I respectfully ask approval of this request and offer this addendum to further explain this variance
request and to add clarification for my building plans.
This request seeks two variances to city building requirements, one is the 30' requirement from
my property line (Street/roadway). And the other is a 10' variance from an adjacent property
line.
30' from Street/road way - The physical structure of my house is 30' from the
established (existing) roadway, however only a few feet from my property line. I
seek to build the new garage on line with my current house structure (which is 30'
from the roadway). Because the actual roadway (asphalt) does not boarder on the
property lines in my neighborhood, it seems that all houses in the neighborhood (at
least on my side of the block) are not in compliance with this requirement (see
picture #1).
10' from adjacent property line — My proposed new double garage (20') requires a
variance to this requirement. New construction as planned would place this structure
within 5' of the neighbor's property line and 7' from their housing structure. The
placement of the proposed garage on my property allows for fire department access
for both properties. Additionally, the alignment of my house structure and garage
will be on line with that of my neighbor's house and garage (places three or four
houses on line). My neighbors approve of this variance and in fact needed one on the
south side of their property when they added their garage.
The double garage is required due to the steep slope of my side yard (from street, heading to the
lake and which requires a volume of fill to be able to construct), hindering my ability to park
vehicles or to be creative with a design.

As per your request, I have reviewed the variance request summary and
visited the property site at 2421 Black Lake Road. I have summarized my
thoughts and concerns as follows:
General
• In the event of a major fire emergency on Black Lake Road, the use of our
aerial ladder truck would be unlikely at best. The narrow roadway and
close power lines create a significant challenge for aerial ladder truck
operations on this roadway.
• Due to the above mentioned aerial ladder truck issues, the use of ground
ladders for firefighting, second floor rescue, and roof ventilation would be
the next best option.
• Access to the lake side (west side) of the residences must be adequate for
transporting ladders, fire hoses, and equipment. Obviously we must go
between and around the structures.
• The construction of the addition at 2421 Black Lake Road does potentially
cause an exposure problem with the residential property directly south. In
the event of a major fire, the 7 feet between the houses does cause some
concern since the distance between structures is minimal.
Conclusion and Recommendation
• 1 believe that the five foot building set back would not cause significant
problems for firefighting, access, and normal activities if the following
issues are addressed.
o The chain link fence on the northwest corner of the lot at 2421
should be either remove or have a larger gate opening added.
Firefighters would likely use this route to access the lake side of
house(s) carrying hose lines and ladders. The existing chain link
fence (with no gate) clearly inhibits access.

o Remove the two trees between 2421 Black Lake Road and the
residence just south. These two trees restrict access to the lake
side and would clearly interfere with ground ladder operations
between the two houses.
If the above recommendations can be implemented, then fire protection issues
and safety concerns would be resolved.

BACKGROUND
Chris Snow owns a home located at 2421 Black Lake Road. This site exists as a legal
lot of record and has sewer connections. The home is currently non -conforming with
regard to the north side yard setback and the setback from the street. ' Please see
Exhibit B. Mr. Snow would like to build a two car garage on the south side of his. house,
extending within five feet of the neighbor's property line. Additionally, the garage would. .
extend, within 15 feet of the public right-of-way for Black Lake Road, Mr.. Snow has
requested a variance from the front yard setback as well as the south side yard setback
allowing for the two car garage_
ISSUES ANALYSIS
Front Yard Setback. Section 3, Subd. E.6 of the Spring Park Zoning Ordinance states
that where adjacent structures within the rsame block have setbacks from a street
different from those required, the minimum setback from the street shall be the average
of the setbacks of the adjacent structures fronting on such street. In the case of Mr.
Snow's property, the adjoining properties have setbacks less than the required R-1
setback of 30 feet. Because Mr. Snow's property; as well as the adjoining. neighbors,
have a lesser setback.that what is required within the R-1 District, the average. of the
setbacks would apply. In this case, it does not appear that Mr. Snow requires a setback
variance from the front yard, as it is. allowed by ordinance. The proposed garage
addition is set back further from the street than his home and is in line with the adjoining
neighbor's property. No variance would be required in.this case.

Side Yard Setback. Currently, the home at 2421 Black Lake Road is a non-
conforming structure in that..it does not meet the required side yard setbacks along its
north property line. Section 3, Subd. B.7 of the Spring Park Zoning Ordinance allows
for lawful non -conforming single family structures to be expanded to improve the
livability and/or utility provided the structure is not expanded into the required setback
areas.
The applicant could build a single car garage and comply with required setbacks without
need for variance. However, the applicant is pursuing a five foot setback variance to
accommodate a 20 foot wide two car garage. In our review, a 20 foot two car garage
would be the minimum practical width for two stall garage.
In considering the variance, Section 7, Subd.. B.2 outlines criteria that must be
demonstrated, as follows:
a. Special conditions and circumstances which exist which are peculiar to the land,
structure or building involved which are not applicable to other land, structures, or
buildings in the same district.
11. Special conditions may include exceptional topography or water conditions
in the case of existing lot or parcel of record, narrowness, shallowness, or
shape of the property.
2. Special conditions and. circumstances are not primarily economic in
nature.
Comment: In examining Mr. Snows request, we find that his lot does not offer a
number of alternative building sites. A fifty foot setback from ordinary high water
level of Black Lake, as well as steep slopes to the west of the building prohibit
expansion in this direction. Setbacks off the street right-of-way limit potential for
garages forward of the house. Expansion south of the existing home., is the only
logical expansion area for the home.
b. Literal interpretation of the provisions of this Ordinance would deprive the
applicant of the rights commonly enjoyed by property owners of other properties
in the same district under the terms of this ordinance.
Comment: We believe that.a garage in Minnesota is a reasonable use of the
property and should be provided for within the range of the City ordinances. The
variance of five feet would allow for a minimum 20 foot, two car garage on .the
site. The Planning Commission should make a determination whether a two car
garage is reasonable use of the property in. relationship to the requested side
yard variance.

C. Special conditions and circumstances do not result from the actions of the
applicant.
Comment: In this case, the desire to place a two car garage mandates the need
for the five foot setback. The Planning Commission must make a determination
as to whether a two car garage is reasonable use of the property. If that finding
is made, then the five foot setback seems to be warranted.
d. Granting the variance request shall not confer on the applicant any special
privilege that is denied by this ordinance to other land, structures, or buildings in
_ the same district_
Comment: Garages are inherent with single family homes and are a reasonable
use in consideration of _Minnesota climate. We believe that some building
expansion is warranted as a means of promoting private reinvestment in the
Spring Park single family areas. Again, the Planning Commission must make a
determination. whether the two car garage represents a reasonable use of the
property.
Other Conditions. In examination of the variance request, we do not believe that the
attached garage will cause any additional congestion on the public streets, that the
reinvestment in the home should result in appreciation of the home and adjoining
properties.. We believe that building expansion in these areas is consistent with the
Comprehensive Plan and the suggestions for promoting reinvestment in the existing
housing stock of Spring Park. .
One issue that we do have with the requested five foot building setback off the south
property line is the separation between the proposed garage and the home to the south
would be only seven feet. This setback should be examined by the City's Fire Chief to
determine whether adequate access is provided between the buildings to provide
appropriate fire protection.
CONCLUSION
In our examination of the variance request for 2421 Black Lake Road, we find that
requested front yard setback is not necessary due to conditions already outlined in the
ordinance that allow for flexibility where other properties are set back closer to the street
than the required R-1 setbacks.
In considering the side ,yard setback variance, the Planning Commission and Council
must make a determination as to whether the garage represents reasonable use of the
property. A single car garage could be constructed on the site. without any variance in
compliance with the 10 foot setback required in the R-1 District, however, if the Council
and Planning Commission find that a 20 foot, two car. garage would better

accommodate the needs of the applicant and be in keeping with the City's
Comprehensive Plan policies for .promoting reinvestment in its single family housing
stock, then the five foot setback may be . justified on the basis of lot configuration,
topography, and reasonable use.
