1. Overhead garage doors shall meet the wind loading requirement of 115 Ultimate Wind Speed. Garage door
assemblies must be accompanied by the manufacturer's engineering drawing and installation instructions, on site,
for the building inspector to review. (Mn Rule 1309.R301.2.1)
2. In combustible construction,fire-blocking shall be provided to cut off all concealed draft openings(both vertical and
horizontal)and to form an effective fire barrier between stories, and between a top story and the roof space. (MN
Rule 1309.R302.11)
3. In combustible construction where there is usable space both above and below the concealed space of a floor-
ceiling assembly, draft stopping shall be installed so that the area of the concealed space does not exceed 1,000
ft2. Draft stopping shall divide the concealed space into approximately equal areas. (MN Rule 1309.R302.12)
4. Floor assemblies not required elsewhere in this code to be fire-resistance rated shall be provided with a ''/z"
gypsum wallboard membrane, ?"wood structural panel membrane, or equivalent on the underside of the floor
framing member. (MN Rule 1309.R302.13)
i. Exception:
a. Floor assemblies located directly over a space protected by an automatic sprinkler system in
accordance with Section P2904, NFPA 13D, or other approved equivalent sprinkler system.
b. Floor assemblies located directly over a crawl space not intended for storage or for the installation of
fuel-fired or electric-powered heating appliances.
c. Portions of floor assemblies shall be permitted to be unprotected where complying with the
following:
1. The aggregate area of the unprotected portions does not exceed 80 square feet per story.
2. Fire blocking, in accordance with Section R302.11.1, is installed along the unprotected
portion's perimeter to separate it from the rest of the floor assembly.
d. Wood floor assemblies using dimension lumber or structural composite lumber equal to or greater
than 2-inch by 10-inch nominal dimension, or other approved floor assemblies demonstrating
equivalent fire performance.
5. All interior stairways shall be provided with a means to illuminate the stairs, including the landings and treads.
Interior stairways shall be provided with an artificial light source located in the immediate vicinity of each landing of
the stairway.There shall be a light switch at each level when a stairway has six or more risers. (MN Rule
1309.R303.7)
L Exception:
a. A switch is not required where remote, central, or automatic control of lighting is provided.
6. A garage and its attic are required to be separated from the dwelling and its attic by not less than '/z"gypsum
fastened per table R702.3.5. If the dwelling extends above garage,the ceiling is to be protected with not less than
?"gypsum attached perpendicular to the ceiling framing per Table R302.6. (MN Rule 1309.R302).
7. Exterior stairways shall be provided with an artificial light source located in the immediate vicinity of the top landing
of the stairway. Exterior stairways providing access to a basement from the outdoor grade level shall be provided

8. There shall be a landing or floor on each side of each exterior door.The width of each landing shall not be less
than the door served. Every landing shall have a minimum dimension of 36 inches measured in the direction of
travel. Exterior landings shall be permitted to have a slope not to exceed '/ unit vertical in 12 units horizontal (2-
percent). (MN Rule 1309.R311.3)
9. The maximum riser height shall be 73/ inches.The riser shall be measured vertically between the leading edges of
the adjacent treads. The greatest riser height within any flight of stairs shall not exceed the smallest by more than
?inch. Open risers are permitted provided that the opening between treads on risers located more than 30"above
the floor do not permit the passage of a 4-inch-diameter sphere. (MN Rule 1309.R311.7.5.1)
10. The minimum tread depth shall be 10 inches.The tread depth shall be measured horizontally between the vertical
planes of the foremost projection of adjacent treads and at a right angle to the tread's leading edge. The greatest
tread depth within any flight of stairs shall not exceed the smallest by more than? inch. (MN Rule
1309.R311.7.5.2)
11. Handrails shall be provided on at least one side of each flight with four or more risers. Handrails to comply with MN
Rule 1309.R311.7.8.1 for mounting height,continuity, and grip-size. (MN Rule 1309.R311.7.8.1)
12. Buildings shall be provided with approved address identification.The address identification shall be legible and
placed in a position visible from the street or road fronting the property.These numbers shall contrast with their
background.Address numbers shall be Arabic numbers or alphabetical letters. Numbers shall not be spelled out.
Numbers shall be at least 4 inches high with a minimum stroke width of 1/2 inch.Where required by the fire code
official, address identification shall be provided in additional approved locations to facilitate emergency response.
Where access is by means of a private road and the building address cannot be viewed from the public way, a
monument, pole or other sign or means shall be used to identify the structure.Address identification shall be
maintained. (MN Rule 1309.R319.1)

1. Exterior foundation walls that retain earth and enclose below grade interior spaces,floors, and crawl spaces shall
be waterproofed. (MN Rule 1309.R406.2)The waterproofing shall extend from the top interior wall edge, across
the top of the wall, and down the exterior wall face to the top of the footing. If a full width, closed-cell material is
installed to create a seal between the sill plate and the top of the foundation wall, the installation is deemed to
meet the requirements for the top of the wall waterproofing. (MN Rule 1322.R402.1.1)

i. Notching.Any stud in an exterior wall or bearing partition shall be permitted to be cut or notched to a depth
not exceeding 25 percent of its width. Studs in nonbearing partitions shall be permitted to be notched to a
depth not to exceed 40 percent of a single stud width.
ii. Drilling.Any stud shall be permitted to be bored or drilled, provided that the diameter of the resulting hole is
not more than 60 percent of the stud width,the edge of the hole is not more than 5/8 inch to the edge of the
stud, and the hole is not located in the same section as a cut or notch. Studs located in exterior walls or
bearing partitions drilled over 40 percent and up to 60 percent shall be doubled with not more than two
successive doubled studs bored. See Figures R602.6(1)and R602.6(2). (MN Rule 1309.R602.6)
1. Approved corrosion-resistant flashing shall be applied shingle-fashion in such a manner as to prevent entry of
water into the wall cavity or penetration of water to the building structural framing components. Self-adhered
membranes used as flashing shall comply with AAMA 711.The flashing shall extend to the surface of the exterior
wall finish.Approved corrosion-resistant flashing shall be installed at all the following locations: (MN Rule

i. Exterior window and door openings. Flashing shall be installed at the head and sides of exterior window and
door openings and shall extend to the surface of the exterior wall finish or to the water-resistive barrier for
subsequent drainage. Flashing at exterior window and door openings shall be installed in accordance with
at least one of the following:
a. The fenestration manufacturer's installation and flashing instructions.When flashing is not addressed
in the fenestration manufacturer's instructions, it shall be installed in accordance with the flashing
manufacturer's instructions;
b. in accordance with the flashing design or method of a registered design professional; and in
accordance with other approved methods.
ii. At the intersection of chimneys or other masonry construction with frame or stucco walls,with projecting lips
on both sides under stucco copings.
iii. Under and at the ends of masonry,wood, or metal copings and sills.
iv. Continuously above all projecting wood trim.
v. At wall and roof intersections.
vi. Where exterior material meets in other than a vertical line.
vii. Where the lower portion of a sloped roof stops within the plane of an intersecting wall cladding in such a
manner as to divert water away from the assembly in compliance with Section R903.2.1.
viii. At the intersection of the foundation and rim joist framing when the exterior wall covering does not lap the
foundation insulation.
2. Pan flashing of windows and doors. Pan flashing shall be installed in accordance with the fenestration
manufacturer's installation and flashing instructions.Where flashing instructions or details are not provided, pan
flashing shall be installed at the sill of exterior window and door openings. Pan flashing shall be sealed or sloped in
such a manner as to direct water to the surface of the exterior wall finish or to the water-resistive barrier for
subsequent drainage. (MN Rule 1309.R703.4.1)
Roof-Ceilinq:
1. Enclosed attics and enclosed rafter spaces formed where ceilings are applied directly to the underside of roof
rafters shall have cross ventilation for each separate space by ventilating openings protected against the entrance
of rain or snow.Ventilation openings shall have a least dimension of 1/16 inch minimum and %inch maximum.
Openings in roof framing members shall conform to the requirements of Section R802.7. Required ventilation
openings shall open directly to the outside air and shall be protected to prevent the entry of birds, rodents, snakes,
and other similar creatures. (MN Rule 1309.R806.1)
2. The minimum net free ventilating area shall be 1/150 of the area of the vented space. (MN Rule 1309.R806.2)
i. Exception:The minimum net free ventilation area shall be 1/300 of the vented space provided both of the
following conditions are met:
a. In Climate Zones 6, 7 and 8, a Class I or II vapor retarder is installed on the warm-in-winter side of
the ceiling.
b. Not less than 40 percent and not more than 50 percent of the required ventilating area is provided by
ventilators located in the upper portion of the attic or rafter space. Upper ventilators shall be located
not more than 3 feet below the ridge or highest point of the space, measured vertically.The balance
of the required ventilation provided shall be located in the bottom one-third of the attic space.Where
the location of wall or roof framing members conflicts with the installation of upper ventilators,
installation more than 3 feet below the ridge or highest point of the space shall be permitted.
3. Buildings with combustible ceiling or roof construction shall have an attic access opening to attic areas that exceed

30 square feet and have a vertical height of 30 inches or greater.The vertical height shall be measured from the
top of the ceiling framing members to the underside of the roof framing members. The rough-framed opening shall
not be less than 22 inches by 30 inches and shall be located in a hallway or other readily accessible location.
Where located in a wall the access shall not be less than 22"wide by 30"high.When the access is located in a
ceiling, minimum unobstructed headroom in the attic space shall be 30 inches at some point above the access
measured vertically from the bottom of ceiling framing members. (MN Rule 1309.R807.1)
4. A kick-out flashing shall be installed where the lower portion of a sloped roof steps within the plane of an
intersecting wall cladding, in such a manner as to divert or kick out water away from the assembly.The kickout
flashing shall be a minimum of 2Yz"long. (MN Rule 1309.R903.2.1)
MN Special Provisions:
1. All automatic garage door opening systems that are installed, serviced, or repaired for garages serving residential
buildings, must comply with the provisions of Minnesota Statutes, sections : F.E ' and :'2�,F., (MN Rule
1303.1400& 1309.R309.4)
MN Energy Code:
1. A building certificate shall be completed and posted on or in the electrical distribution panel by the builder. The
certificate shall not cover or obstruct the visibility of the circuit directory label, service disconnect label, or other
required labels(MN Rule 1322.R401.3).
2. Any insulation assembly installed on the exterior of the foundation walls or on the perimeter of slabs-on-grade that
does not permit bulk water drainage shall: (MN Rule 1322.R402.1.1.3).
i. be made of water-resistant materials manufactured for that intended use;
ii. be installed according to the manufacturer's installation instructions;
iii. comply with either ASTM C 578 or C 1029, as applicable;
iv. be covered with a 6-mil polyethylene slip sheet over the entire exterior surface; and
v. have a rigid, opaque, and weather-resistant protective covering to prevent degradation of the insulation's
thermal performance.The protective covering shall cover the exposed exterior insulation and extend a
minimum of 6 inches below grade. The insulation and protective covering system shall be flashed in
accordance with MN Rule 1309.R703.8.
3. For air permeable insulations in vented attics, a baffle shall be installed adjacent to soffit and eave vents. Baffles
shall maintain an opening equal or greater than the size of the vent.The baffle shall extend over the top of the attic
insulation.The baffle shall be permitted to be any solid material (MN Rule 1322.R402.2.3).

Yeah I have been talking to this guy, new owner of Cheney's place.They have the variance and the requirements
for the garage.They plan to make it smaller than the requirements. But yes,we need the plans submitted to.
When we get everything,we can chat with the County as well. I think they plan to get it done before Sunset project
this year.

FYI—I told this guy we need drawings/plans for this garage and advised him of the street setback,the county ROW,
and road reconstruction net year. I think we should get the county's approval as well if this is OK from a city
perspective.
Let's chat about it more tomorrow—the county is taking land if it is needed for both perm and temp easements. If
you don't agree to their offer on the perm easement,they will start condemnation proceedings. I don't want us to
get caught up in that by approving a new garage in their possible space.
