Contractor came in today to pull two permits — one for re -roof and the other for replace
two windows and a door. He wanted the two permits separate as one is going for an
insurance claim.
He said he's going to be doing some remodeling inside this house. He's going to be
1. Adding a closet to a bedroom
2. new flooring
3. New kitchen cabinets
4. Rearranging the kitchen
5. New tile
Contractor was told that cosmetic fixes did not require a permit but any electrical or
plumbing work, permits would have to be pulled. Contractor indicated there would be
some changes to electrical and plumbing and those contractors would pull the
appropriate permits.

Dear Mr. Dawley:
Today your contractor, Eugene Juarez, stopped by city hall in response to a previous letter sent
to you dated October 24, 2011 from our building inspections department. I told Mr. Juarez I was
aware of the letter sent to you and was expecting Mr. Juarez to stop in. Attached are some
documents that I think will help clear up why a building permit application is being requested:
1. Memo to file dated 9-9-11 explaining the expected scope of remodeling Mr. Juarez said
he'd be doing at your residence.
2. An Inspection Notice dated 10-5-11 for a plumbing inspection. Inspection Notice states
"Building permits required for framing, insulation and electrical work. Apply at city hall
ASAP."
3. An e-mail correspondence between myself and our inspections department trying to
determine why the letter dated October 24th was written.
4. Building permit application form (sent to Juarez).
As you can see, the inspections department is asking your contractor to fill out a building permit
application and scope of work as they believe the remodel went beyond what was originally
intended.
Please let me know if you have any questions regarding this. Otherwise the building permit
application and scope of work should be submitted to city hall and we will forward the
documents to our building inspections firm.

This letter is in regards to the remodel/repair work that is being performed at your
home. In order to insure that new building construction and remodel work is
compliant with building codes established by the State of Minnesota, the City of
Spring Park requires that a building permit be obtained for all construction. Our
records indicate that there is not a building permit for the remodel/repair work for the
property at 2413 Black Lake Rd., Spring Park.
Any work done without a building permit, approved plans, if required, and periodic
inspections, is being done in violation of the Minnesota State Building Code. If
previously done work appears not in compliance with the Minnesota Building Code,
or cannot be proven to have been done in compliance with the code, it may need to
be removed. Please be advised that failure to obtain a permit prior to performing
work is a violation of Minnesota State Building Code and Minnesota State Law, and
the matter may be referred to the City Attorney's Office for appropriate action.

Hi Tracy. Attached is a letter dated October 24, 2011 you sent to the property owner at 2413 BLR in our city. The
contractor came to city hall today wondering what was going on. I didn't know what was going on until after he left and
I looked in the property file and saw an inspection sheet (attached). I also came across a memo I wrote to the file the
same day the contractor came in to the city inquiring about permits (attached). The contractor is stating he was told he
didn't need permits beyond what he initially applied for. However, the inspection sheet signed by (I think Nick Qualle)
says differently.
Any suggestions as to what I should do? I can call the contractor and tell him according to the inspection sheet his work
went beyond what he initially described and he needs to apply for a building permit. I note from my permit spreadsheet
that building permits 11-33 and 11-34B and 11-09P were applied for. I don't see an electrical permit applied for unless
you have record of it.

Hi Wendy
First, he does have a permit for an electric permit for a kitchen remodel. So he is good there. I would suggest that he
complete a building permit application and submit a scope of work and a drawing of what he is doing (a floor plan of walls
be taken out, new walls, etc.) It sounds like he did not intentionally not pull a building permit, so I would say that we waive
any penalty fees.
It is a little hard with a kitchen remodel to know if a building permit is required. You do not need one for new kitchen
cabinets or flooring. I almost always have them talk to Nick or Dan. They seem to know the right questions to ask. A
contractor generally knows what needs a permit.
