8. Stairways, Lifts, and Landings. Stairways and
lifts are the preferred alternative to major
topographic alterations for achieving access up and
down bluffs and steep slopes to shore areas.
Stairways and lifts must meet the following design
requirements:
a. Stairways and lifts must not exceed four (4)
feet in width on residential lots. Wider
stairways may be used for commercial
properties and public open -space recreational
properties.
b. Landings for stairways and lifts on
residential lots must not exceed thirty-two
(32) square feet in area. Landings larger
than thirty-two (32) square feet may be used
for commercial properties and recreation
fields and buildings.
C. Canopies or roofs are not allowed on
stairways, lifts, or landings.
d. Stairways, lifts, and landings may be either
constructed above the ground on posts or
pilings, or placed into the ground, provided
they are designed and built in a manner that
ensures control of soil erosion.
e. Stairways, lifts, and landings must be located
in the most visually inconspicuous portions of
lots, as viewed from the surface of the public
water assuming summer, leaf -on conditions,
whenever practical.
f. Facilities such as ramps, lifts, or mobility
paths for physically handicapped persons are
also allowed for achieving access to shore
areas, provided that the dimensional and
performance standards of subitems a to a are
complied with in addition to the requirements
of Minnesota Rules, Chapter 1340.
Fences - General Requirements.
Section 1. Section 3, Subd. D.9.a. is hereby amended to read as follows:
a. Permit Required. No person shall hereafter construct or cause to be constructed
or erected within the City of Spring Park any fence without first making an
application for and securing a fence permit. The Zoning Administrator shall require
an applicant for a fence permit to establish the boundary lines of his property by a
survey thereof to be made by any Registered Land Surveyor.

b. LOCations.. All _ fences shall be .'located

person constructing, or causing the
construction, of such fence unless the owner
of the property adjoining agrees, in writing,
that such fence may be erected on the division
line of the respective properties.
c. Construction and Maintenance. Every fence
shall be constructed in a substantial,
workmanlike manner and of substantial material
reasonably suited for the purpose for which
the fence is proposed to be used. Every fence
shall be maintained in a condition of
reasonable repair and shall not be allowed to
become and remain in a condition of disrepair
or danger, or constitute a nuisance, public or
private. Any such fence which is, or has
become dangerous to the public safety, health
or welfare, is a public nuisance, and the
Zoning Administrator shall commence proper
proceedings for the abatement thereof, when
directed to do so by the City Council. Link
fences, wherever permitted, shall be
constructed in such a manner that no barbed
ends shall be at the top. Barbed wire fences
are prohibited in all districts, except barbed
wire stands on top of fences over seven (7)
feet high may be allowed as an anti -vaulting
measure on fences in "C" and "M" Districts.
d. In no case shall any fence exceed forty-two
(42) inches in height inside the required
shoreland setback. Fences within the "C",
"M", and "R-3" Districts may exceed this
height limitation in the shoreland area for
security fences. In no case shall such fence
be constructed in a manner which will block or
otherwise adversely interfere with an
adjoining property owner's lake view.
e. In no case shall any fence obstruct the normal
passage of runoff water.
f. In those instances where a boundary line fence
exists as an enclosure which restricts access
from the street, a recognizable gate shall be
provided. Such ingress points shall be
unobstructed and a minimum of two and one-half
(2 1/2) feet in width.
Section 2. Section 3, Subd. D.9.g. is hereby amended to read as follows:
g. All fences shall be set back five (5) feet from any lot line abutting a City street or
County road right-of-way and shall comply with the requirements of Section 3.C.7
of this Ordinance. Where the City Engineer has concluded that additional setback
is necessary for general street maintenance, the City shall require a greater fence
setback from the property line.
10. Required Fencing, Screening, and Landscaping.

or storage) abuts property zoned for
residential use, the owner of the commercial
or manufacturing shall provide screening alo
