SPRING PARK REPORT OF SUSPECTED

Complaint Based Enforcement: The Spring Park City Council has adopted ordinances to preserve and protect the health,
safety, and welfare of our community. The pritnary goal is to obtain voluntary compliance by all Spring Park residents.
Because limits to city resources do not permit a comprehensive, city-wide inspection and enforcement program, the city
generally enforces its ordinances by responding to complaints regarding alleged violations of the ordinance provisions. City
staff is directed to investigate and initiate enforcement procedures as follows:
1. Upon any complaint alleging an imminent threat to public health, safety or welfare.
2. Upon a complaint by one or more residents or property owners in the immediate neighborhood of the alleged
ordinance violation. "Immediate neighborhood" includes:
o The area within 400 feet of the property where the violation is alleged to exist; or
o Property from which the alleged violation can be clearly seen; or
o Property that is primarily accessed by driving past the location of the alleged violation.
3. Upon observation of a suspected violation by city staff during the ordinary course of duties, as time permits.
In most cases, if a violation is found the property owner will be given a reasonable amount of time to resolve a violation. The
investigation and enforcement process take time and you may not see immediate results in response to a complaint. Thank

All hoophousing near docks in spring park
Description of the location of the problem (e.g. behind garage, back NE corner of lot, cross street, etc.):
There are many hoop houses throughout spring park near docks. there are too many to list.
Detailed description of the problem: (attach photos if necessary)
The city indicated multiple times that hoop housing would not be allowed in Spring Park. All of these stuctures fit
the definition of hoop housing in ordinance 22-06 section 18-181. All of these structures are within city limits as
shown on the city zoning map city limit border (attached). Lake Minnetonka Conservation District code
2-6.21 subd 2 a states that if a city is a more restrictive code than the city code should be followed. It also
appears the city does have jurisdiction over the area including docks since the city requites permits for non owner
usage as indicted in section 42-327 c of the city code. Since it was indicated that the city was going to be looking
for hoop housing even without citizen complaints I am astounded that these structures were allowed to be
installed and left up. I expect the city to take this nuisance complaint seriously and not think it shouldn't
enforce the hoop housing nuisances because this is a lake community and all of those hoop houses are for boats.
Nothing in the hoop housing statue excludes boat and or dock structures. I expect all owners of these hoop
house structures will be given 10 days notice to remove the hoop housing very soon (within a week) or it will be showing the city does
