According to this survey, this proposed new dwelling meets the City of Spring Park's setbacks and hardcover requirements. It is our intention to bring to the Council a possible conflict in the interpretation of Section 3, Subd. E., #'s 6 and 7, (page 44 attached). While number 6 reads in part `In no case shall the required setback from the street exceed the minimum setback established for the district" there is no such provision in number 7 of that same subdivision. Although the proposed placement of the new dwelling meets all required setbacks, it would not meet the averaging requirements of adjacent structures and would therefore render the building site non buildable. We as city staff believe this particular language in section 7 to be deficient in terms that even though dwellings may meet the regular shoreline setback standards, they would be required to use averaging instead. Staff requests at this time the Council approve the lakeside setback for 2471 Black Lake Road as 50' and not the averaging requirement. Staff also requests that this particular confusing language be addressed and clarified by NAC at such time the zoning ordinance is updated. /wI ? ��T /l!
