and necessary change, the project designer(s), the building contractor(s) and the property owner(s) are ultimately
responsible for providing complete code compliance and maintaining minimum construction standards for the
safeguarding of life or limb, health, public welfare and property while constructing this project.
Approval is based on the correction of all noted deficiencies and compliance with all items listed below. Any changes from
these documents and/or additional information shall be submitted to the Department of Building Safety for code
compliance review and approval. Written response of approval must be on site prior to implementation of such changes.
The following information is related to the submitted plans/scope or as general information regarding code compliance.

Building Planning:
1. In combustible construction, fire -blocking shall be provided to cut off all concealed draft openings (both vertical and
horizontal) and to form an effective fire barrier between stories, and between a top story and the roof space. (MN
Rule 1309.R302.11)
2. In combustible construction where there is usable space both above and below the concealed space of a floor -
ceiling assembly, draft stopping shall be installed so that the area of the concealed space does not exceed 1,000
sq.ft. Draft stopping shall divide the concealed space into approximately equal areas. (MN Rule 1309.R302.12)
3. In dwelling units, where the lowest part of the opening of an operable window is located more than 72 inches
above the finished grade or surface below, the lowest part of the window opening shall be a minimum of 24 inches
above the finished floor of the room in which the window is located. Operable sections of windows shall not permit
openings that allow passage of a 4-inch diameter sphere where such openings are located within 24 inches of the
finished floor. (MN Rule 1309.R312.2.1)
i. Exceptions:
a. Windows with openings that will not allow a 4-inch-diameter sphere to pass through the opening
when the window is in its largest opened position.
b. Openings that are provided with window fall prevention devices that comply with ASTM F2090.
c. Windows that are provided with window opening control devices that comply with Section R312.2.2.
4. Smoke alarms shall be installed in the following locations: (MN Rule 1309.R314.3)
L In each sleeping room.
4. Outside each separate sleeping area within 21' of the bedroom doors.
iii. On each additional story of the dwelling, including basements and habitable attics but not including crawl
spaces and uninhabitable attics. In dwellings or dwelling units with split levels and without an intervening
door between the adjacent levels, a smoke alarm installed on the upper level shall suffice for the adjacent
lower level provided that the lower level is less than one full story below the upper level.
iv. Smoke alarms shall not be installed within 3' horizontally of a bathroom that contains a tub or shower unless
this requirement interferes with other required placements.
5. Smoke alarms shall be interconnected and hardwired. Combination alarms shall be listed in accordance with UL
217 and UL 2034. (MN Rule 1309.R314.1.1)
6. When required, Carbon Monoxide alarms shall be installed outside and not more than 10 feet from each separate
sleeping area or bedroom. Alarms shall be installed on each level containing sleeping areas or bedrooms. Alarms
shall also be installed inside each bedroom where a fuel -fired appliance is present in the bedroom or its attached
bathroom. (MN Rule 1309.R315.3)
7. Carbon Monoxide alarms shall be interconnected. Combination alarms shall be listed in accordance with UL 217
and UL 2034. (MN Rule 1309.R314.4)
8. Carbon Monoxide alarms shall receive their primary power from the building wiring where such wiring is serviced
from a commercial source, and where the power is interrupted, shall receive power from a battery. (MN Rule
1309. R315.6)
9. Buildings shall be provided with approved address identification. The address identification shall be legible and

placed in a position visible from the street or road fronting the property. These numbers shall contrast with their
background. Address numbers shall be Arabic numbers or alphabetical letters. Numbers shall not be spelled out.
Numbers shall be at least 4 inches high with a minimum stroke width of 1/2 inch. Where required by the fire code
official, address identification shall be provided in additional approved locations to facilitate emergency response.
Where access is by means of a private road and the building address cannot be viewed from the public way, a
monument, pole or other sign or means shall be used to identify the structure. Address identification shall be
maintained. (MN Rule 1309.R319.1)
Foundation:
1. Exterior foundation walls that retain earth and enclose below grade interior spaces, floors, and crawl spaces shall
be waterproofed. (MN Rule 1309.R406.2) The waterproofing shall extend from the top interior wall edge, across
the top of the wall, and down the exterior wall face to the top of the footing. If a full width, closed -cell material is
installed to create a seal between the sill plate and the top of the foundation wall, the installation is deemed to
meet the requirements for the top of the wall waterproofing. (MN Rule 1322.R402.1.1)
Roof -Ceiling:
1. Buildings with combustible ceiling or roof construction shall have an attic access opening to attic areas that exceed
30 square feet and have a vertical height of 30 inches or greater. The vertical height shall be measured from the
top of the ceiling framing members to the underside of the roof framing members. The rough -framed opening shall
not be less than 22 inches by 30 inches and shall be located in a hallway or other readily accessible location.
Where located in a wall the access shall not be less than 22" wide by 30" high. When the access is located in a
ceiling, minimum unobstructed headroom in the attic space shall be 30 inches at some point above the access
measured vertically from the bottom of ceiling framing members. (MN Rule 1309.R807.1)
2. A kick -out Flashing shall be installed where the lower portion of a sloped roof steps within the plane of an
intersecting wall cladding, in such a manner as to divert or kick out water away from the assembly. The kickout
flashing shall be a minimum of 2-1/2" long. (MN Rule 1309.R903.2.1)
MN Energy Code:
