why a smaller one might be the better route. He said a ten foot wide net will take three people to move it. Mason wonders if they come with wheels. Kaczanowski said Thor Thompson park doesn't have an ideal spot for soccer that doesn't interfere with the baseball field. Mason thinks the soccer should be focused at Wilkes Park. Tolsma agrees because grass doesn't last long in front of soccer nets and Thor Thompson doesn't have the room to spare. Hoffman said he believes larger nets are better in terms of allowing a range of ages to play. Kaczanowski said he doesn't think they should be any larger than ten feet wide. Hoffman asked about budget. Tolsma said this will go on next year's budget because of the lateness of the year. Tolsma said he'll make an earmark on the budget under the parks fund that new equipment line item is spoken for. He will also give the council a heads-up on this. Hoffman said if there is funding for the goalie net they can wait for the Frisbee golf baskets. Tolsma said this depends upon how many baskets. Hoffman looked at it and thought three to start. Sign Ordinance Amendment Public Hearing — Brixius said last month the proposed dynamic sign for Spring Park boat launch was discussed that some amendments needed to be made to accommodate the sign size and duration of message scroll. Brixius said they are looking for an 8-15 second scroll change therefore they are suggesting an 8 second change in the 35 mph zone. Brixius said when the dynamic sign ordinance was first proposed several years ago there was a concerted effort to not allow a "Las Vegas Strip" of dynamic signs. He said there have been changes in technology and timed dimming is now an option. He said the size of the sign is also being proposed to change. Mason wonders if a sign's message was missed could it be brought up on someone's cell phone. Tolsma said the County indicates the message can be changed from a cell phone but he doesn't know about recalling it. Tempero wonders if the feed can be lead to the city's website and someone can access it that way. Tolsma said it's interesting and he will follow up on this. Brixius said the placement and the intention is geared towards boaters and not necessarily towards the common commuter. Mason wonders if the city wants a message would the city have to go through Hennepin County. Tolsma said the city would be involved in this and they would be able to change the message or go through HC to change the message. Hoffman asked about the square footage. He said the sign is a total of 70 square feet, not just the dynamic part and Brixius confirmed. Hoffman said this size change could affect future signs. Brixius said this is being changed in the public zoning district only so from that perspective the eligibility for this size and type of sign is limited to that zoning district. Hoffman wondered if notification was sent to surrounding property owners. Brixius said no because it • wasn't required. Hennepin County Equipment Grant Application Tolsma said he hasn't heard anything yet and doesn't expect to until December. He said if it's approved they would make the equipment purchase in January. Tolsma said the grant program is now split into three categories and he said the city would like to apply in the spring for a playground equipment grant. Hoffman asked about the soccer nets and he thought it was discussed for one net. Tolsma said the grant requires ordering two so he feels they both can be put to use. Tolsma said he was looking for input on the size of the goals and what has been requested is about the midrange sized. Struck said this sounds like the size that was previously discussed and agreed upon. 9.
