Expanding a non -conforming use property by
requesting a covered deck.
I checked this site again today, and feel that if
the proposed covered deck is to be fabricated with-
in the setback requirements I can see no problem::
in allowing the request as for the cat walk and
landing. I feel, because of the uniqueness of thb.
terrain, permitting the catwalk to encroach into
the side yard setback would not be detrimental to
the zoning.
Provided however, the walkway does not exceed four
feet in width, and/or does not encroach or become
closer than six feet to the side lot line.

I was at the property with both the owner and the contractor.
I realize the importance for a current survey but due to the
existing circumstances of existing fences and retaining walls
that have been in existance prior to the Brown's acquiring
the property, I felt that maybe the Commission would accept
an accurate scale plat plan drawing. As I am asuming that
someone at sometime would have surveyed the adjoining properties
to errect their structures.
I shall inform the contractor, once again, to fabricate such
a plat plan or else request the property owner to acquire
a current survey. Also, I would the Commission to view this
property, if possible, prior to the next scheduled meeting
with the above stated points in mind.

Attached is a request for a three (3) foot variance to the
required ten (10) foot side yard set back for construction
of a deck. This provision is not set forth by ordinance
but rather by council policy resolution that contains no
requirements for appeal. Therefore, if your members see
fit to approve this application without a public hearing
you may do so.
However, after reviewing the application if you feel it is
in the best interest to call for a public hearing this is
your prerogative.
The application does have letters of approval from the
neighboring property owners.
The building inspector has viewed the property and made
suggestions which the applicant has incorporated in his
drawing.

This is an "after the fact" variance request which is
a result of a neighbor complaint.
The Building Inspector has reviewed the site and
deems the steps to be new. There is no record of
any owner of the property obtaining a building
permit for the steps.
No permit was obtained for the present replacement
of the deck or steps.
A variance was granted for the deck on April 21,
1980.

Dear Mr. Cantwell,
Thank you for submitting the survey of your property. In
review of your plan and survey the new stairs on the side
are an encroachment, encroaching on the required 10 foot
side yard set back. A variance will be necessary, enclosed
is an application. The variance procedure takes about six
weeks, it requires a public hearing before the Planning.
Commission, notification of neighbors within 350 feet and
a notice needs to be published. If a variance is not applied
for the stairs will need to be removed immediately. The fee
for a variance is $100.00. The Planning Commission meets on
the second Wednesday of each month.
The Building Inspector has made an inspection and has
problem with your construction. I would suggest after
you have gone thru the variance procedure you contact
the Building Inspector to make corrections, a copy of
inspection notes are enclosed.

or open space less than the minimum required by
this Ordinance, and if the yard or other open space
as existing on the effective date of this Ordinance
is less than the minimum required, it shall not be
further reduced. No open space required to be
provided about any building or structure shall be
included as part of any open space required for
another structure.
3. Shoreland Setback. Notwithstanding any provision
to the contrary in this Ordinance, in all districts
the setback from the ordinary high water mark of
any public body of water shall be fifty (50) feet.
4. The following shall not be considered as
encroachments on required yard setbacks:
a. Chimneys, flues, belt courses, sills,
pilasters, lintels, ornamental features,
cornices, eaves, gutters and the like provided
they do not project more than two (2) feet
into a required yard.
b. A one (1) story enclosed entrance for a
detached single family, two family or
townhouse dwelling provided it does not extend
into the front yard setback more than four (4)
feet.
C. =Steps, uncovered porches, stoops, landings or
similar features in front —or rear Cyards�,
provided they do not extend above the entrance
floor level of the building or more than six
(6) feet into the required yard.
d. Laundry drying and recreational equipment such
as swing sets and teeter totters, arbors,
trellises, air conditioning or heating
equipment in rear yards provided they do not
project within five (5) feet from any lot
line.

Referencing your letter February 27, 1996 re: Deck Construction.
In 1995, I found it necessary to replace rotting deck boards, joists, and stringers on a portion of my existing
deck. The attached sketch shows the repairs made during the 1995 summer. The portion repaired had pine 2x6
J oists overlaid with 1/2"plywood, with lx6"redwood deck boards which were "shimmed' atop the plywood.
The plywood and joists had been installed with approximately a 1" pitch across the 6* width of the deck to
provide a semi -dry storage area beneath the deck. However, this construction allowed seedlings to sprout
between the deck boards and retain water that caused subsequent rotting. The shims beneath the decking
allowed the boards to "float' and the nails popped loose. This had been a constant problem since my purchase
of this property in 1984. The "rail" on this deck was a cantilevered section with attached "seats" with supports
every 4+. This cantilevered section was causing the 2x8" stringers to toe out causing loss of support to the 2x6''
J oists. Since approximately 1986, numerous deck boards were individually replaced, and in 1994 all of the joists
adjacent to the porch were replaced with green treat 2x6" 's. Stairway #2 in the sketch was also repaired at
that time using green treated lumber. Previous stairs were 2x12"risers with 1x2 cleats and 2x6"treads, with
cantilevered hand -rail matching the deck rail, all of standard pine, and using nails only for asseembly. In
repairing this stairway, the 1 x2" cleats were replaced with 2x2' cleats, and all assembly was with phosphate -
treated screws. The cantilevered hand -rail was replaced with 2x2" stiles -straight -up- attached to the risers to
prevent the "toe -out' that was occuring.
In 1995, all of the remaining 2x6' joists(pine) were replaced with green treated, adjusting the former joist
hangers to eliminate the 1 " pitch and replacing where necessary. The former 2x8"(pine) deck stringers were
replaced with 2x10" green treated lumber, and the cantilevered rails/seats were replaced with 2x2"stiles and
1 :6"top rail. (stiles on 6 1/2"centers). Some of the 4x47pine) support posts were replaced with green treated
lumber and the concrete pylons which had been cast over 4"post holes using 1 gallon ice-cream buckets for
form were re -cast (using 5-gallon buckets as forms) over the old.. Stairway Itl (in the sketch) formerly
consisted of 2x 10 risers with lx2"cleats and 2x6"treads with a pipe -handrail' was 24'mde without a platform.
The risers abbutted the concrete block wall depicted, and the lower ends rested in soil causing rot. A concrete
slab 4"thick was poured over the pre-existing foundations for a now non-existant building, and new pylons were
installed for 4x4"posts for a 32'k36 " platform. This stairway was increased to 36"wide (General OSHA regm't)
The risers are 2x10"s with 2x2"cleats and 2x6"treads-all green treated. All deck boards were replaced with
Ix6"green treated, including the deck portion repaired in 1994 (for cosmetic purposes). The stairs repaired in
1994 were bleach -treated to match the 1995 construction, and allowed to' weather' for uniform appearance, and
all construction will be treated with Thompson's Wood Protector Deck Finish' in Spring 1996.
The above defined constructions, with sketches, are available for inspection at any time. Since this work was
considered as normal house maintenance, a construction permit was not deemed necessary, but I am wiling to
pay a reasonable fee for a late filing, if that is deemed necessary. Stairway #2 was increased 12"toward the
property line, but is well within the 'set -back' allowed for the current garage, and should not be a problem. All
other construction is basically board -for -board replacement.
