Variance - 18-16 - Side Setback - Addition of Storage Shed - 2259 Lilac RoadCITY OF SPRING PARK COUNTY OF HENNEPIN STATE OF MINNESOTA RESOLUTION NO. 18-16 RESOLUTION APPROVING A VARIANCE FOR THE ADDITION OF A STORAGE SHED AT 2259 LILAC ROAD WITHIN THE CITY OF SPRING PARK WHEREAS, Jeff Hoffman has requested a variance for his property at 2259 Lilac Road to build a shed that would fall in his property's side setback; and WHEREAS, City Staff have reviewed submitted plans and prepared a planning report dated August 1st, 2018; and WHEREAS, the Spring Park Planning Commission met and held a public hearing on August 8th, 2018 to consider the variance request, the staff reports, and to take public testimony. WHEREAS, upon closing the public hearing, the Planning Commission recommended that the City Council approve the variance for 2259 Lilac Road subject to the conditions outlined in the August 1st, 2018 Planning Report as amended and based on the following variance findings -of -fact: • A shed is a permitted in residential districts and is a reasonable use of the property for any homeowner. • The location of a large commercial building immediately next to this residential property is a unique characteristic of the lot. • The property owner has gained permission from the adjoining commercial property owner to build the shed in the location. • The proposed location would minimize view of the shed from the street or neighboring residential properties. It would not be expected to have any impact upon surrounding homes property value, or the character of the neighborhood. • The shed will reduce the amount of outdoor storage at this site provide interior storage space. • The placement of the shed would protect and maintain existing trees on the property. • The shed would have little impact on air and light supply to the commercial building given its small size. The commercial building would have the greater impact. • The addition would in no way impact normal traffic flows. • Private reinvestment is a goal of the Comprehensive Plan. WHEREAS, the Spring Park City Council met on August 20t", 2018 to consider the variance application; and WHEREAS, the Spring Park City Council has received the aforementioned plans, staff review documents, and the Planning Commission recommendation, and agrees with the findings and recommendation of the Planning Commission. NOW, THERFORE, BE IT RESOLVED that the City Council of Spring Park, Minnesota hereby approves the variance for 2259 Lilac Road, subject to the following conditions: • The applicant is required to stake the south property line prior to building installation to avoid the placement of the shed encroaching on the neighboring commercial property. • The applicant shall locate a minimum of two feet from the property line.
