The City requires a setback from the Ordinary High Water level of Lake Minnetonka ( elevation 929.4 msl). Section 42-65 € of the Spring Park zoning and shoreland code addresses on legal nonconforming homes. In review of your request against this section of the code, I make the following findings. 1. The property and home preexisted the date of current required 50 foot shoreland setback. 2. The location of the proposed deck is reasonable in relation to the home and the proximity to the OHWL. 3. The proposed deck does not exceed 15% of the current building setback toward the OHWL and is more than 30 feet from the OHWL. Based on these findings we approve the deck location with the following conditions. 1. The deck is constructed primarily of wood and is not roofed or screened. 2. Approved corrosion -resistant flashing shall be applied shingle -fashion in such a manner as to prevent entry of water into the wall cavity or penetration of water to the building structural framing components. Self -adhered membranes used as flashing shall comply with AAMA 711. The flashing shall extend to the surface of the exterior wall finish. Approved corrosion -resistant flashing shall be installed at all of the following locations: (MRC R703.8) a. Continuously above all projecting ledger boards. b. Where exterior porches, decks, or stairs attach to a wall or floor assembly of wood -frame construction. 2. Exterior landings, decks, balconies, stairs and similar facilities shall be positively anchored to the primary structure to resist both vertical and lateral forces or be designed to be self- supporting. Attachment shall not be accomplished by use of toenails or nails subject to withdrawal. (MRC R311.5.1) Exception: The opening between adjacent treads is not limited on stairs with a total rise of 30 inches or less. 3. Guards shall be located along the open sides of floors, stairs, ramps, and landings that are located more than 30 inches measured vertically to the floor or grade below. Insect screening shall not be considered as a guard. (MRC R312.1.1) 4. Required guards at open -sided walking surfaces, including stairs, porches, balconies or landings, shall be not less than 36 inches high measured vertically above the adjacent walking surface, adjacent fixed seating or the line connecting the leading edges of the treads. (MRC R312.1.2) Exceptions: a. Guards on the open sides of stairs shall have a height not less than 34 inches measured vertically from a line connecting the leading edges of the treads. b. Where the top of the guard also serves as a handrail on the open sides of stairs, the top of the guard shall not be less than 34 inches and not more than 38 inches measured vertically from a line connecting the leading edges of the treads. 5. Required guards shall not have openings from the walking surface to the required guard height which allow passage of a sphere 4 inches in diameter. (MRC R312.1.3) Exceptions: a. The triangular openings at the open side of stair, formed by the riser, tread and bottom rail of a guard, shall not allow passage of a sphere 6 inches in diameter. b. Guards on the open side of stairs shall not have openings which allow passage of a sphere 43/8 inches in diameter. 6. Deck ledger connection to band joist - For decks supporting a total design load of 50 pounds per square foot (40 pounds per square foot live load plus 10 pounds per square foot dead load), the connection between a deck ledger of pressure -preservative -treated Southern Pine, incised pressure -preservative -treated Hem -Fir or approved decay -resistant species, and a 2-inch nominal lumber band joist bearing on a sill plate or wall plate shall be constructed with'/2-inch lag screws or bolts with washers in accordance with Table R507.2. Lag screws, bolts and washers shall be hot -dipped galvanized or stainless steel. (MRC R507.2) 7. Placement of ledger screws or bolts in deck ledger & band joists in accordance with Table R507.2.1 and Figures R507.2.1(1) and R507.2.1(2) 8. The lateral load connection required by Section R507.1 shall be permitted to be in accordance with Figure R507.2.3. Where the lateral load connection is provided in accordance with Figure 507.2.3, hold-down tension devices shall be installed in not less than two locations per deck, and each device shall have an allowable stress design capacity of not less than 1500 pounds. Buildings shall have approved address numbers, building numbers or approved building identification placed in a position that is plainly legible and visible from the street or road fronting the property. These numbers shall contrast with their background. Address numbers shall be Arabic numbers or alphabetical letters.
