Resolution - 15-14 - Sideyard Setback Variance - 4018 Sunset• RESOLUTION NO. 15-14 CITY OF SPRING PARK HENNEPIN COUNTY, MINNESOTA A RESOLUTION APPROVING SIDE YARD SETBACK VARIANCES FOR A SINGLE FAMILY HOME EXPANSION LOCATED AT 4018 SUNSET DRIVE WITHIN THE CITY OF SPRING PARK, MINNESOTA WHEREAS, Mark and Heather Willier have applied for variances from the required R-1 District side yard setbacks (10 feet) for the expansion of their house located at 4018 Sunset Drive in Spring Park; and WHEREAS, the site is zoned R-1, Single and Two Family Residential District which requires a 10 foot side yard setback and the property owner has requested a reduced side yard setback of five feet; and WHEREAS, the application has been reviewed by the City Planner in reports dated June 4, 2015 and August 6, 2015, and reviewed by the City Engineer in a report dated July 30, 2015; and • WHEREAS, the Planning Commission has held the public hearing on June 10, 2015 and continued the public hearing to August 12, 2015 to consider the application and hear public testimony regarding the proposed variance request; and WHEREAS, upon Planning Commission review of the application materials, the NAC reports of June 4, 2015 and August 6, 2015 and public testimony, the Planning Commission recommended approval of the variance requests to reduce the side yard setbacks to allow a five foot side yard setback for the new house expansion based on the revised grading plan dated 7/24/15 and Gronberg and Associates letter of July 30, 2015, and with variance findings and site plan conditions outlined in the NAC report of August 6, 2015; and WHEREAS, the Spring Park City Council has reviewed the application materials, staff reports, and the Planning Commission recommendation and agrees with said recommendation of the Planning Commission; and NOW, THEREFORE, BE IT RESOLVED that the City Council of Spring Park approves variance requests to allow the home expansion at 4018 Sunset Drive to be located within five feet of the side lot lines based on plans dated 7/24/15 and Gronberg and Associates letter of July 30, 2015 based on the following findings and conditions: Variance Findings: • 0The requested variance provides for a reasonable use of the property. • The expanded house will not overburden public utilities or increase traffic congestion on public streets. • The proposed house expansion is in character with the development patterns of the adjoining lots and surrounding neighborhood. The house expansion is consistent with Spring Park's Comprehensive Plan and its goals and policies for residential land uses. The need for a variance is due to practical difficulties that are unique to the lot at 4018 Sunset Drive related to lot width and lot area. Conditions of Approval: All construction shall match the approved site and grading plan dated 7/24/15. Some adjustment may be allowed to widen the garage at the east end of the building provided the revised plan maintains a minimum of five feet of side yard setback on both sides of the building addition, and the total hard cover of the site does not exceed 40% of the total lot area. If this option is pursued, the property owners must submit a revised site plan illustrating the changes and verifying the setbacks and hard cover with the building permit. 2. The applicant slope the garage floor to drain towards the driveway. • 3. The sidewalk must be slotted to allow stormwater to pass through to the underlying drainage swales. Construction details for the sidewalk must be submitted to the City for building permit review. • 4. Building eaves and gutters shall not extend over property lines. 5. The proposed deck shown on the site plan is NOT approved. Alternative deck plans that meet the standards of Section 42-65(e) of the Spring Park Zoning Code must be provided if a deck is pursued. 6. The applicant shall implement the stormwater elements identified in the July 30, 2015 letter from Mark Gronberg. The applicant shall request inspection by the City once installation is complete. 7. All construction, grading, drainage, and site access shall be on the applicant's property. If any element of the site improvements encroaches onto adjoining properties, the applicant shall obtain appropriate easements. 8. The property owner submit a demolition plan that illustrates all hard cover that will be removed and any demolition of existing walls, structures, or hard surface. This plan will be submitted with the building permit to verify any items removed from site. E • ADOPTED by the City Council of the City of Spring Park this 17t" day of August 2015.
