CALL TO ORDER - The meeting was called to order by Mayor Rockvam at 7:00 p.m. Council Members Jerome P. Rockvam, Mayor; Gary Hughes; Pamela Horton; and Catherine Present: Kane Palen Council Members Megan Pavot Absent: Staff Present: Dan Tolsma, City Administrator and Theresa Schyma, City Clerk. 2. PLEDGE OF ALLEGIANCE — Mayor Rockvam led the audience in the Pledge of Allegiance. 3. ADOPT AGENDA M/Hughes, S/Horton to adopt the agenda. Motion carried 4-0. 4. ADOPT CONSENT AGENDA a. County Commissioner Jan Calhson — Commissioner Calhson reported on the activities of the County Board and their legislative priorities and platform for 2017. b. Kandis Hanson Introduction & Summary of MNSPECT Services — Kandis Hanson, Relationship Manager for MNSPECT Services, introduced herself, provided the annual report and comparison of 2015 & 2016, and provided a summary of MNSPECT services. Mayor Rockvam stated that, from his observations, contracting for building inspections services has been working well for a city the size of Spring Park. 7. PUBLIC HEARINGS - None. 8. Mayor & Council — Council Member Hughes provided an update from the most recent Lake Minnetonka Conservation District (LMCD) meeting. He stated the LMCD is in the process of re - codifying the LMCD Code. Mayor Rockvam requested for City staff to take a look at the load limit signs that are posted on Northern Avenue as they appear to be mismarked. Furthermore, he would like a four -ton limit sign posted on West Arm Drive and stated that if there is a charge for that sign since it is a private road that the Homeowner's Association would pay for it. City Administrator Tolsma responded that staff would take care of those signs. Council Member Hughes asked about what is done with vehicles that do not comply with the load limits. City Administrator Tolsma responded that Orono Police investigates any potential infractions and will weigh any vehicles they believe are over the limit. He stated that residents who believe they are witnessing a violation of the load limit restrictions should contact Spring Park City Hall or the Orono Police department. b. City Staff — City Administrator Tolsma reported that the annual audit is currently being conducted and the auditor will present his report in April. c. Contract Staff — None. 11. PeopleService January Report -Council Member Kane Palen asked about the status of the City's wells. City Administrator Tolsma responded that there was a fairly comprehensive rebuild of Well #2 in 2012 but in the next five years the City will have to take a closer look at the condition and maintenance of all wells. He added that some helpful information will be provided in the upcoming asset management report. Council Member Kane Palen requested a tour of all City facilities. BACKGROUND: Spring Park Garbage Hauler licenses expire March 31, 2017. All six of the currently licensed garbage haulers in the City were sent renewal information in February 2017. Those garbage haulers are: Aspen Waste, Blackowiak Disposal, Empty Can Sanitation, Republic Services, Waste Management, and Randy's Sanitation (commercial only). 2. DISCUSSION: Prior to the March 9, 2017 deadline, City staff received the required application materials for the renewal of the 2017 Garbage Hauler licenses for Aspen Waste, Blackowiak Disposal, Empty Can Sanitation, Republic Services, Waste Management, and Randy's Sanitation. All applicants have returned the following required materials for issuance of a license: • Complete & signed Garbage Hauler license renewal application • Copy of Certificate of Liability Insurance • Performance bond • List of motor vehicle information for all trucks operating in Spring Park • All required license fees In addition, all garbage haulers were made aware of the City's noise ordinance and road restrictions and also that there will be no exemptions granted to garbage trucks for either of these issues. To ensure that there is no interruption in garbage hauling service for the residents of Spring Park, the City Council is encouraged take action at tonight's meeting. 3. FINANCIAL CONSIDERATIONS: All required licensing fees have been received. 4. Applicant Signature W =� Printed name Date 4 CONDITIONS TO 2017 MUSIC CONCERT PERMIT - LORD FLETCHER'S 1) Outdoor music concerts will be permitted on Saturdays, Sundays and Holidays from 3-7 p.m. and Thursdays and Fridays 6-9 p.m. only. 2) Lord Fletcher's may hold outdoor music concerts during a period commencing no earlier than May 27, 2017 and ending no later than September 4, 2017. 3) Lord Fletcher's will comply with all applicable laws, ordinances, and codes and will continuously monitor its property and surrounding streets, lakeshore and docks to ensure compliance. This specifically includes, but is not limited to and compliance with, serving of alcohol, posted occupancy loads, proper designated unobstructed exits, all fire safety and emergency evacuation requirements, noise requirements, and Hennepin County Sheriff's Water Patrol requirements. 4) Live music played by a band or DJ within the building shall not be amplified outside through the use of speakers. 5) Lord Fletcher's will employ at its expense identifiable security staff and off -duty police personnel to sufficient to insure its compliance with item 3. 6) If Orono Police requests music be stopped because of complaints or violations of permit conditions or City ordinances, Lord Fletcher's will immediately and willingly comply with the request and will not resume the music that day. 7) Lord Fletcher's will make every reasonable effort to ensure that its music concerts and DJ amplification does not exceed the state guidelines for noise as defined in Minnesota Rules 7030, as well as the following db limits for sustained periods of time (defined as: one continuous exceedance for a duration of more than ten seconds, or five or more individual exceedances in any one minute period) at the soundboard (85), or any nearby residence (65). Sustained db levels above and beyond the db limit at any of the three locations shall be deemed as non- compliance with this section. The City Council reserves the right to modify the db limits at any time throughout the duration of this permit. 8) Lord Fletcher's agrees to have a qualified sound technician on the premises at all times amplified music is being played outside. The sound technician shall possess the proper knowledge and equipment capabilities to effectively control volume levels. The sound technician shall also exercise authority over the volume controls of performers if they fail to comply with requests to decrease their own volume levels. 9) Lord Fletcher's will deposit with the City $1,000 to be placed in a non -interest bearing escrow account. In the event the City incurs expenses related to monitoring or regulating noise levels or the performance of live music at Lord Fletcher's the City shall be reimbursed from the escrow account. Any unused funds remaining in the escrow account after the final performance of the year shall be repaid to Lord Fletcher's within 30 days of the final performance of the year. 10) Lord Fletcher's will provide the City in advance with a list of all scheduled music concert events. 11) Refrigeration equipment/trucks shall be located on the property so as not to interfere with the peace and quiet of adjacent properties. 12) Lord Fletcher's will reposition the directional speakers and drum shield in a manner designed to mitigate noise escapement. 13) Lord Fletcher's will place a sound barrier fence west of the stage. 14) Lord Fletcher's agrees that the city will periodically monitor the noise levels at the property line. Should those results indicate excessive noise levels on more than one occasion or, if the Orono Police request that the music be stopped five or more times during the permit period, the City will have the right to revoke the permit — after a formal hearing at a regular or special Council meeting. 15) Lord Fletcher's will educate its employees regarding appropriate methods for responding to complaint calls and procedures for forwarding complaints to management. 16) Lord Fletcher's will hold semi-annual meetings with neighborhood residents from both Spring Park and Orono to provide a forum for the discussion of possible concerns regarding its music concerts. Kimley»>Horn MEMORANDUM To: Mr. Dan Tolsma, City Administrator City of Spring Park 4349 Warren Avenue Spring Park, MN 55384 From: John Crawford, P.E., PTOE Kimley-Horn and Associates, Inc. Date: September 14th, 2015 Subject: Lord Fletchers Noise Compliance Study Kimley-Horn and Associates conducted a noise study around Lord Fletchers restaurant on Saturday September 5ch 2015. The purpose was to determine if the noise levels conform to the conditions of the 2015 music concert permit for Lord Fletchers. A total of three distinct site locations were measured with one site containing two measurement points. All noise measurements were conducted following the MPCA and MnDOT Noise policy guidelines. An approved and calibrated Larson Davis LXT sound meter was used to conduct the noise measurements. Each site was measured for a minimum of 7.5 minutes with the majority of the measurements taken for 15 minutes. For each measurement taken, the Leq was watched to determine if the instantaneous Leq ever exceeded the 65 dBA limit set forth by the city of Spring Park. If the instantaneous Leq exceeded the 65 dBA threshold the level was noted and recorded. At each location the "background" noise was measured. Background noise was determined to be the hourly Leq equivalent for each analysis period. Measurement Locations and Notes: 1875 Shadywood Road — Measurements were taken at two different locations at this property per the request of the homeowner. The first measurement was taken in the backyard approximately 20 feet from the lake shore from 4:30 to 4:45 PM. At this location the music could be heard but was dampened by the large amount of Cattails between the measurement site and Lord Fletchers. The 65 dBA limit was exceeded 2 times during the 15 minute measurement period. The first was 68.3 dBA and correlated to the drummer. The duration was approximately two seconds, well below the permitted duration of ten seconds. The second was 70.8 dBA and this was correlated to a passing motorcycle. The overall Leq for the measurement was determined to be 56.4 dBA. Based on the 65 dBA threshold being exceeded only twice during the 15 minute measurement, Lord Fletchers is within the permitted noise limits at this location. Also based on the 15 minute Leq they are also within the MPCA standards for a residential area. The second measurement taken at this site was located on the homeowner's back deck. The meter was placed approximately 10 feet from the house. A 7.5 minute measurement was conducted between 4:47 and 4:54 and determined that the 65 dBA threshold was only exceeded once at 65.6 dBA. This was correlated to a shout at the end of a song 2550 University Avenue West, Suite 238N, St. Paul, MN 55114 Kimley>>> Horn Page 2 by the lead singer. The overall Leq for the measurement was 56.1 dBA. A third measurement was conducted at this site as well between 6:22 and 6:37 PM on the homeowner's back deck. The 65 dBA level was exceeded twice during the 15 minute measurement at levels of 66.3 dBA and 66.4 dBA. Both were correlated to the lead singer shouting at the end of a song. The overall Leq was 56.8 for the 15 minute period. Based on all three measurement at this location it can be determined that Lord Fletchers is within the permitted noise levels for outdoor live music. Overflow Parking Lot — One noise measurement was conducted between 5:07 and 5:22 PM in Lord Fletchers overflow parking lot. The music could not be heard from this location. The background noise was mainly traffic noise from the adjacent streets and any noise spikes were correlated to cheering or yelling on the volleyball courts. The overall Leq for this measurement was 60.3 dBA, with no exceedances of 65 dBA. Based on this measurement Lord Fletchers is within the permitted noise levels. 1910 Shadywood Road — One noise measurement was taken at this location between 5:36 and 5:51 PM. The music could be heard but the line of sight was blocked by the roadway and the music was overpowered by the adjacent street traffic. All noise spikes were due to passing traffic. The band sound level varied between 55 and 60 dBA for the entire measurement. The overall Leq for the 15 minute period was 66.9 dBA. The Leq at this location is louder than the noise from the band due to the adjacent street traffic. Based on this measurement Lord Fletchers is within the permitted noise levels. Noise Conclusions and Suggestions: Based on the measurements taken and the noise levels that were observed, Lord Fletchers is not violating any part of the permit set forth by the city of Spring Park, MN. It must be noted that local residents stated the Saturday September 5th, 2015 was an average day for the noise levels. Two local residences made comments that the nighttime disc jockey music seems to be louder than the live music on occasion. I obtained noise sample measurements off -site at points closest to surrounding neighbors as well as in the south parking lot adjacent to the outdoor bar where the music was playing. I took samples from approximately 3:50 pm to 5:10 pm. Please note my sampling descriptions as it is important to differentiate between on -going quieter "background taped music" versus live "band music". Testing Equipment: The noise monitoring equipment I used was a Quest Technologies, Type I Sound Level Monitor with wind screen, and 1 calibrated the sound level monitor about an hour prior to the testing period with a Quest Technologies, Acoustic Calibrator, Model QC-10/QC-20. Overall, I would have to say they were noticeable but not objectionable or unduly loud. By comparison, I certainly noted the loud motorcycles driving by on the public street or the loud yelling from the patrons playing in the closer volleyball courts. The background music was insignificant before the band started and I wonder if anyone has complained about the air conditioning unit on the south side which to me was more objectionable. Comparing today's noise measurements to similar past noise sampling that I have conducted at approximately the same locations, I would say the volume on this day was conservative and under control, albeit still noticeable. My experience shows that aside of clearly loud & excessive volume, the next complaint is from an expectation that one does not have to listen to any noise from neighbors. If you were to compare these measurements to the MPCA noise regulations for a residential district with a maximum daytime limit of 65 decibels in a residential area, the highest off -site reading of 57.5 dBA (Overflow parking lot) was not in violation. On this particular date and time, the volume of the band playing at Lord Fletcher's outdoor bar was not in violation. rk you or the opportunity to provide assistance to you. This Plan will enable the City to proactively plan future infrastructure improvements based on the cost benefit of the improvements. This prioritization of spending will help reduce maintenance costs and risk of catastrophic system failures. We have reviewed all of the existing information that we have for developing an inventory and condition assessment of the City's infrastructure (sanitary sewer, water, storm sewer, streets, sidewalks, street lights and retaining walls). I have outlined an approach and associated cost for developing the inventory and condition assessment of the various infrastructure items. Inventory We will use a combination of record plans, existing CAD basemaps and GIS to determine utility lengths. The information will not be 100% geospatially accurate (located to within inches of the actual location) but it will be accurate enough to develop preliminary cost estimating in the plan. Condition Assessments Once a comprehensive inventory is completed, the next step is to determine the condition of the existing infrastructure assets. This process varies depending on the type of infrastructure so I have listed the individual assets below. Sanitary Sewer - condition assessment will include reviewing the most recent documentation (i.e. televise reports, maintenance records, etc.) for the sewer pipe, structures, and lift stations. A field review will be completed on the sanitary structures to determine condition. Water - condition assessment will be based on the installation date/age, material and history of maintenance issues. Storm Sewer - condition assessment will be based on installation date/age, material and history of maintenance issues. A field review will be completed on the storm structures to determine condition. Streets - we will use the existing condition assessment from 2014. City of Spring Park 2/4/17 Page 2 Sidewalk - we will complete a field review of existing sidewalk. Street Lights - I understand these are new so we will inventory but there's really no need to review condition. Retaining Walls - we will complete field review of existing walls. This is a fairly basic condition assessment using existing and readily available information. There are additional assessments that could be completed to provide a higher level of assessment information (televising the storm sewer, acoustic testing of the water main, flow metering to determine 1/1, etc.) but that level of testing costs a significant amount of money and can be pursued in the future as specific concerns are identified. Once the inventory and condition assessments are completed, we will develop maintenance/replacement costs for the infrastructure based on the inventory and recommended improvements. We will also develop a phased improvements plan based on a combination of existing conditions, costs, and geographic location so the City can plan specific projects going forward. We propose to complete the work outlined above on an hourly basis for a not to exceed cost of $60,000. This Asset Management Plan will not eliminate the possibility of future infrastructure failures but it will allow the City to make educated decisions and spend infrastructure dollars in the most cost effective areas first. The Mound Fire call -out volume was quite high in 2016, so a slower emergency call -out month is a just fine! During the month of February, our call volume was lower than we experience in a typical month. This is good news for our residents, as fewer individuals needed emergency assistance! The unseasonably warm temperatures in February caused thin ice on Lake Minnetonka. The Fire Department responded to a few calls of possible vehicles through the ice. Fortunately, no one was hurt in any of the water incidents we responded to. The Mound Volunteer Fire Department was officially established in 1923 as an independent corporation. In 2008, the Mound Fire Department un-incorporated and became a Municipal Fire Department and a department of the City of Mound. Today, the Mound Fire Department operates out of the state of the art Public Safety Building which was constructed in 2004. The Public Safety Facility houses the Mound Fire Department, Mound City Hall and a precinct for the Orono Police Department. This facility features all the amenities necessary for essential day- to-day operations including administrative office space, modern information technology capabilities, apparatus bays, training rooms, a commercial kitchen, and a backup generator for emergency power. The Mound Fire Department staff consists of 37 volunteer firefighters, a full-time Fire Chief and one full-time administrative assistant. The department serves the City of Mound, Minnetrista, Spring Park, Minnetonka Beach, and Shorewood for a total service area of over 20 square miles. The department responds to an average of 560 emergency calls each year. The Mound firefighters work 16,000 + hours per year providing a wide variety of emergency response services, attending training, providing public safety programs, fire inspection, and fire code enforcement. The Mound Fire Department continues to be a respected leader in the fire and rescue service. During "open book" meetings, the valuation and classification issues are handled by the assessor's staff on a one-on-one basis with the property owner. Typically, open book meetings are held by the county assessor's staff. However, larger cities with an appointed city assessor may hold their own open book meetings. The open book meetings are held in locations that are convenient for property owners. Often open book meetings are held over several days during both day and evening hours. This allows property owners to appeal when it best suits their schedules instead of having to rearrange their schedules to attend a local board meeting held at one place and time. The open book meetings provide a forum for property owners to meet with assessment staff on an informal basis to review information about their property and to ask questions about the assessment. This setting allows the assessor's office to resolve questions and reduce the number of property owners who feel the need to appeal to the County Board of Appeal and Equalization. Property owners do not need to make an appointment to meet with the assessment staff. They can simply show up at the dates and times stated on the Notice of Valuation and Classification, and an appraiser will discuss their assessment. Depending on the jurisdiction, the appraisers may have laptop computers to access information about the taxpayer's property. Some counties may be able to link directly to their computer -assisted mass appraisal (CAMA) system which allows the appraiser to obtain data on sales of comparable properties. When reviewing the details of the property with the owner, the appraiser can verify the accuracy of the county's data and correct any errors. The property owner can also schedule an appointment for the appraiser to view the property if needed. Benefits for the proaerty owner Property owners often find that the open book meeting is less intimidating than presenting their appeal to the Local Board of Appeal and Equalization. They often appreciate the fact that they can have their questions answered in a more private setting, and not have to be apprehensive about making a presentation in front of their friends and neighbors. In this one-on-one setting, property owners may spend as much time with the appraiser as they need. They can compare the value of their home with the values of similar homes owned by their neighbors. The process is very efficient because concerns and questions are often resolved immediately. Property owners can see that the appraiser collects the same information on all properties, reassuring them that the process is the same for everyone, and they have not been singled out for a value increase. Property owners who are not satisfied with the "open book" approach may appeal to the County Board of Appeal and Equalization and/or appeal to Tax Court. It is only a recommendation that the property owner attend the open book meeting to discuss concerns prior to the County Board of Appeal and Equalization. In a jurisdiction that does not have a Local Board of Appeal and Equalization, the property owner is not required to attend an open book meeting in order to appeal to the County Board of Appeal and Equalization. Benefits for the local board The benefit for the local board is that an open book meeting saves time for board members. It eliminates the need for the board to become familiar with and educated on the local real estate market. Board members will be able to spend this time concentrating on their other duties as town board or city council members. In addition, board members can avoid confrontational situations with constituents and will no longer be put into difficult situations by having to make decisions about the property values or classifications of property owned by friends and neighbors. Benefits for the count While the number of appeals made at the open book meeting may not be less than the number of appeals to the local board, the benefit for the county is that the open book process allows for immediate consideration of issues, and in many cases, appeals are resolved before the County Board of Appeal and Equalization. The process is efficient for the county because it can often consolidate several jurisdictions into one meeting (or a series of meetings) instead of holding at least one meeting in each jurisdiction. Property Tax Fact Sheet 14 Why doesn't the assessor's value reflect the sale price of my property? 1. There is a lag between the time of the assessment and when the sale takes place. An appraisal is an estimate of property value based on historical data at a set point in time — January 2 of each year — and the market can change dramatically by the time the property is sold. For example, consider a property valued at $180,000 as of January 2, 2007. This assessment is based on home sales that occurred between October 2005 and September 2006. However, the property may sell for $230,000 in August 2007. Does this mean the estimated value is incorrect? Not necessarily. It could signal an upturn in the housing market between September 2006 and August 2007, raising the sale price of the home. Just as buyers in rapidly accelerating markets may pay significantly more than the assessor's last valuation, they may also pay less in declining markets. A property valued by the assessor at $200,000 for the 2007 assessment may sell for $175,000 in August 2007. This lag time often results in a dramatic difference between actual sale prices and the estimated market values for the current year. 2. Properties can change over time. While values can fluctuate on an annual basis due to sales of similar properties, Minnesota law requires that properties only be inspected once every five years, unless new construction or demolition takes place. Between those inspections, properties may be improved without the owner obtaining a building permit — or they may deteriorate if neglected. These changes can be difficult for assessors, who may only see the exterior of the home, to consider in their annual evaluations. 3. There is no "correct" price for real estate — but rather a range of prices. The ultimate sale price of a particular property depends on its unique characteristics as well as the complex Property Tax Division — Mail Station 3340 — St. Paul, MN 55146-3340 www.taxes.state.mn.us motivations and preferences of the seller and potential buyers. If that weren't the case, Realtors and sellers would never have to reduce listing prices, offers from multiple buyers would all be identical, and professional appraisals would all arrive at the same value. In reality, list prices often misjudge the market, offers are negotiable and can vary widely, and appraised values may be disputed. 4. No two parcels of property are identical. Estimating the precise value of a property that is based on dozens, if not hundreds, of characteristics is very difficult. Even nearly identical properties (e.g. adjacent townhomes or condominiums) often sell for different amounts. 5. Real estate markets are highly localized and always changing. Sale prices of different types of properties can vary widely. Currently, farmland and recreational properties are rising in value and sales are strong, but residential sales are stable or slightly declining in several areas. Some neighborhoods are declining at a much faster rate than other areas, which may be stable or slightly increasing in value. 6. Fewer sales mean more challenges for assessors. In many markets and for many types of property, there are few sales of comparable properties. This can make accurate market assessments more difficult, but the assessor must still use his/her professional judgment and knowledge to estimate market values on an annual basis. This may mean looking at sales that take place outside the study time frame or in a neighboring city or township. 7. Not all sales are representative of the market. Some sales, such as foreclosures, sales between relatives, or sales where the seller or buyer are acting under undue duress are not considered open -market, arm's-length transactions and are not used in sales ratio studies, nor are they used as comparables in estimating the market values of similar properties.
