A RESOLUTION APPROVING A STREET SETBACK VARIANCE FOR
THE HOME LOCATED AT 2473 BLACK LAKE ROAD, IN THE R-1 SINGLE AND
TWO FAMILY RESIDENTIAL DISTRICT, WITHIN THE CITY OF SPRING PARK,
MINNESOTA
WHEREAS, Anne Marie Borne has submitted a complete application and plans
for a variance to allow her to expand her home within the required street setback in an
R-1, Single and Two Family Residential Zoning District; and
WHEREAS, the site is guided for low density single family land use and is zoned
R-1, Single and Two Family Residential District and the proposed variance is consistent
with the with the City's Comprehensive Plan and zoning; and
WHEREAS, the Spring Park Planning Commission held a public hearing and
reviewed the application at their December 12, 2012 meeting; and
• WHEREAS, upon Planning Commission review of the application information, the
NAC planning report dated December 6, 2012, and public testimony, the Planning
Commission made the following findings in favor of the requested variance:
The proposed addition will add value and utility to the home. The addition will
allow the property owner to continue to reside in her home. The continued
reinvestment in the single family home is a reasonable use of the property and is
consistent with the residential goals and policies of the Comprehensive Plan.
2. The site exhibits practical difficulties unique to the property including:
a. Unique lot configuration
b. Age of the home and its placement on the lot.
c. Second story primary building entrance.
3. The requested variance is not out of character with surrounding properties. Most
of the homes along Black Lake Road fail to meet the 30 foot street side setback.
4. The variance and building addition will not negatively impact adjoining properties.
5. The building addition is an improvement over existing conditions, with regards to
increasing the structural setback between the utility pole and the fire hydrant.
• WHEREAS, based on the variance findings, the Planning Commission then
recommended approval of the requested variance subject to the following conditions:
1. The applicant provide, with the building permit application and construction
drawings, an illustration of all excavation limits, depth of the excavation, and
proposed methods of protecting the water main, hydrant and utility pole during
excavation and building construction.
2. The excavation shall be inspected by the City to insure no damage occurs to the
hydrant or water main. Any damage to public utilities shall be corrected at the
expense of the applicant.
3. The applicant shall notify Xcel Energy of their schedule for excavation and
construction. The applicant shall comply with any conditions required of Xcel to
protect their utility pole.
4. The applicant shall provide a site plan that illustrates how the remaining area
between the building and street will be restored and landscaped. No landscaping
shall be places within the six foot hydrant setback that would obscure or block
access to the hydrant.
5. Upon completion of the addition the applicant have a gutter system installed on
the addition, and a drainage plan implemented in the yard, which directs
stormwater runoff from the building addition away from neighboring yards and
towards the lake side of the subject property.
• WHEREAS, the Spring Park City Council has reviewed and considered the
variance for the Borne home located at 2473 Black Lake Road in Spring Park and
agrees with the findings and recommendations of the Planning Commission and City
staff.
NOW, THEREFORE BE IF RESOLVED that the City Council of Spring Park,
Minnesota hereby approves the variance for expansion of a home within a reduced
street setback for the property at 2473 Black Lake Road in accordance with the plans
dated October 2012 and subject to the following conditions:
1. The applicant provide, with the building permit application and construction
drawings, an illustration of all excavation limits, depth of the excavation, and
proposed methods of protecting the water main, hydrant and utility pole during
excavation and building construction.
2. The excavation shall be inspected by the City to insure no damage occurs to the
hydrant or water main. Any damage to public utilities shall be corrected at the
