The proposed garage will be relocated from across the street. In the past, a property owner had requested the lot across the street be combined to Lot 11, Rose Lawn but the City Council denied the requested combination because the roadway would split the property. The present lot is an undersized 4,882 sq. ft lot required lot size is 10,000 sq. ft. The present home is 758 sq. ft. The present home is 35 ft from the lakeshore, the required footage is 75 ft and 2.8 ft from the north side line. required is 10 ft. The zoning ordinance requires two (2�roperty parking spaces. The existing chain link fence is in the public right-of-way easement. Recommend: The lot, side yard, front and lakeshore setbacks are non- conforming. The topography of the lot is such that the lot falls off toward the lake approximately 8 ft. from the front building line to the back of the house. Presently, they have two (2) plus open parking spaces. If a single car garage is to be placed on the lot with the garage doors facing the street a parallel head -in parking stall could be placed in front of the garage which would meet the 2 parking space requirement. Recognizing the shallowness of the lot and the topography, and that no owner of a non -conforming use can be denied a resonable use of his property, I would recommend approval of the variance request to place the detached garage 55 ft to 61 ft from the lake and 12 ft to 15 ft from the property line. It appears feasible to get MCWD approval after discussing the proposal with Cliff Reep, of Hickok & Associates. In response to your letter of July 19, 2004 asking for a current Hardcover Calculation Worksheet for the existing lot of record at 2421 Black Lake Rd, which falls below R1 lot and width standards, the enclosed two hardcover views are provided. Additionally, the following comments are offered for consideration. I was caught by surprise with your letter. As you know I have made pain staking attempts to follow all construction ordinances as I planned and executed the construction plans for the remodeling of the family dwelling at the stated location. Since, the denial of the one, side yard variance request I made via the Planning/Council process in November 2002,1 have strived to stay within all ordinances and regulations, requiring no variances in the construction process. The remodeling occurred utilizing the same existing foot print, adding a city permit approved garage and deck. I also maintained the pre- existing location for the gravel driveway and concrete slab to the west of the house. I have enclosed pictures of these pre-existing items for your viewing (the concrete slab (n disrepair) is underneath the wood planking in which the hot tub sits). And lastly, the building inspector has been involved throughout the building and inspection process to avoid surprises and to ensure compliance. I have provided two hardcover calculations, both are my best representation of the geography, with the square footage being the difference; one based on Hennepin county tax records and the other from the latest survey dtd 1/13/04. Based on the ordinance definition of hardcover, °Impervious" — Webster defined as: "Incapable of being penetrated or affected", I excluded the pre-e)asting gravel driveway and gravel side piece of the yard (the driveway was pre-existing and both have no plastic underneath, i.e. are penetratable). I have included in the calculation, items which I feel should not to be included sidewalk (which is partially pervious), deck (which has open ground underneath it and seems to be listed in the ordinance as a partially pervious item (but no calculation is provided for a partial pervious items)) and lastly, a portion of the concrete stab (area not covered by the sun room calculation (that covers the majority of the slab)) which was apart of the pre-existing foot print of the structure. Even with the questioned hardcover items included in the calculation the hardcover calculation shows 27.68% and 25.03% respectively. Keep in mind that the subject plot also seems to qualify for status as falling below R1 size standards as well. The City of Spring Park has liability coverage with the League of Minnesota Cities Insurance Trust (LMCIT). As you know, I am a claims adjuster for LMCIT and will be handling this loss on behalf of the City of Spring Park. After very careful consideration and investigation of your claim against the City of Spring Park for water/sanitary sewer back-up related damages, we believe that the City of Spring Park is not responsible for your property loss. Our investigation has concluded that during the late evening and early morning of June 181h and 191h, 2014, the City of Spring Park experienced a severe rainfall event which exceeded the design capacity of the city's collection systems. The heavy rainfall caused water from flooded streets to infiltrate into the city's sanitary sewer system. The sanitary sewer became inundated with the extra water, resulting in a sewer back-up into your home. As you may have heard, the City of Spring Park does carry no-fault sewer back-up coverage through the League of Minnesota Cities Insurance Trust. This coverage does not apply for this occurrence because your loss was caused by a catastrophic incident. A catastrophic incident is a rainfall which exceeds the amount determined by the National Weather Service to constitute a 100 year event. Although the city truly regrets your loss, we have made a determination that the city is not responsible for the loss and, therefore, we must deny your claim.
