Re: Permit Application No. 80-19
Location: 2429 Black Lake Road, Spring Park
Purpose: Lake setback variance
Dear Mr. Hanson:
At its meeting on April 17, 1980, the Board of Managers of the
Minnehaha Creek Watershed District reviewed the subject permit
application.
It approved the permit for a variance allowing for a lakeshore
setback of 41 feet. Such distance shall be measured from the
Ordinary High Water Level established for the lake of 929.4 NGVD,
All work shall be done in a manner to prevent erosion and silta-
tion both during and after construction in accordance with the
Minnehaha Creek Watershed District guidelines, a copy of which is
enclosed,
All work shall conform to the requirements of the City of Spring
Park.
Approval is granted under Minnehaha Creek Watershed District Rule J,
Permits are valid for one year.
Please contact us at 473-4224 when the project is about to com-
mence so an inspector may view the work in progress.
Thank you for your cooperation.

Dear Mr. Hodges:
Your bill for damages caused by the extraordinary
rainfall and power outage on July 6th was reviewed
by the Council and investigated by the City's insurance
carrier.
The insurance company has determined that the power
outage was an act of God and not the responsibility of
the City, therefore they would not pay a claim on this
bill.
It was suggested that you file a claim with your insurance
company or investigate the Flood Disaster Aid available
for this area.
The Council will reconsider your request after these
other avenues have been investigated.
Yours.very truly,

471-7555 Dear Mr. Christensen:
At their last meeting the City Council reviewed your letter
and concerns regarding the back-up problems you have been
experiencing. The Council had authorized the City Engineer
to check elevations on the City sewer main and in your
basement. Attached.is a letter from the Engineer on his
findings.
As stated by the Engineer the elevation difference should
allow for adequate slope and drainage. Therefore, the City
Council determined that there was nothing the City could do
to alleviate your problems and instructed this letter be sent
so you may correct the problem as you see fit.
If you have further questions you may call David Goman
at our office or Ken Adolf at Schoell & Madson office.

Subject: Sanitary Sewer Elevation at 2429 Black
Lake Road
Ladies and Gentlemen:.
As directed, we have obtained the elevations of the sanitary sewer by 2429 Black
Lake Road and also of the basement floor. Following is a tabulation of the information;
Downstream manhole invert (No. 39) 932.08
Upstream manhole invert (No. 39A) 933.00
Calculated invert of sewer main at
service connection 932.47
Elevation of basement floor 936.36
Elevation of sewer cleanout not accessible
The elevation difference between the basement floor and the city sewer at the
service connection is about 2.89 feet. The length of the service line is about 50 feet.
The elevation difference should allow for adequate slope on the service.
The basement floor elevation of 933.81 Dave obtained from the City's records
might be the previous basement floor elevation. If this is the case, the service stub
within street right of way would likely have been constructed at minimum slope.
Please contact me if you have any questions.
Very truly yours,

Dear Bill and Cherrie Bartolotto:
Gary Hughes
(952) 471-7867
It was nice to meet you yesterday, Bill. As you know, myself and DJ
Goman our Utility Superintendent, met at your residence along with
Administration
you, your builder, John Meader and his assistant for a visual inspection
Sarah Friesen
Administrator
of our deck proposal. It was very helpful to discuss with you and to

be able to visualize your project. When I returned to City Hall I looked
D.J. Goman
in your neighbors' property file at 2433 Black Lake Road for a survey of
Utility Superintendent
their property. I did locate a minimal survey, similar to yours, that did
Sharon Cori
not show clear measurements (distances) to the property line that
Deputy Clerk
adjoins you and their lakeshore. I did mail you a photocopy of this
Wendy Lewin
survey yesterday to assist you with updating your survey.
Office Assistant
As you know, your builder has been to City Hall with several different
scenarios in an attempt to gain a building permit to build a deck that
will fulfill your needs and desires and, at the same time, stay within the
ordinance requirements of the City of Spring Park. There has been a
lot of time devoted to trying to make this work within a comfort zone
without having an updated survey. Each new scenario presented
however has not satisfied an allowance for setbacks from the side yard
and the lake that would be defensible without having an updated
survey.
At this time, if you wish to build a deck that exceeds what was removed
for maintenance purposes, we are going to require an updated survey
and the proposed deck drawn on the updated survey in order to show
that all of the setbacks have been complied with.

We at the City feel we try to do everything possible to assist
homeowners with improving their property and we too understand the
desire on the homeowners part to save money. The proposal you are
bringing to the City however is too close to call and beyond the comfort
level without an updated survey. Also, please be aware that at last
night's Council meeting your original denied building permit was briefly
discussed as it is part of a monthly review. I mention this because
when you are eventually granted a building permit for your deck
rebuild, this will no doubt be scrutinized closely by the Council because
of the original denial.

Builder submitted a revised deck plan after being denied original design. Builder
and home owner agreed they will just replace the original deck that was demoed.
They are however asking at this time to extend the original deck towards the lake
(westerly) four more feet and northerly two more feet By extending this deck
four more feet towards the lake, the builder said he and the homeowner
measured and the northwestern corner of the proposed deck is 60 feet from the
lake and the southwestern corner of the extended deck is more than 75 feet from
the lake. These measurements arenot confirmed when using a ruleron the
survey dated 1990 and using the scale 1" = 20'.
Builder had asked to be able to pour the footings for the deck over the weekend
and builder was told I would check with Bruce Vang for permission and would call
the builder with the permission or not. Call placed to Vang with the request and
message left on voicemail. Meanwhile, uponsketching the new proposed deck
on the survey dated 1990 and measuring, it was realized the new proposed deck
would still encroach in the 50 foot setback. I called the builder immediately and
left a message on voicemail informing him he needed to return to city hall to
discuss the most recent proposal and, that I had still not heard from Vang about
pouring footings this weekend. I also informed the builder via voice mail that it
was possible a new survey would be needed if the homeowner continued to want
to build the new deck close to the setback in orderto determine what would be
allowable.

Date of Loss:
6/19/14
Dear Mr. Bartolotto;
CONNECTING & INNOVATING
SINCE 1913
This letter is in regard to your liability claim against the City of Spring Park (City) for damage to
your property as a result of a sanitary sewer backup on or about June 19, 2014.
The City has liability coverage with the League of Minnesota Cities Insurance Trust (LMCIT). As
you know, I am a claims adjuster for the LMCIT and am handling this loss on behalf of the City.
After very careful consideration and investigation of your claim against the City, we believe that
the City would not be legally obligated to pay for your damages.
Our investigation determined that during the late evening and early morning of June 18th and 19eh,
2014, the City of Spring Park experienced a severe rainfall event which exceeded the design
capacity of the City's collection systems. The heavy rainfall caused water from flooded streets to
infiltrate into the City's sanitary sewer system. The sanitary sewer became inundated with the
extra water, resulting in a sewer back-up into your home.
In order for the City to be negligent, the failure of the sanitary sewer system and subsequent
damage must be caused by the City's failure to exercise ordinary and reasonable care in the
construction, maintenance, and inspection of its system. It is not reasonable to expect a city to
guarantee the operation of their sanitary system under all circumstances. Unfortunately, these
systems are subject to Acts of God, such as the excessive amount of rainfall your city experienced
in May and June 2014, and specifically on June 19.
As you may have heard, the City of Spring Park does carry no-fault sewer back-up coverage
through the League of Minnesota Cities Insurance Trust. This coverage does not apply for this
occurrence because your loss was caused by a catastrophic incident as defined in the coverage
agreement between the City and the LMCIT.
