The resolution was filed with the Registrar of Titles for Hennepin County on August 2, 1988 which put the vacation of easement of record on the Certificate of Title for 2436 Black Lake Road. However, because the property is registered property, a court order is needed to take the easement off of the Certificate of Title. In the event you commence a court action to vacate that portion of the easement vacated by the City's resolution, Spring Park will not object to or oppose the action. I have enclosed a copy of the resolution which has been recorded. When we get the recording information, I will forward it to you also. WHEREAS, a public hearing was held on July 18, 1988 after notice was published, NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SPRING PARK that the following easement be vacated according to the attached survey dated June 17, 1988 and the legal description dated June 20, 1988.
