It was nice to see you. At this time I am returning your check number 8514 in the amount of $1,485.62. The City appreciates your enthusiasm and haste in paying this. However, at last night's public hearing the city engineer apologized for his miscalculation of the assessment. Although some projected costs from the initial (feasibility) report went down, the actual cost of purchasing easements and higher than anticipated contractor bids due to soil conditions and bituminous costs increased. Therefore, it was agreed to continue the public hearing to Monday, April 201h, and between now and that time, hold another neighborhood meeting to clarify increased costs and assessments. You will soon be receiving a notice from the city engineer regarding this neighborhood meeting to be held at City Hall on Wednesday, April 15th at 7 p.m. If you are unable to attend either of these meetings, you will also be notified by mail of the change in the assessment. I apologize for this confusion and hope you have any and all questions answered before this project proceeds to the next step. I wish I was prepared to answer the most likely pressing question of all — how much will the increase be? I don't know but assume the engineer will have those calculations prepared by the neighborhood meeting next week. Thank you, Steve. Dear Mr. Bremer, You have inquired as to the non -conforming status of the dwellings located at 4365 Warren Avenue in Spring Park. In our research the tax records indicate that the duplex was constructed in 1930. The tax records do not identify the year the smaller individual units were constructed. Our property files do not provide evidence of a building permit or history on the two smaller dwelling units. Section 42-63(d)(5) on the Spring Park Zoning ordinance requires: " Not more than one principal building shall be located on a lot." This zoning provision was adopted in 1983. Each of the buildings containing dwelling units constitutes a principal building. The three separate buildings on the lot is non -conforming condition. Additionally, based on the County's aerial photos the two smaller buildings do not appear to meet required setbacks. To qualify as a Legal non -conforming use we need to determine if all the buildings were legally established prior to 1983. The Duplex meets this condition but we need to verify the existence of the two smaller dwelling prior 1983. As a legal non -conforming use the Spring Park zoning code allows. 1. Normal maintenance of the building including repairs and alterations that do not physically extend or intensify the nonconforming use. This would allow you to replace siding, windows and roof. 2. Under State Statute a legal nonconforming use that is destroyed, or razed can be rebuilt in the same size, configuration and volume if a building permit is obtained within 180 days of the buildings destruction. If the use is discontinued for a period of one year the legal nonconforming status is lost and all future use must be incompliance with the applicable zoning regulations. There are no restrictions that prohibit the sale of the property. The grandfathered rights of a Legal nonconforming use run with the property and not ownership. They do not lapse with the property sale. Any new property owner will hold the same rights and responsibilities as you being the current owner. There is a need to demonstrate that the two smaller dwelling units on your property legally existed prior to 1983 to be declared a legal nonconforming use. If you could provide documentation that the dwellings existed prior to 1983 we can make that declaration. Items may include any building permits, title information, dated photographs, third party testimony that these buildings were dwellings prior to 1983, or any information that would demonstrate the age of these dwellings would be helpful.
