The City requires a setback from the Ordinary High Water level of Lake Minnetonka( elevation 929.4 msl). Section 42-65 € of the Spring Park zoning and shoreland code addresses on legal nonconforming homes. In review of your request against this section of the code, I make the following findings. 1. The property and home preexisted the date of current required 50 foot shoreland setback. 2. The location of the proposed deck is reasonable in relation to the home and the proximity to the OHWL. 3. The proposed deck does not exceed 15% of the current building setback toward the OHWL and is more than 30 feet from the OHWL. Based on these findings we approve the deck location with the following conditions. The deck is constructed primarily of wood and is not roofed or screened. The property owner submit an application and construction drawings to obtain a building permit for the deck. Tom, you can now pursue a building permit for the your deck. Rd. In the spring of 2017 1 discussed with you and the planner (via email) building a deck on the south side of my home. At that time there was some concern about the rear setback due to the unregistered portion of land that was part of yard impacting the setback (we only had 7 ft of registered land instead of the 10 needed) The accretion that forms the backyard has since been registered and now the property on certificate of title runs all the way down to the lake (attached). Now that the setback issue has been addressed I intend to submit a permit application to build a 10'x20' deck (drawn in on the attached map). I am now circling back with you to double check you/the planner don't see any issues before I submit an application. Please feel free to call or email me with any questions or concerns.
