When DJ and I were over at another residence on Black Lake Road measuring deck setbacks (Yes, our friend, John Meader), the homeowner brought to our attention the landscaping that was currently in progress at 2471. We were shocked, to say the least, as we had no idea landscaping of this magnitude was going to be done to this property. We notified the Minnehaha Creek Watershed immediately and a stop work order was issued to the property. The Watershed has since lifted their stop work order. Baker was informed that a landscape plan needed to be submitted to the city for hardcover calculations. Baker's builder dropped off the survey with the retaining walls, steps and a rain garden illustrated (attached). This survey also shows re -calculated hardcover. With one significant but rare exception — where the city formally creates a boundary line commission pur- suant to Minn. Stat. § 465.79—cities have limited authority to resolve bound- ary line disputes for private property owners without incurring unwanted or unanticipated liability. Boundary line disputes can arise in a variety of ways. Ownership of property can be clouded from the start by faulty surveys, sale documents, and deeds. Or accidental encroachments can occur. For example, a garage may be mistak- enly built a few feet over a boundary line or a fence may meander off course. Such disputes can be resolved by mutual agreement or, if no agreement can by reached, by the court. When the dispute is solved by mutual agree- ment, usually an easement or license is granted by the landowner to the encroaching party. In these situations, an attorney is normally needed to draft the legal documents. A matter for the courts. When parties cannot resolve their dispute, a court of law must be asked to impose a resolu- tion to the problem.This occurs when one party files a lawsuit against another to "quiet title" to the disputed bound- ary line. When a boundary line dispute is brought to the court, both parties will need an attorney to prepare plead- ings and attend one (or potentially several) hearings. Court resolution of a boundary line dispute may be an expensive and lengthy process. Landowners may wait more than a year to have their sched- uled day in court and finally receive the court order resolving their prob- lem. Because of the expense and time By Rachel L. Carlson involved, many landowners may be tempted to ask the city, instead of the court, to impose a solution to their dispute. In the alternative, the parties may not understand the legal process for approaching the courts for a legal solution to their problems and may simply assume that the city —which issues zoning and building permits — is the correct body to which they should voice their concerns. Creating a city boundary commission. Cities have only limited ability to resolve boundary line disputes between neighbors who cannot agree. Cities may by resolution create a formal boundary commission under Minn. Stat. § 465.79 to assist in resolving dis- putes. A boundary commission must be formed of residents of the county or counties in which the city is located, who are familiar with real property. The commission could potentially include local real estate agents, attor- neys, surveyors, and appraisers. The commission, upon petition of one of the disputing landowners, must "attempt to establish agreements ... as to the location of common boundar- ies." If an agreement cannot be reached, the commission may make recommen- dations in the form of a "plan" to the city council as to the best resolution of the boundary dispute. After a hearing where all the parties to the dispute are given an opportunity to present their information, the city council can accept or modify the plan.The city council's plan must then be submitted to the court for hearing and final review. The court may modify the plan as needed, and issue a final plat that permanently resolves the boundary dispute. A city that forms a boundary com- mission may assess all or part of the potentially considerable cost of resole- . ing the dispute to the benefited property owners (including the costs of hiring commissioners with knowledge of real estate, commissioning surveys, and the cost of staff and city attorney time). City boundary commissions are rare. Due to the costs involved, cities do not generally have the resources to assist a small number of landowners with dis- putes. A city commonly will create a boundary commission only where a dispute concerns numerous property owners and potentially city property or important city street right-of-way. Formation of a city boundary commis- sion will not likely save private property owners any time or money because the city's costs can be assessed back to their property. In addition, property owners ,will still likely want their own attorney to represent their interests in the pro- cess, before the commission, city coun- cil, and the court. Don't allow staff to get involved. In cities without boundary commis- sions (or most cities in Minnesota), city staff should not try to resolve bound- ary line disputes between neighbors. Except through the formal establishment of a boundary line commission, cities generally lack the authority to impose permanent solutions to disputes. In addition, city staff may lack the tech- nical knowledge to draft the necessary documents. Attempting to resolve the disputes may make the city vulnerable to legal action if the documents pre- pared by staff are not drawn up cor- rectly, or could potentially make the city vulnerable to claims it interfered with a property owner's rights to his or her property. Doing what they did without following the required process is not allowed (Site plan review process of Section 5, required prior to receiving a building permit). The final result seems to meet the stipulations listed in 4.b on page 89, however, the plans should be reviewed and approved by the City Engineer and the watershed District to make sure that this is the case. Since the watershed lifted their stop work order, we can probably assume that the project meets their criteria. You might ask the City Engineer to review and ask the Bakers to complete an application for a plan review and pay the appropriate fees to pay for the engineering review. I'm not sure what application is used for building permits, but if the application doesn't already request it, a question should be added that asks about amount of impervious surface. This would then provide the information needed to trigger the administrative plan review of Section 5. Fees — City of Spring Park 3 CITY OF SPICING PARK SPICING PARK, MINNESOTA RESOLUTION 07 - A RESOLUTION ADOPTING AN ORDINANCE AMENDING CHAPTER 6 OF THE CITY CODE BY ADDING A NEW ARTICLE IV REGARDING THE REGULATION OF SPECIAL EVENTS IN THE CITY OF SPICING PARK AND THE ESTABLISHMENT OF PERMIT REQUIREMENTS WHEREAS, the Police Chief recommended that the City Council adopt an ordinance regulating special events occurring in the City of Spring Park for purpose of protecting the public health, safety and welfare by providing a permit procedure and authorizing the imposition of conditions on special events; and WHEREAS, the current City Code does not address the regulation of special events other than dances and musical concerts; and WHEREAS, special events have the potential to burden City services (such as police, fire, and utility services) and to affect public safety; and WHEREAS, the City Council believes that it is in the public interest for the City to regulate special events occurring in the City of Spring Park for the protection of the health, safety and welfare of City residents and the general public. NOW, THEREFORE, in consideration of the foregoing, it is hereby: RESOLVED: that the City of Spring Park hereby adopts the following ordinance adding a new Article IV to Chapter 6 of the City Code regarding special events: CITY OF SPRING PART{ SPRING PARK MINNESOTA ORDINANCE NO.07- AN ORDINANCE AMENDING CHAPTER 6 OF THE SPRING PARK CODE BY ADDING A NEW ARTICLE IV THERETO REGARDING THE REGULATION OF SPECIAL EVENTS AND THE ESTABLISHMENT OF PERMIT REQUIREMENTS THE CITY COUNCIL FOR THE CITY OF SPRING PARK ORDAINS: That the Spring Park Code is hereby amended by adding to Chapter 6 a new Article IV thereto as follows: ARTICLE IV. SPECIAL EVENTS DIVISION I. GENERALLY Sec.6-172. Policy. It is the intent and purpose of this Article to establish regulatory requirements and procedures for purposes of protecting the health, safety and welfare of the public during the conduct of special events within the City of Spring Park. Sec.6-173. Definitions. For purposes of this Article, the following words shall have the definitions given to them in this section unless the context clearly indicates or requires a different meaning. Person. A natural person, group of natural persons, association, organization, club, partnership, limited partnership, limited liability company, corporation or any other legal entity. Special Event. The following constitute a special event: (1) Any outdoor gathering of more than 35 individuals persons on public property assembled for a common purpose for a period of one hour or longer; (2) Any event or gathering (whether on public or private property) which generates on -street parking needs for more than 20 vehicles; (3) Any event or gathering which impedes, obstructs or blocks the free flow of pedestrian or vehicle traffic on public streets or sidewalks at any time; (4) Any event or gathering on public property using (a) a tent or membrane structure having an area in excess of 400 square feet or (b) a canopy ORDINANCE NO. 2 covering an area in excess of 600 square feet or (c) when heat sources, cooking equipment, spark/ember producing processes or open flame are used near or contained within a tent, membrane structure or canopy of any size. Examples of special events include, but are not limited to: block parties, marathons, walkathons, runs/walks/races, bicycles rides or races, skiing events or races, parades, circuses, arts or crafts fairs, flea markets, exhibits, carnivals, fishing contests, and any other gatherings or events of a similar nature. Secs. 6-174 — 6-179. Reserved. DMSION II. PERMIT Sec. 6-180. Permit Required. No person shall hold, host, conduct, present or participate in a special event within the City unless a permit has been issued for such event as provided in this Article. Sec.6-181. Exceptions. The following events are not required to apply for permits under this division: (1) funeral processions; (2) occasional, private, social parties held in private residences or private lots; (3) events sponsored or managed by the City of Spring Park; (4) events held in or on the grounds of any school, place or worship, athletic field, arena, auditorium or other place of assembly used for regularly established assembly purposes. Sec.6-182. Application. Written application for a special event permit on a form prescribed by the City Council must be delivered to City Hall at least 45 days in advance of the proposed date on which the event is to occur unless the time requirement is waived by the City Council. The application must include the name and address of the person holding or sponsoring the event; the event location or route; the time of commencement and termination of the event; and a general description of the event. The application will be considered complete only when the form is fully completed, signed by the applicant, and the application fee paid to the City. The application fee will be as prescribed by the City Council and set forth in the schedule of fees in City Code and on file in City Hall. The application fee is non-refundable. Sec. 6-183. Investigation and Review. Upon receipt of a complete application, the City Administrator will deliver a copy of the application to the Police Chief and the Fire Marshal for investigation and review. ORDINANCE NO. 3 Within 10 days of receipt of the application, the Police Chief and Fire Marshal will deliver to the City Administrator a written recommendation for approval or disapproval of the permit based on findings regarding the effect of the proposed special event on public health, safety and welfare, including, but not limited to, the ability of the City to direct and control traffic and parking and the Event's compliance with the City Fire Code. If the event involves the use of state trunk highways, the Police Chief will make necessary arrangements with the Minnesota Department of Public Safety for alternate routes or other necessary changes to the event. Sec. 6-184. Council Action; Imposition of Conditions. The City Administrator shall refer the complete application and the recommendations of the Police Chief, Fire Marshal and City Administrator to the City Council for action at its next regular meeting following receipt of the recommendations. The City Council may deny the permit, approve the permit, or approve the permit subject to reasonable conditions deemed necessary to protect the health, safety and welfare of City residents and the public. Such conditions may relate to any of the following: (1) Location and hours of the event; (2) Sanitation and/or availability of potable water; (3) Security and/or crowd control; (4) Parking; (5) Traffic direction and control; (6) Emergency and medical services; (7) Clean-up and trash disposal; (8) Insurance; (9) Lighting; (10) Fire safety, including meeting the provisions of the City and State Fire Codes; (11) Temporary barricades and/or fencing; (12) Size, location and removal of advertising or promotional materials; (13) Noise levels and methods for compliance with City noise ordinances; (14) Alcohol consumption; (15) Notification of neighboring residents and businesses; (16) Any other conditions which the City Council deems reasonable or necessary to protect the health, safety and welfare of City residents and the public. Sec. 6-185. Denial of Permit Application. The City Council may deny a special event permit application based upon a finding or determination that: (1) The event would endanger public health, safety or welfare; (2) The event would unreasonably inconvenience City residents or the general public; ORDINANCE NO. 4 . r (3) The event would unreasonably infringe on the rights of abutting or neighboring properties; (4) The event would conflict with another event or interfere with construction or maintenance work; (5) There are not sufficient public safety personnel or event staff available to safely and successfully operate the event; or (6) The event would violate any law, rule, regulation or ordinance of the City of Spring Park, State of Minnesota, Hennepin County, Minnehaha Creek Watershed District, Lake Minnetonka Conservation District or any agency or other governmental body having jurisdiction. Sec. 6-186. Payment of Expenses. The applicant for a special event permit must pay all expenses incurred by the City with respect to the event, including, without limitation, the expenses related to the provision of any additional police or fire department services required for the event and the enforcement of the permit, including any permit conditions. The City may, as a condition of permit approval, require the applicant to deposit with the City an amount up to 115% of the estimated amount of such expenses as determined by the City; provided, however, the applicant's obligation to pay all expenses as provided in this section is not limited to the amount of the deposit. In the event that the actual expenses of the City related to the event are less than the amount of the deposit, the City will refund the excess funds to the applicant. Sec. 6-187. Issuance of Permit. A special event permit will be issued to the applicant by the City Administrator upon approval of the City Council and receipt by the City of full payment of the application fee and any deposit required to cover estimated costs to be incurred by the City for the event. Sec. 6-188. Indemnification. The permit holder must agree to defend, indemnify, and hold harmless the City, its Council members, employees, officers, contractors and agents from and against any and all liability, claims, damages, costs, judgments or expenses, including attorneys fees, resulting directly or indirectly from any act or omission arising out of, caused by, or related to the conduct of the activities authorized by the permit and such agreement will be part of the permit. Sec. 6-189. Penalty; Enforcement. (1) Any person who violates any condition of a special event permit or any provision of this Article shall be guilty of a misdemeanor punishable as provided in Sec. 1-13 of the City Code. ORDINANCE NO. 5 (2) The City may enforce this Article using any of the following methods: a. Citation by police officer or any other City official; b. Criminal misdemeanor prosecution; or c. Permit revocation; including immediate termination of the event and/or disbursement of persons gathered. This ordinance shall be in full force and effect upon its passage and publication. At the same time we were informed of this, we were also informed that the immediate neighbor to the south of the new construction is "livid" because of what she deems to be encroachment in the side yard setback. Hughes indicated there could be a potential lawsuit coming because of this so-called encroachment. Memory recall is this: earlier this summer there was a concern received about the possibility of the new construction being too close to the south side yard setback. I don't recall how this concern was received by staff. Suffice it to say Orono building inspections was notified and requested they do a site visit wherein the side yard measurements were verified to insure there was no encroachment. We were notified, I believe verbally, that there was no encroachments and the new construction was properly placed per the survey/plan. According to Hughes, south neighbor Ann Marie Borne, is furious over the placement of the new residence and she said the contractors putting in the paver driveway were even putting the driveway on her property. The driveway has since been relocated according to Hughes. I told Hughes the only thing we were aware of was the earlier concern about the side yard encroachment and we felt it had been dealt with. I told Hughes we've never taken a phone call from neighbor Borne and according to conversation with the builder, Paul Thomas Homes, Borne is supposedly more than satisfied with the new construction. My questions relate to property line disputes between neighbors. We recently issued a fence permit (yes, the fence I asked you about a couple of weeks ago). The fence applicant would not agree to placing the fence inside of his property line much more than a couple of inches and got around the maintenance issue by manufacturing the fence so that the fence sections can be removed and maintained totally from the applicant's property. Now the rear -yard adjoining neighbor to the south is claiming the fence was in fact placed upon his property and upon examining the fence applicant's new survey and the angry neighbor's older survey, it looks as though there is a discrepancy in the lot lines. We sent these two surveys to Schoell and Madsen and they contacted Mark Gronberg, the most recent surveyor, and S&M agrees with Gronberg's methodology versus the older survey. This does nothing to assuage the angry neighbor's defense that the fence is misplaced. The angry neighbor claims there were stakes put in the ground when the new survey was conducted but feels they were either moved or knocked over and wrongly replaced in order to benefit the fence applicant. Sarah and I went out and took measurements but we're dealing with inches versus feet, it's too difficult to be accurate. On another matter, pretty much the same issue, an adjoining neighbor to the south of new construction on Black Lake Road claims the new construction was placed too close to the property line and didn't conform with the ten foot side yard setback. This complaint initially started as a rumor and we immediately asked our building inspector to check this out. We have had verbal confirmation only from him that they believe the new construction was placed upon the property according to plan. What do we do about these things? Sarah feels it is a city's responsibility to make sure.things are placed where they are supposed to be however how much money does a city spend trying to get to the bottom of a he said/she said thing? What if surveys performed by different surveyors show conflicting boundary lines? And, what if a resurvey shows a misplacement? I guess a fence can be moved but a new house can't. Do not issue any certificate of Occupancy for this home until this issue is resolved. We do not want to allow the building to be occupied. A stop order should be immediately issued to discontinue work on the building until the violation is corrected. 2. The City has the right to require the violation to be corrected per the approved plans. The reasonableness will depend on how far the building construction has progressed. Other cities that we work for have required tear down and corrections. These efforts were generally imposed when the violation was caught early in the construction process (ie. foundation work or framing). 3. The city could issue an after the fact variance. The applicant would need to submitt a variance application and demonstrate that why the variance is needed and justified. This is an option for the applicant, however, their are no assurances of approval by the city. 4. The applicant could pursue a Zoning text amendment to request a reduction to the city's side yard setback. This would require the city council to consider a change in zoning standards, however, in light of the narrowness of the city's residential lots, and many nonconforming homes some adjustment in the setback may be considered. This would have application city wide and may reduce the number of future variance requests. Please discuss these options with the city attorney, she may have other suggestions. The angry neighbor claims there were stakes put in the ground when the new survey was conducted but feels they were either moved or knocked over and wrongly replaced in order to benefit the fence applicant. Sarah and I went out and took measurements but we're dealing with inches versus feet, it's too difficult to be accurate. On another matter, pretty much the same issue, an adjoining neighbor to the south of new construction on Black Lake Road claims the new construction was placed too close to the property line and didn't conform with the ten foot side yard setback. This complaint initially started as a rumor and we immediately asked our building inspector to check this out. We have had verbal confirmation only from him that they believe the new construction was placed upon the property according to plan. What do we do about these things? Sarah feels it is a city's responsibility to make sure things are placed where they are supposed to be however how much money does a city spend trying to get to the bottom of a he said/she said thing? What if surveys performed by different surveyors show conflicting boundary lines? And, what if a resurvey shows a misplacement? I guess a fence can be moved but a new house can't. My question to you, and what council is asking, is what can be done now, after the fact? The city is asking the builder provide an as -built in order to determine if there was an encroachment; however, if that is found to be the case, what is a city supposed to do? Obviously the house can't be moved at this point. Lyle said usually when something like this happens an after -the -fact variance is applied for and, has to be granted, and there is the cost of the variance application fee assessed to the builder — big deal, I think our variance fee is $200. Section 5 of the Spring Park Zoning/Shoreland Ordinance shall be amended by repealing the existing Section in its entirety and by replacing it with the following: Sec. 5. Administration —Site Plan Review and Approval Requirements. (a) Purpose. To insure that the purposes of this Ordinance are adhered to, it is hereby determined that a comprehensive review of site, building and development plans for multifamily, commercial, industrial, and institutional developmerts shall be made by the planning commission and approved by the city council prior to the issuance of any building permits by the building official pursuant to the procedures established by this section. (b) Approval Required. All multi -family residential, commercial, industrial, and institutional development or redevelopment projects in the City involving: (1) Erecting of a building or buildings; (2) Moving of a building or buildings to a location or locations within theCity; (3) Changing the use of a building or parcel of land where the proposed change may result in change of traffic patterns, parking, or compatibility of land use; (4) Modifying, enlarging, or constructing an addition to an existing building or buildings; (5) Accessory site improvements and/or land features of a parcel of land that result in the need for additional parking or (6) Grading, site preparation, and removal or placement of soils, rock and concrete material require the submission of detailed site and building plans to the City for review and approval. No building permit will be issued by the City until complete plans as required by this Section have been submitted by the applicant and reviewed and approved by the City. No certificate of occupancy will be issued by the City unless the project has been constructed in complete accordance with site and building plans approved by the City. (c) Exceptions. The following shall be excepted from the foregoing site and building plan review and approval requirements: (1) Detached single family residential structures, or uses or structures accessory thereto. (2) Modifications, additions, or enlargements of existing structures which do not increase the gross floor area of the building by more ban 10 percent and which do not require a variance from the provisions of this Zoning Ordinance may, at the discretion of the City Administrator, be exempted from some, or all, of the procedures for building and site plan approval contained in this Section. Notice of City review of applications for site plan review will be sent 2 to all property owners within 350 feet of subject property. The applicantmust provide the City with documentation showing that the applicant has submitted any required applications to all other jurisdictions (i.e. watershed district, DNR, etc.)having permitting and approval authority overthe proposed project. (f) Information Requirement. The information required for all site and building plan applications generally consists of the following items, and all information must be submitted unless expressly waived by the City Council: (1) Certificate of Survey, completed within 5 yearsand prepared by a registered land surveyor. Monuments must be placed on site to allow physical inspection. (2) Site Plan, including the following: a. Name and address of developer/owner. b. Name and address of architect/designer. c. Date of plan preparation. d. Dates and description of all revisions. e. Name of project or development. f. A scaled plan or, for multifamily, institutional, commercial or industrial properties, a certificate of survey, depicting the following: 1. Scale of plan (engineering scale only, at oneinch equals 100 feet or less). 2. North point indication. 3. Lot dimension and area. 4. Required and proposed setbacks. 5. Location, setbacks and dimensions of all buildings on the lot including both existing and proposed structures. 6. Location of all adjacent buildings located within 100 feet of the exterior boundaries of the property in question. 7. Location, number, dimensions, and setbacks of existing and proposed parking spaces, including drive aisle width. 8. Location, number, and dimensions of existing and proposed loading spaces. 9. Location, width, and setbacks of all curb cuts and driveways. 10. Vehicular circulation. 11. Sidewalks, walkways, trails. 12. Location of recreational and service areas. 13 Location of rooftop equipment and screening. 14. Provisions for storage and disposal of waste, garbage, and recyclables, including details for screening exterior trash/recycling enclosures. 15. Location, sizing, and type of water and sewer system mains and proposed service connections. 16. Location of ordinary high water level, if lot is riparian. 17. Location of 100 year flood elevation, if applicable. 18. Snow storage or snow removal plans. 19. Utility Plans, including location of electrical, telephone, cable, satellite, fiber optic, or other utility equipment including switching or transformer equipment above and below ground. 3 (2) Grading/Stormwater Drainage Plan showing the following: a. Existing contours at two ibot intervals. b. Proposed grade elevations, two foot maximum intervals. c. Drainage plan including configuration of drainage areas and calculations. d. Storm sewer, catch basins, invert elevations, type of castings, and type of materials. e. Spot elevations. f. Proposed driveway grades. g. Surface water ponding and treatment areas. h. Erosion control measures. i. Location of ordinary high water level if lot is riparian. j. Location of 100 year flood elevation, if applicable. k. Location of any delineated wetlands, if applicable (3) Landscape Plan showing the following: a. Planting schedule or table containing the following: 1. Symbols. 2. Quantities. 3. Common names. 4. Botanical names. 5. Sizes of plant material. 6. Root specification (bare root, balled and burlapped, potted, etc.) 7. Special planting instructions. b. Plans and elevation drawings showing bcation, type and size of all existing significant trees to be removed and/or preserved. c. Planting plan (showing all species to scale at normal mature crown diameter or spread for local hardiness zone). d. Planting detail (showing typical installation according to standard Minnesota Nursery Landscape Association planting practices). e. Typical sections with details of fences, tie walls, planter boxes, tot lots, picnic areas, berms and other features f. Typical sections with details of landscape islands, planter beds, and foundation plantings with identification of materials used. g. Note indicating how disturbed soil areas will be restored through the use of sodding, seeding, or other techniques. h. Delineation of both sodded and seeded areas with respective areas in square feet. i. Coverage plan for underground irrigation system, if any. j. Where landscape or man-made materials are used to provide screening from adjacent and neighboring properties, a cros&through section shall be provided showing the perspective of he site from the neighboring property at the property line elevation. k. Other existing or proposed conditions which could be expected to affect landscaping. I. Snow storage areas. 4 (4) Construction Staging and Construction Hazard/Nuisance Mitigation Plan addressing traffic, safety, and nuisance issues created by construction activities as established in Section 3, Subd. N of this Ordinance. (5) Lighting Plan, including the following: a. Site plans indicating the location of all illuminating devices, fixtures, lamps, supports, reflectors and other lighting devices. b. Description of the type of illuminating devices, fixtures, lamps, supports, reflectors and other lighting devices. The description may include, but is not limited to, catalog cuts bymanufacturers and drawings (including sections where required). c. Photometric plans illustrating the angle of the cutoff or light emissions, and illumination field of the proposed site lighting. (6) Building Plans, including the following: a. Architectural elevations of all principal and accessory buildings including photos if applicable, showing type, color, and materials used in all external surfaces. b. "Typical" floor plan and "typical' room plan drawn to scale with a summary of square footage foreach use or activity. c. Material specification including color for all exterior materials. d. Roofline details, including any equipment or building elements extending above the roofline, including but not limited to vents, antennae, HVAC units, or otherequipment. (7) Other plans and information as follows: a. Legal description of property under consideration. b. Fire protection plan. c. Type, location and size (area and height) of allpermanent signs to be erected upon the property. A sign permit shall be required for all signs. d. Sound source control plan. (g) Waiver of Requirements✓Appropriateness. The City Council may waive any of the required submission requirements upon presentation of information that demonstrates unique conditions of the site, construction operation or size of project. All information is required unless waived by the City Council. (h) Minnesota State Building CodelFire Code. The review and approval of site improvements for compliance with the requirements of the City adopted building and fire codes is in addition to the site plan review process established under this Section. The site plan approval process does not imply compliance with the requirements of the building and fire codes. (i) Plan Agreements. All site and construction plans officially submitted to theCity shall be treated as a formal agreement between the applicant and theCity.
