The insurance company has determined that the power outage was an act of God and not the responsibility of the City, therefore they would not pay a claim on this bill. It was suggested that you file a claim with your insurance company or investigate the Flood Disaster Aid available for this area. It was very helpful to discuss with you and to y p p ry p be able to visualize your project. When I returned to City Hall I looked D.J. Goman in your neighbors' property file at 2433 Black Lake Road for a survey of Utility Superintendent their property. I did locate a minimal survey, similar to yours, that did Sharon Cori not show clear measurements (distances) to the property line that Deputy Clerk adjoins you and their lakeshore. I did mail you a photocopy of this Wendy Lewin survey yesterday to assist you with updating your survey. Office Assistant As you know, your builder has been to City Hall with several different scenarios in an attempt to gain a building permit to build a deck that will fulfill your needs and desires and, at the same time, stay within the ordinance requirements of the City of Spring Park. There has been a lot of time devoted to trying to make this work within a comfort zone without having an updated survey. Each new scenario presented however has not satisfied an allowance for setbacks from the side yard and the lake that would be defensible without having an updated survey. At this time, if you wish to build a deck that exceeds what was removed for maintenance purposes, we are going to require an updated survey and the proposed deck drawn on the updated survey in order to show that all of the setbacks have been complied with. The proposal you are bringing to the City however is too close to call and beyond the comfort level without an updated survey. Also, please be aware that at last night's Council meeting your original denied building permit was briefly discussed as it is part of a monthly review. I mention this because when you are eventually granted a building permit for your deck rebuild, this will no doubt be scrutinized closely by the Council because of the original denial. incerel , Wendy Lewin Deputy City Clerk Enclosures 6-1-07 Builder submitted a revised deck plan after being denied original design. Builder and home owner agreed they will just replace the original deck that was demoed. They are however asking at this time to extend the original deck towards the lake (westerly) four more feet and northerly two more feet By extending this deck four more feet towards the lake, the builder said he and the homeowner measured and the northwestern corner of the proposed deck is 60 feet from the lake and the southwestern corner of the extended deck is more than 75 feet from the lake. These measurements arenot confirmed when using a ruleron the survey dated 1990 and using the scale 1" = 20'. Builder had asked to be able to pour the footings for the deck over the weekend and builder was told I would check with Bruce Vang for permission and would call the builder with the permission or not. Call placed to Vang with the request and message left on voicemail. Meanwhile, uponsketching the new proposed deck on the survey dated 1990 and measuring, it was realized the new proposed deck would still encroach in the 50 foot setback. I called the builder immediately and left a message on voicemail informing him he needed to return to city hall to discuss the most recent proposal and, that I had still not heard from Vang about pouring footings this weekend. I also informed the builder via voice mail that it was possible a new survey would be needed if the homeowner continued to want to build the new deck close to the setback in orderto determine what would be allowable. The City has liability coverage with the League of Minnesota Cities Insurance Trust (LMCIT). As you know, I am a claims adjuster for the LMCIT and am handling this loss on behalf of the City. After very careful consideration and investigation of your claim against the City, we believe that the City would not be legally obligated to pay for your damages. Our investigation determined that during the late evening and early morning of June 18th and 19eh, 2014, the City of Spring Park experienced a severe rainfall event which exceeded the design capacity of the City's collection systems. The heavy rainfall caused water from flooded streets to infiltrate into the City's sanitary sewer system. The sanitary sewer became inundated with the extra water, resulting in a sewer back-up into your home. In order for the City to be negligent, the failure of the sanitary sewer system and subsequent damage must be caused by the City's failure to exercise ordinary and reasonable care in the construction, maintenance, and inspection of its system. It is not reasonable to expect a city to guarantee the operation of their sanitary system under all circumstances. Unfortunately, these systems are subject to Acts of God, such as the excessive amount of rainfall your city experienced in May and June 2014, and specifically on June 19. As you may have heard, the City of Spring Park does carry no-fault sewer back-up coverage through the League of Minnesota Cities Insurance Trust. This coverage does not apply for this occurrence because your loss was caused by a catastrophic incident as defined in the coverage agreement between the City and the LMCIT.
