Resolution - 25-08: Variance Approval for 3916 Mapleton Ave. CITY OF SPRING PARK HENNEPIN COUNTY MINNESOTA RESOLUTION NO. 25-08 APPROVING AN EIGHT (8) FOOT FRONT YARD BUILDING SETBACK VARIANCE TO ALLOW FOR THE EXTENSION OF AN EXISTING GARAGE LOCATED AT 3916 MAPLETON AVENUE WHEREAS,Brent Reid has applied for a variance to construct an addition onto his garage that requires an eight (8) foot front yard building setback variance at his property located at 3916 Mapleton Avenue with parcel number 1711723330055 in the City of Spring Park;and WHEREAS,City Staff has reviewed submitted plans and prepared a planning report dated April 17,2025;and WHEREAS,the Planning Commission of the City of Spring Park met and held a public hearing on April 9,2025 to consider the application,the April 9,2025 planning report,applicant presentation,and public testimony; and WHEREAS,the Planning Commission of Spring Park upon closing the public hearing on April 9,2025,voted on the variance which resulted in a 2 to 2 tie vote passed to the City Council. WHEREAS,the City Council of the City of Spring Park met on April 21,2025 to consider the variance application;and WHEREAS,the City Council of the City of Spring Park reviewed the findings,recommendations,and the WSB planning report dated April 17,2025. NOW,THEREFORE BE IT RESOLVED that the City Council of Spring Park,Minnesota hereby approves the eight(8)front yard building setback variance to accommodate the proposed garage expansion based on the following: 1. The improvement will not impair an adequate supply of light and air to the adjacent property. 2. The variance to the front garage setback does not change the use of the property or add any congestion to local streets. 3. The variance to the front garage setback does not increase the danger of fire or endanger public safety. 4. The proposal would not influence property values,and it is not contrary to the intent of the zoning ordinance as the subject property will continue its existing low-density,single-family use. 5. The use of the property as a single-family home is not changing and it is consistent with the intent of the single-family land use designation established for this property in the City's comprehensive plan. 6. The use of the property as a single-family home with a larger two car garage is reasonable in that the use meets zoning standards for permitted uses and the land use designation of the comprehensive plan. 7. The property owner wishes to use the garage to accommodate a larger vehicle. 8. The requested variance is the minimum variance as determined by the applicant to provide a larger garage on the property.
