Ordinance - 25-05: Amending Chapter 34; Deliquent Utility Accounts CITY OF SPRING PARK COUNTY OF HENNEPIN STATE OF MINNESOTA ORDINANCE NO. 25-05 AN ORDINANCE AMENDING CHAPTER 34: UTILITES, SECTION 34-193, DELINQUENT ACCOUNTS THE CITY COUNCIL OF THE CITY OF SPRING PARK, MINNESOTA ORDAINS AS FOLLOWS: The individual accounts shall become due immediately following the billing. A penalty as prescribed in the utilities rate schedule shall be added to the next quarterly billing for any account unpaid one month after the date of the billing. An additional penalty shall be added for each subsequent month in which such account is unpaid. If an unpaid balance remains for more than 90 days,water service may be shut off without further notice. A service fee will be charged for shut off and turn-on and shall be paid in addition to the unpaid balance. All delinquent accounts as of 10/1 of each year may be certified by the governing body to the county auditor and assume the same status of other taxes against the benefited property. In addition, the City shall also have the right to bring a civil action or take other legal action to collect the unpaid water and sewer charges. In certifying such charges, the amount, the legal description of the premises served, and the name and owner shall be specified. The amounts so certified, together with the service charges and interest at the rate of six percent per annum, shall be extended by the county auditor on the tax rolls against such premises in the same manner as taxes and shall be paid to the city along with the taxes. Effective Date. This ordinance shall be in full force and effective immediately upon its passage and publication.
