Since the HOA’s presentation the City has gone back to look at the information provided and the issue at hand. The agreement in 2012 had an engineering study completed and recently, the current city engineers completed another two engineering studies, one in 2024 and the other in 2026. Both studies show no evidence of any change in topography that would change the calculations made in the current contract. The HOA provided the City with its independent study, which showed a decrease in the City’s percentage from 24% to 19%, contradicting the claim that the percentage had increased. Orono Public Works went and investigated the catch basin in question and informed the City that work was done in 2024 and the Catch Basin is functioning properly. City of Spring Park 4349 WARREN AVENUE, SPRING PARK, MINNESOTA 55384-9711 (952) 471-9051 FAX (952) 471-9160 WWW.CI.SPRING-PARK.MN.US Catch Basins (storm grates in the road) are typically cleaned out twice a year. Lason LawnScape does maintenance of the HOA’s drainfield and other items but does not have a vacuum truck to clean out the catch basin annually. The HOA has stated that the catch basin does not operate or was installed incorrectly. But with the data the City has, this should not be the case. The only issue that could potentially arise is the cleaning of the catch basin which appears to be neglected. (would have been cleaned when City performed maintenance/repairs in 2024) Recommendation – With the data provided by the City Engineer, Orono Public Works, and the study provided by the HOA, City Staff recommend to the Council, no changes to the current 2012 Contract. Page | 1 Update Memorandum Date : September 1 8, 202 6 Prepared By : Chris Bunders , PE (City Engineer) Project : S pring Park MN West Arm Catch Basin - HOA Subject : West Arm Drive Catch Basin Review and Requested Documentation Purpose This memorandum updates the City’s review of the private catch basin located at the west end of West Arm Drive by incorporating the 2024 stormwater evaluation prepared for the West Arm Townhomes Association by IMO Consulting Group. This information supplem ents Moore Engineering’s prior drainage assessments and informs the City’s response to the HOA’s request to increase the City’s cost participation from 24% to 40%. Background Review Moore Engineering previously reviewed the MFRA 2012 drainage evaluation, the HOA’s September 7, 2026 presentation, Moore’s 2024 drainage assessment, and aerial photography from 2012, 2024, and 2026. These reviews consistently show that drainage areas have remained stable over time. The HOA has now provided a 2024 stormwater evaluation prepared by IMO Consulting Group. This report includes updated drainage area calculations, pipe condition assessments, and recommendations for two locations on West Arm Drive. Updated Drainage Area Information The HOA’s 2024 study identifies three contributing drainage areas to the catch basin at the west end of West Arm Drive: • West Arm Townhome Association property: 59% • West Arm Road (City of Spring Park): 19% • HCRRA property: 22% These percentages confirm that the City’s contribution to the drainage area is approximately 19%, which is lower than the 24% cost -share established in the 2012 agreement. The new study does not support increasing the City’s cost participation. Moore Engineering concurs with the drainage percentages documented in the HOA’s 2024 study. Two Carlson Parkway, Ste 110, Plymouth, MN 55447 P : 612.355.7726 Memorandum West Arm Catch Basin Update Page | 2 Condition of the Catch Basin and Downstream Pipe The HOA’s consultant observed the catch basin during a heavy rainfall and found it functioning properly and in good condition. A separated joint was identified in the downstream pipe, but the remainder of the pipe appears to be in good condition. The recom mended repair is a localized cured -in-place pipe lining, with an estimated cost of approximately $2,000. This aligns with Moore Engineering’s understanding that the deterioration is limited and repairable. Evaluation of Potential Additional Drainage Sources The HOA previously suggested that additional stormwater may be entering the system from the south or from HCRRA property. The 2024 study found no evidence of any additional drainage entering the system from these areas. This supports Moore Engineering’s co nclusion that drainage areas have not changed and that the HOA’s claim of increased City contribution is not supported by field evidence. Catch Basin Maintenance Concerns The HOA reported that the catch basin fills, spills over, and deposits sediment between two homes. Moore Engineering’s assessment indicates that this condition is consistent with a lack of routine maintenance rather than increased City drainage. The HOA’s 2024 study also documented pavement failure and structural deterioration at other HOA -owned catch basins, further indicating deferred maintenance. Catch basins should be cleaned every two to three years to maintain proper function. Failure to perform routine maintenance can reduce storage capacity, cause overflow, transport sediment, and in crease localized flooding risk. The City recommends that the HOA inspect and clean the catch basin immediately. Requested Documentation from the HOA During the September 7 presentation, the HOA stated that an engineering evaluation supports increasing the City’s cost participation from 24% to 40%. The 2024 HOA study does not support this claim and instead reinforces the City’s existing cost -share perce ntage. Next Steps if Documentation Is Not Provided If the HOA is not satisfied with this evaluation, Moore Engineering will conduct a full reevaluation of drainage areas on behalf of the City. Because this reevaluation would be required solely by the HOA request , the cost of this reevaluation will be billed to the HOA. Conclusion The HOA’s 2024 stormwater study confirms that drainage areas have not changed, shows that the City’s drainage contribution is approximately 19%, and does not support increasing the City’s cost participation to 40%. The study also identifies maintenance -related issues within HOA -owned infrastructure and recommends pipe repair and catch basin rehabilitation that fall under HOA responsibility. The City will await an an swer from the HOA , and if required Moore Engineering will reevaluate drainage areas at the HOA’s expense. 1 AGREEMENT BETWEEN THE CITY OF SPRING PARK AND WEST ARM TOWNHOMES ASSOCIATION, INC. REGARDING DRAINAGE SYSTEM This Agreement is made as of the _____ day of ____________, 2012 by and between the City of Spring Park, Minnesota (the “City”) and West Arm Townhomes Association, Inc. a Minnesota nonprofit corporation (the “Association”). RECITALS A. West Arm Road is a private road located in Spring Park, Minnesota which serves the West Arm Road Townhomes complex. B. West Arm Road currently has a catch basin and French drain for purposes of stormwater drainage and sediment collection. C. The Association is currently responsible for maintaining the existing catch basin and French drain on West Arm Road. D. The Association has periodically requested assistance from the City in paying for the clean out of the catch basin and French drain and addressing the issue of stormwater drainage in the area. E. The City Engineer has studied the watershed maps of the area and determined that 76% of the stormwater runoff captured by the existing catch basin and French drain on West Arm Road comes from Association property and 24% comes from City property. F. The City is willing to share certain costs related to the stormwater drainage systems serving the area and located on West Arm Road as provided herein. Now, therefore, it is agreed as follows: AGREEMENT 1. The City and Association agree to replace the existing catch basin located on West Arm Road with an improved catch basin and sump (the “New System”). The location for the New System is shown on the attached Exhibit A. The plans and specifications for the New System are attached as Exhibit B. 2. The Association is responsible for hiring a contractor to install the New System. Prior to hiring a contractor, the Association will obtain the written approval of the City for both the contractor and the total cost of the project. 3. Upon completion of the project to the City’s reasonable satisfaction, the City will reimburse the Association for 24% of the cost of installing the New System. 2 4. In the event that there are unforeseen circumstances during installation of the New System which result in an increase in the total cost of the project, the Association will promptly notify the City of the anticipated cost over-runs in writing and will not authorize the contractor to proceed with the work until the City has approved any additional work and costs, which approval will not be unreasonably delayed or denied. 5. The Association shall be responsible for maintaining the New System in good condition and repair. The City will reimburse the Association for 24% of the costs of cleaning out the new catch basin on a regular basis as required to keep it in good operating condition. All other costs of the New System will be paid by the Association. 6. In the event that the topography of the area changes, the City Engineer will review the watershed maps of the area to determine if the drainage patterns and use of the New System by the City and the Association have changed. In the event that it is determined that the relative percentages for use of the New System by the parties have changed, the Association and the City may amend this agreement to reflect such change with respect to the percentage share of the cost of cleaning the catch basin to be paid by each party. 7. Except as otherwise provided above, this Agreement may be amended or terminated only by a written agreement signed by both parties. This Agreement is made and entered into by the parties hereto as of the date first written above. It includes the main white building and two separate structures on the south side of the property, both accessible from Paties Lane. The price has now dropped to $275,000. There has been interest in the past in purchasing this property next to City Hall to help beautify the area. Now that it is for sale again, staff is bringing it to the Councils attention. The Council may approve the purchase by willingly knowing they will use it for public purpose in the future. This purpose does not need to be identified at the time of purchase however, but a future plan will need to be developed. The Council can authorize the City Administrator to negotiate an offer and set a standard maximum price and inform the public why acquiring the property is in the Cities best interest. Recommendation – If Council wishes to move forward with the potential of purchase, authorize the City Administrator to negotiate an offer up to $275,000, the City Administrator will bring back the accepted terms for any required final approval at the next available Council meeting (if there are any). Joining this partnership will give residents access to rain barrels and the City would offer them a discounted price. If the Council approves, Staff recommend allocating $2,000 from the 2027 general fund for $20 off per rain barrel. This will allow us to provide a discount on 100 rain barrels in 2027. If this program is a success, we can look at continuing in 2028. Moore Engineering is willing to match the $2,000 which would then give Spring Park residents a 40% discount on each rain barrel. Staff also recommend offering residents the option of seasonal storage in the basement garage with each rain barrel being individually labeled. We would require residents to winterize the barrel, as well as deliver and drop off/pick up in the fall and spring seasons. Recommendation – Staff recommend approving the allocation of $2,000 for the rain barrel program. Tank Mixer A tank mixer is installed inside the tank bowl.
