This letter is in regards to the remodel/repair work that is being performed at your
home. In order to insure that new building construction and remodel work is
compliant with building codes established by the State of Minnesota, the City of
Spring Park requires that a building permit be obtained for all construction. Our
records indicate that there is not a building permit for the remodel/repair work for the
property at 2413 Black Lake Rd., Spring Park.
Any work done without a building permit, approved plans, if required, and periodic
inspections, is being done in violation of the Minnesota State Building Code. If
previously done work appears not in compliance with the Minnesota Building Code,
or cannot be proven to have been done in compliance with the code, it may need to
be removed. Please be advised that failure to obtain a permit prior to performing
work is a violation of Minnesota State Building Code and Minnesota State Law, and
the matter may be referred to the City Attorney's Office for appropriate action.
Please call our office at 952-442-7520 by November 4, 2011, so we can help you
determine if a permit(s) is required for this project. You may also contact the City of
Spring Park, to submit an application and any required paperwork. If you have any
questions regarding what is required to be submitted or feel you have received this

Dear Mr. Dawley;

This letter is in regard to your liability claim against the City of Spring Park (City) for damage to
your property as a result of a sanitary sewer backup on or about June 19, 2014.
The City has liability coverage with the League of Minnesota Cities Insurance Trust (LMCIT). As
you know, I am a claims adjuster for the LMCIT and am handling this loss on behalf of the City.
After very careful consideration and investigation of your claim against the City, we believe that
the City would not be legally obligated to pay for your damages.
Our investigation determined that during the late evening and early morning of June 181h and 191h,
2014, the City of Spring Park experienced a severe rainfall event which exceeded the design
capacity of the City's collection systems. The heavy rainfall caused water from flooded streets to
infiltrate into the City's sanitary sewer system. The sanitary sewer became inundated with the
extra water, resulting in a sewer back-up into your home.
In order for the City to be negligent, the failure of the sanitary sewer system and subsequent
damage must be caused by the City's failure to exercise ordinary and reasonable care in the
construction, maintenance, and inspection of its system. It is not reasonable to expect a city to
guarantee the operation of their sanitary system under all circumstances. Unfortunately, these
systems are subject to Acts of God, such as the excessive amount of rainfall your city experienced
in May and June 2014, and specifically on June 19.
As you may have heard, the City of Spring Park does carry no-fault sewer back-up coverage
through the League of Minnesota Cities Insurance Trust. This coverage does not apply for this
occurrence because your loss was caused by a catastrophic incident as defined in the coverage
agreement between the City and the LMCIT.
