RESOLUTION NO. 15-17
A RESOLUTION APPROVING A SIDE YARD SETBACK VARIANCE
FOR THE SPRING PARK WATER TREATMENT BUILDING
LOCATED AT 4333 WARREN AVENUE
WITHIN THE CITY OF SPRING PARK, MINNESOTA
WHEREAS, the Minnesota Pollution Control Agency and Minnesota Department
of Health are mandating that the City of Spring Park update its water treatment facility to
add equipment to remove TCE from the City's water supply; and
WHEREAS, the additional water treatment equipment will require the expansion
of the City's existing water treatment building located at 4333 Warren Avenue; and
WHEREAS, 4333 Warren Avenue is zoned P, Public/Semi-Public District which
allows public utility buildings but requires a side yard setback of 10 feet; and
WHEREAS, the expansion of the existing water treatment building brings the
new addition within four feet of the east lot line which does not meet City Code; and
WHEREAS, after evaluating several layouts, the City has determined to pursue a
side yard setback variance to allow the building to be set back four feet from the east
property line at 4333 Warren Avenue; and
WHEREAS, the Planning Commission has held the public hearing on September
9, 2015 to consider the application and hear public testimony regarding the proposed
variance request; and
WHEREAS, upon Planning Commission review of the application materials, the
City Administrator's report and public testimony, the Planning Commission
recommended that the City Council approve the variance to allow the expansion of the
water treatment building to be set back four feet from the east property line at 4333
Warren Avenue, based on the site plan dated 8/10/15 and building elevation plans
dated 6/30/15. Said recommendation is based on the findings laid out in the conclusion
of this resolution; and
WHEREAS, the Spring Park City Council has reviewed the application materials,
staff reports, and the Planning Commission recommendation and agrees with the
findings and said recommendation of the Planning Commission; and
NOW, THEREFORE, BE IT RESOLVED that the City Council of Spring Park
• approves the variance request to allow the water treatment building expansion at 4333
Warren Avenue to be located within four feet of the east side lot line based on the site
plan dated 8/10/15 and building elevation plans dated 6/30/15 and based on the
following findings:
• Variance Findings:
• The requested variance provides for a reasonable use of the property.
• The expanded building will not overburden public utilities or increase traffic
congestion on public streets.
• The building expansion is being mandated to add equipment to treat water so as
to protect the health and safety of Spring Park residents and businesses.
• The proposed building expansion is in character with the development patterns of
the adjoining lots and surrounding neighborhood.
• The building expansion is consistent with Spring Park's Comprehensive Plan and
its goals and policies for public/institutional land uses and the delivery of quality
public services.
• The need for a variance is due to practical difficulties that are unique to the lot at
4333 Warren Avenue related to lot width, lot area, location of the existing
building, the physical composition of the building layout, and water treatment
operations.
ADOPTED by the City Council of the City of Spring Park this 21" day of September
2015.
